1973-02 Rezoning U.S. Survey 3098 to R1I' KODIAK ISLAND BOROUGH ORDINANCE NUMBER 73 -2 -0 AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY REZONING LOT TWENTY -SIX A (26A), U. S. SURVEY NO. 3098 FROM UNCLASSIFIED TO R -1. WHEREAS, AS 07.15.340 empowers the Borough to enact a Zoning Ordinance and provide for its administration, enforcement and amendment, and WHEREAS, the Kodiak Island Borough has pursuant thereto adopted Chapter 5 of its Code of Ordinances and Resolutions, which provides for planning and zoning provisions and procedures, and WHEREAS, according to the Comprehensive Planning and Zoning Map adopted by the Kodiak Island Borough, Lot Twenty -six A (26A), U. S. Survey No. 3098 has been zoned Unclassified, and WHEREAS, a Petition has been received from MIKE SHOCKLEY and JOHN EUFEMIO, stating that they are the owners of Lot Twenty -six A (26A), U. S. Survey No. 3098, and asking that the (same be rezoned from Unclassified to R -2, which reauest was disapproved by the Planning and Zoning Commission after public hearing, and 4 WHEREAS, the Borough Assembly having considered the matter on appeal, and having determined that the public necessity, convenience and good zoning practice required the reclassification of said lot from Unclassified to R -1. i NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly of the Kodiak Island Borough that the property known and described j as: Lot Twenty -six A (26A) of U. S. Survey No. 3098 Page One, ORDINANCE NO. 73 -2 -0 f Now classified as Unclassified, be and the same is hereby reclassified as R -1, and that a public hearing on this reclassification be held after at least seven (7) days notice of the time and place for such hearing has been published in a paper of general circulation in the Borough, at which public hearing parties in interest and citizens shall have an opportunity to be heard.
