In reference to the letter from COK Building & Safety director, Ted Hanson, dated August 7, 2023, CDD notes that there is a timeline of 6 months for the conditions from Variance # 22-003, originally case 21-010, to be met. CDD approves this new zoning compliance based on these conditions. Variance # 22-003 was approved on September 15, 2021. KANA has not met conditions for approval for 23 months. As you are aware the three conditions of approval have not been met that were set as part of the variance granted by the Zoning Commission during their meeting on September 15, 2021 for this KANA property. The stairwell offset drawing from St. Denny Surveying is not an As -Built as require in condition three. Conditions one and two cannot be met until the fire separation distance (FSD) is corrected. You had indicated in a previous letter that you were working with the adjoining property owner to acquire property to correct the FSD issue created by the addition of the covered deck and stairway. The code requires a minimum of 40" for the FSD to the property line from the most exterior surface of the projection (covered deck and stairway). This letter is to notify KANA that a six month deadline will be set for the correction of the FSD and lack of As -Built as part of the issuance of the zoning compliance and building permits for the roofing, siding and door replacement project since those conditions have not been completed since the September 15, 2021 issuance of the variance by the Zoning Commission. Correction of the FSD can be accomplished by acquiring enough property thorough purchase from the adjoining property owner and re -plat to achieve a 40" FSD or by demolition of portions of the roof and deck for the projection to increase the FSD distance from the existing property line to the projection to a minimum of 40".
