FY2021-32 AN ORDINANCE INITIATING A BALLOT MEASURE FOR THE OCTOBER 5, 2021 REGULAR MUNICIPAL ELECTION, WHICH, IF PASSED BY THE VOTERS, WOULD. ESTABLISH A NON-AREAWIDE PARKS & RECREATION SERVICE AREA, IN ACCQRPANCE WITH CHAPTER 4.05.010 OF THE KIB CODE, ESTABLISHING, ALTERING, ABOLISHING SERVICE AREAS TO COINCIDE WITH THE NON-AREAWIDE PARKS & RECREATION AUTHORITY THAT WAS ADOPTED BY THE BOROUGH PURSUANT TO A BALLOT MEASURE IN 407 . WHEREAS, the Kodiak Island Borough, a Second-ClasLa Borough under Title 29, Alaska Statutes, approved by Ballot Proposition and ratified by Resolution No. 76-54-R dopted a Non- Areawide Parks & Recreation au#K+r 15,4.976; and, WHEREAS, the Kodiak Island Borough also established by a Parks & Recreation Committee to generate priorities and action plans includinM a capital improvement program for parks and recreation; and, WHEREAS, the Ifodiak Island Borough has leveraged its non-areawide parks and recreation authority under Title 29, Alaska Statutes, to obtain grants, hold state land leases, and enter into collaborative agreements with the Borough School District and City of Kodiak , to maintain local neighborhood parks and baolfields; anon, WHEREAS, with the exercise of this non-areawide authority, the Borough has been constrained from legally spending general fund revenue on an otherwise adopted, non-areawide service function; and, s�- WHEREAS, � for the land owners residing on the Kodiak Island Borough "Road System". to fully exercisR parks & recreation authority involving the expenditure of local revenue, it must be considered ifthat service is worth establishing a Non-Areawide Parks & Recreation Service Area, and weutd-thefekay pay -a small tax increment in the same manner as, fire, and lighting district services are administered; and, WHEREAS, Chapter 4.05.30 of the Borough Code states, if adopted by ordinance, the assembly, will put forth the ordinance to the applicable voters to be passed by a major ty of the qualified voters per KIB Code 4.05.060; and, WHEREAS, if the proposition is approved by major y vote of the applicable voters at the October 5, 2021 regular municipal election, an ordinance amending the code to re-establish the current Parks & Recreation Committee would need to be adopted to create an elected service Kodiak Island Borough, Alaska Ordinance No. FY2021-32 Page 1 of 2 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 area board, responsible for establishing the priorities of a non-areawide Parks & Recreation Service Area through planning, budgeting, and managing said service area in accord with the will of the benefitted land owners within the service area; and, WHEREAS, if approved, a Parks & Recreation Service Area would then be created to consider the management of all borough recreation facilities separately from the borough's general fund and give -:1 voters more direct influence directly_ over the Parks & Recreation Service Area Board on matters of recreation facilities, service levels, and the related tax increment required to sustain said facilities and services, NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KQEIIAK ISLAND BOROUGH that: Section 1: This ordinance is not of general application and shall not be codified. Section 2: An election is to be held on Octolter 5, 2021 in tMe Nodiak Island Borough and the following proposition shall be submitted to the qualified voters for approval or rejection.
