ORDINANCE NUMBER 73 - 5 - 0
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY TO
ELECT REGULATORY POWERS FOR WATER POLLUTION CONTROL IN AN AREA
OUTSIDE THE CITY OF KODIAK AND AUTHORITY TO PROVIDE PUBLIC
FACILITIES AND SERVICES.
WHEREAS, the City of Kodiak has made application to
Environmental Protection Agency for a Grant for the installation
of a sewer treatment plant and for interceptors for the City and
immediate surrounding area, and
WHEREAS, certain requirements must be met as required
by Housing and Urban Development and
WHEREAS, the City and surrounding area will be required
to provide for such facilities under Federal Pollution Laws, and
WHEREAS, the Kodiak Island Borough may at the option of
the Borough elect such power under A. S. 29.48.035 (b),
NOW, THEREFORE BE IT ORDAINED, that the Kodiak Island
Borough hereby elects to assume regulatory powers for water
pollution and authority to provide facilities and service for that
area outside the City of Kodiak; and to call for the establishment
of a service district in accordance with A. S. 29.63.090 (a) and
to designate the City of Kodiak as the logical government entity
to provide for such services.
FURTHER, that a public hearing be held on this Ordinance
seven (7) days after publication of notice of the same has been
given in the Kodiak Mirror, and on the date of the second reading
thereof, and that this Ordinance become effective at the expiration
of thfrty (30) days after its final passage and approval.
