ORDINANCE NO. 85-11-O
AN ORDINANCE OF THE KODIAK ISLAND BOROUGH ASSEMBLY AMENDING CHAPTER
17.03, GENERAL PROVISIONS AND USE REGULATION, OF THE BOROUGH CODE.
The Kodiak Island Borough Hereby Ordains:
Section 1: That Section 17.03.060, Building Permits, is hereby amended:
17.03.060 ~u~n~-Peem~ee Zoning Compliance. A bu~&~es-pe~m~e Zonin~
compliance is required for ebe site ~radin~ (excavation and fill), erection,
construction, establishment, moving, alteration, enlargement, repair, or
conversion of any building or structure in any district established by this
title, subject to the following:
A. Gradin~ (as defined in Chapter 70 of the Uniform Building Code),
exclusive of gradin~ as excepted in Section 7003 of Chapter 70 of the UBC, in
a residential or conservation district requires an exception from the Planning
and Zonin~ Commission.
AY B__~. An application for a bu~½&~n~-pe~,m~ zoning compliance will be
filed with the ~n~-e~f~e~ Communit~ Development Department em& on a
form mpp~eve~-~y-N~m provided b~ the department. If the application meets the
requirements of this title, as verified by the ~®n~m~-~ee~ department, and
other applicable regulations, ~Ne ~ permit will be issued.
~ C__. In all cases where the planning commission or the board of adjust-
ment has granted a variance or an exception to this title, the b~m~
e~&e~a~ department will issue a ~u~&~&m~-peem~* zonin~ compliance to allow
the building work to be done in accordance with the decision, except that no
permit will be issued following the granting of a variance or exception until
the time for filing an appeal has expired and it is verified that no appeal
has been filed.
~v D_~. No building permit shall be issued by a building official until
the eem~m~-e~ee~ Communit~ Development Department has verified from the
application for e bu~½d~n~-peem~ zonin~ compliance for a proposed building
that it conforms and will be occupied for a use in conformity with the
provisions and regulations of this title, except that this provision shall not
apply to building permits for residential structures when no yard or height
changes are involved. Any building permit issued in conflict within this

Section 2: That this ordinance shall be in full force and effect upon
passage.
