AN ORDINANCE OF THE KODIAK ISLAND BOROUGH REZONING
OTS ONE (1) THROUGH EIGHT (8), BLOCK ONE (1), ALLMAN ADDITION
ROM R -1 TO BUSINESS
WHEREAS, AS 07.15.340 empowers the Borough to enact
:zoning ordinances and provide for their administration, enforce -
ment and amendment, and
WHEREAS, the Kodiak Island Borough pursuant thereto
'adopted Chapter Five of its Code Of Ordinances and Resolutions
,which provides for planning and zoning provisions and procedures,
and
WHEREAS, according to the comprehensive Planning
and Zoning map adopted by the Kodiak Island Borough, Lots One (1)
through Eight (8), Block One (1), Allman Addition have been
classified as R -1, and
WHEREAS, a petition has been received from Mildred
Markham stating that she is the owner of Lots One (1) through
Eight (8), Block One (1), Allman Addition, which land is zoned
R -1, and which the petitioner requests be rezoned as Business

and as a basis for her petition has stated that Lot One (1) has
Peen used for business purposes for the last eleven years and
ilthat the building located thereon now needs to be replaced and
11she is in the process of demolishing it; that Lots Two (2) and
::Three (3) were previously used for residential purposes, but
l!that the houses located thereon have been removed and the land
is now vacant and has been vacant for several years; and that
ILot Four (4) is occupied by a temporary storage shed, which she
(plans to remove and the land will then be vacant; that Lots Five
(5) through Eight (8) are occupied by a business known as the
IlMontmarte Inn and have been so occupied for approximately twenty- i
ifive years or more; and this area would better utilized and i

served if the same were classified to reflect the proper use of
said land, and
WHEREAS, the petition was considered by the Planning
and Zoning Commission and a public hearing was held thereon on
the 24th day of February, 1971, and after said public hearing
the Planning and Zoning Commission has recommended the
reclassification of said property to business and there were no
objections voiced at the public hearing, and it having been
determined that the public necessity, convenience and good zoning
!practice requires such reclassification,
NOW, THEREFORE, BE IT ORDAINED by the Borough
Assembly of the Kodiak Island Borough that the property known
and described as Lots One (1) through Eight (8), Block One (1),
Allman Addition to the City of Kodiak, now classified as R -1
be and the same-is hereby reclassified as Business, and that
notice of this Ordinance be given by publication in the Kodiak
Mirror seven (7) days prior to the second reading and that a
public hearing be held thereon on the date of the second readinc
land that this Ordinance become effective on the expiration of
thirty (30) days after its adoption.
FIRST READING AND APPROVAL DATE: March 4, 1971.
SECOND READING, PUBLIC HEARING AND PASSAGE DATE:
