AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
REZONING LOTS 8, 9, 10, OF BLOCK 5 OF BARANOF HEIGHTS FROM
!R -2 TO R -3 AND REZONING LOTS 6, 7, 8, AND 9 OF BLOCK 7 OF
BARANOF HEIGHTS FROM R -3 TO R -2.
WHEREAS, AS 29.33,.070 empowers the Borough to enact a
Zoning Ordinance and provide for its administration, enforcement
and amendment, and
i WHEREAS, the Kodiak Island Borough has pursuant thereto
;adopted Chapter 5 of its Code of Ordinances and Resolutions, which
'provides for planning and zoning g provisions and procedures, and
WHEREAS, according to the Comprehensive Planning and
;Zoning Map adopted by the Kodiak Island Borough, Lots 8, 9, and
;lo of Block 5 of Baranof Heights Subdivision have been zoned R -2
and
WHEREAS, a petition has been received from Murl Estes

stating that he is the owner of Lots 8, 9, and 10, Block 5
Baranof Heights Subdivision and asking that the same be rezoned
from R -2 to R -3 and
WHEREAS, the Planning & Zoning Commission held a public
hearing on the above request on March 21, 1973, and after said
public hearing denied the rezoning request, stating that the area
would not accommodate higher denisty, and
WHEREAS, the Borough Assembly having considered the
matter on appeal, and having determined that an exchange in zoning
Of two areas, Lots 8, 9, and 10, Block 5 and Lots 6, 7, 8, and 9
of Block 7, of which Mr. Estes is the owner, would not increase
the density of this area, and that public necessity, convenience
and good zoning practice required the reclassification of said
lots.
NOW" THEREFORE, BE IT ORDAINED by the Borough Assembly
of the Kodiak Island Borough that the property known and described
as:
Lots 8, 9, and 10, Block 5 of Baranof Heights
Subdivision; Now classified as R -2, be and the
same are hereby classified as R -3, and

Lots 6, 7, 8, and 9, Block 7, Baranof Heights
Subdivision now classified as R -3, be and the
sane are hereby classified as R -2, and that a
public hearing on this reclassification
be held after at least seven (7) days notice of the time and place
for such hearing has been published in a paper of general
circulation in the Borough, at which public hearing all interested
parties and citizens shall have an opportunity to be heard.
