1973-15 Rezoning Allman Addition to Businessii it KODIAK ISLAND BOROUGH ORDINANCE NUMBER 73 -15 -0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOTS 15A, 17A, 19A and 21A OF THE ALLMAN ADDITION FROM R -1 AND UNCLASSIFIED to BUSINESS WHEREAS, AS 29.33.090 empowers the Borough to enact zoning ordinances and provide for their administration, enforcement and amendment, and WHEREAS, the Kodiak Island Borough has pursuant thereto adopted Chapter 5 of the Code of Ordinances and Resolutions which provides for planning and zoning provisions and procedures, and WHEREAS, according to the Comprehensive Planning and Zoning Map adopted by the Kodiak Island Borough, Lots 15A, 17A, 19A and 21A had been zoned R -1 with the back unsubdivided portion being zoned Unclassified, and WHEREAS, John Fray and Harold Sargent had petitioned the Borough Planning & Zoning Commission for a vacation and replat of the smaller lots and incorporation of the unsub- dividid into the present sized lots; said vacation and re- plat approved, and WHEREAS, further request was received to rezone the entire replatted lots to Business, and WHEREAS, a public hearing was held on said request, no objections were voiced and consent for the change in zoning was received from the City of Kodiak, and WHEREAS, the Planning and Zoning Commission has re- commended that this area be zoned to Business as it is contiguous to a business zone, NOW, THEREFORE, BE IT ORDAINED by the Kodiak Island Borough Assembly of the Kodiak Island Borough that the property known as Lots 15A, 17A, 19A and 21A now classified R -1 and Conservation, as platted on plat prepared by Roy A. Ecklund, recorded September 1, 1972, be and the same 7 n is hereby reclassified to Business, and that the Comprehensive Plan of the Kodiak Island Borough be and the same is hereby amended accordingly, and that a public hearing be held on this Ordinance seven (7)days after notice of the same has been given in the Kodiak MIRROR, and on the date of second reading thereof, and that this Ordinance become effective at the expiration of thirty (30) days after its final passage and approval.
