1971-07 Rezoning U.S. Survey 562 to Business7 n I n! 0 2? 1 KODIAK ISLAND BOROUGH ORDINANCE NUMBER 71 -7 -0 AN ORDINANCE REZONING LOTS NINETY -THREE (93), NINETY -FOUR (94), NINETY -SIX (96), NINETY -SEVEN (97) AND NINETY -EIGHT (98), BLOCK NINE (9), ERSKINE SUBDIVISION, U. S. SURVEY NO. 562 FROM R -2 TO BUSINESS WHEREAS, AS 07.15.340 empowers the Borough to enact zoning ordinances and provide for their administration, enforcement and amendment, and WHEREAS, the Kodiak Island Borough has pursuant thereto adopted Chapter 5 of its Code of Ordinances and Resolutions, which provides for planning and zoning provisions and procedures, and WHEREAS, according to the comprehensive planning and zoning map adopted by the Kodiak Island Borough, Lots Nine -three (93), Ninety -four (94), Ninety -six (96), Niney -seven (97) and Ninety -eight (98), Block Nine (9), Erskine Subdivision of U. S. Survey No. 562, has been classified as R -2, and WHEREAS, a Petition has been received from i !JOHN BURNHAM stating that he is purchasing the above - described I I property for the expansion of the retail sales and service business of Kodiak Outboard, and i. WHEREAS, adjacent properties thereto are business ,including the City Market and said property is in the vicinity Iiof the City Hall on Mill Bay Road and the City Library and i !this area would be better utilized and served if the same 'were classified as business property, and WHEREAS, the Petition was considered and approved by the Planning and Zoning Commission on the 29th day of (March, 1971 after a public hearing was held thereon and said I I ibody has recommended the reclassification of said property to business and there was only one objection voiced at the ii '!Page One, ORDINANCE NO. 71 -7 -0 i'. i public hearing held by the Planning and zoning Commission, and it having been determined that the public necessity, convenience and good zoning practice require such reclassification_ NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly of the Kodiak Island Borough that the property known and described as: Lots Ninety -three (93), Ninety -four (94), Ninety -six (96), Ninety -seven (97) and Ninety -eight (98) of Block Nine (9), Erskine Subdivision of U. S. Survey No. 562, Be and the same is hereby reclassified as business and that notice of this Ordinance be given by publication in the Kodiak Mirror seven (7)• days prior to the second reading and that a public hearing be held thereon on the date of the second reading and that this Ordinance become effective at the expiration of thirty (30) days after its adoption.
