ORDINANCE NUMBER 68 -30 -0
AN ORDINANCE REZONING LOT TWENTY -SIX (26) BLOCK ONE
(1) KODIAK TOWNSITE FROM BUSINESS TO R -3
WHEREAS, AS 07.15.340 empowers the Borough to enact
a zoning ordinance and provide for its administration, enforcement
and amendment, and
WHEREAS, the Kodiak Island Borough has pursuant theret
adopted Chapter 5 of its Code of Ordinances and Resolutions, which
provides for planning and zoning provisions and procedure, and,
WHEREAS, according to the comprehensive plan adopted
by the Kodiak Island Borough, Lot Twenty -six (26) Block One (1) of
the Kodiak Townsite has been classified business and
WHEREAS, the Kodiak Island Borough Planning and _Zoning
Commission has recommended that said lot be reclassified from
business to R -3 as the property is contiguous to an R -3 zone and
according to the comprehensive plan for 1999 it can be used as a
buffer zone between industrial and residential and therefore this
rezoning will not be contrary to the objectives of the plan and
further the property is and has always been used for residential
purposes and is now owned and has always been owned by the same
family which due to an increase in the size of the family requires
a larger residence and the family can better afford to build a
larger home on the existing land than it can to purchase a larger
home at this time and it has been determined that the public
necessity, convenience, general welfare and good zoning practice
requires that reclassification,
NOW, THEREFORE, BE IT ORDAINED by the Borough Assembly
of the Kodiak Island Borough that Lot Twenty -six (26) Brock One (1)
of the Kodiak Townsite now classified as business be and the same
is hereby reclassified as R -3 and that notice of this Ordinance be

given by publication in the Kodiak Mirror seven (7) days prior to
the second reading of this Ordinance and that a public hearing be
held thereon on the date of the second reading of this Ordinance
and that this Ordinance become effective at the expiration of
thirty (30) days after its adoption.
