AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY
REZONING AN UNSUBDIVIDED PORTION OF U. S. SURVEY 1396
BOUNDED ON THE NORTHWEST BY LILY LAKE AND ON THE SOUTHEAST
li BY LOTS ONE (1) THROUGH EIGHT (8) OF ALLMAN ADDITION TO THE
CITY OF KODIAK.
WHEREAS, ALASKA STATUTES 29.33.090 empowers the
Borough to enact a Zoning Ordinance and provide for its

:1 administration, enforcement and amendment, and

WHEREAS, the Kodiak Island Borough has pursuant thereto
adopted Chapter 5 Of its Code of Ordinances and Resolutions,
which provides for planning and zoning provisions and pro-
f!
i cedures, and

WHEREAS, according to the Comprehensive Planning and
;i Zoning Map adopted by the Kodiak Island Borough, this unsub-
j divided portion of U. S. Survey 1396 has been zoned UNCLASSIFIED,
and

WHEREAS, a Petition has been received from MILDRED MARKHA
jl and JOHN FRAY, stating that they are the owners of this unsub-
divided portion and re
que3ting same be rezoned from UNCLASSIFIED
to BUSINESS to coincide with zoning of Lots One (1) through
Eight (8) of Allman Addition, and
WHEREAS, the Petition was considered and approved by
the Planning and Zoning Commission on the 7th day of March,
1973, after a public hearing was held thereon and said body has
recommended the reclassification of said property to business
and there was-only one objection voice at the public hearing
held by the Planning and Zoning Commission, and it having been
determined that the public necessity, convenience and good zoning
practice require such reclassification,
NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly
of the Kodiak Island Borough that the property known as:
That Unsubdivided Portion of U. S. Survey 1396,
Kodiak Island Borough, described as:
Commencing at Corner 1, U. S. Survey 1396, thence
N 340 43' W, 330.00 feet along the Westerly boundary
of U. S. Survey 1396 to the TRUE POINT OF BEGINNING,
Corner 1; Thence N 34° 43' W, 102.56 feet along the
Westerly boundary of U. S. Survey 1396 to the Southerly
R.O.W. of Larch Street, said point being Corner No. 2;
Thence N 510 03' E. 60.16 feet along said R.O.W. to
Corner No. 3; Thence S 340 43' E, 47.00 feet to Corner
No. 4; Thence N 55 0.17' E, 296.00 feet to Corner No. 5;
Thence S 340 43' E, 60 feet to Corner No. 6; Thence
S 550 17' W, 356.00 feet to Corner No. 1, THE TRUE
POINT OF BEGINNING. Said portion contains 20,447
square feet more or less.
Be and the same is hereby reclassified as BUSINESS
and that notice of this Ordinance by given by publication in
the Kodiak MIRROR seven (7) days prior to the second reading
and that a public hearing be held thereon on the date of the
second reading and that this Ordinance become effective at the
expiration of thirty (30) days after its adoption.
