KODIAK AIRPORT LEASE ADA-04851
THIS SUPPLEMENT to Lease ADA-04851 is entered into by and between the State of
Alaska, Department of Transportation and Public Facilities, Statewide Aviation Leasing,
Central Region, whose physical address is 4111 Aviation Avenue, Anchorage, Alaska
99519-6900, referred to as the Lessor, and Buskin River Hospitality, LLC, whose address
is 881 N Northshore Drive, Wasilla Alaska 99654, referred to as the Lessee, including
exhibit(s) and signature page(s) as follows:
RECITALS:
1. Effective April 1, 1982, Lease ADA-04851, was executed between the Lessor and
J. W. Ashford and Wayne J. Cherrier for Lots 1 and 2, Block 1400, consisting of
approximately 61,920 square feet of land; and
2. Effective September 24, 1982, Supplement No. 1 amended Special Covenants 1
and 3; and
3. By Consent dated June 7, 1983, Lease ADA-04851 was assigned from J. W.
Ashford and Wayne J. Cherrier to J. W. Ashford, Wayne J. Cherrier, and William H.
Bulen; and
4. By Consent dated May 24, 1989, Lease ADA-04851 was assigned from J. W.
Ashford, Wayne J. Cherrier, and William H. Bulen to Buskin River Inn, Inc.; and
5. By Consent dated June 27, 1994, Lease ADA-04851 was assigned from Buskin River
Inn, Inc. to Buskin River Inn Partnership; and
6. By Consent dated November 18, 2005, Lease ADA-04851 was assigned from Buskin
River Inn Partnership to The Kishan Group, Inc.; and
7. By Consent dated September 1, 2021, Lease ADA-04851 was assigned from The
Kishan Group, Inc. to Buskin River Hospitality, LLC; and
8. The Lessee desires to extend or amend the above described principal agreement;
and

9. The parties find it will be to their mutual advantage to extend, supplement, amend, or
revise said contract.
NOW, in consideration of the foregoing, Lease ADA-04851 is hereby extended,
supplemented, amended or revised in the following particulars only, viz.:
Basic Provision 3 (Term) is hereby amended read as follows:
The Term of this agreement is fifty (50) years beginning April 1, 1982 and
ending March 31, 2032. All rights and liabilities under this Lease become
effective on the first day of the term of this Lease.
Basic Provision 2 (Authorized Uses), Paragraph 1 is hereby replaced in its
entirety as follows:
The Lessor authorizes the Lessee to use the Premises for the following
uses only:
Operation and maintenance of hotel/motel, restaurant, cocktail lounge,
general office building, and hotel swimming pool.
III. Special Covenant 1 is hereby added as follows:
The Lessee understands and agrees the value of investment resulting from the
purchase price has been applied to the term of this Lease to the maximum
extent allowed under 17 AAC 45.225. This lease will not receive any additional
term extensions and only a Successive Lease may be applied for when term is
exhausted.
The effective date of this Supplement No. 2 is April 1, 2022.
ALL OTHER TERMS, PROVISIONS, AND COVENANTS REMAIN UNCHANGED.
