AGREEMENT FOR THE USE
BETWEEN
ENGINEERING & FACILITIES AND BAYSIDE FIRE DEPARTMENT
CONTRACT FY2023-36
This agreement entered into this 23 day of January , 2023, by and between the
Kodiak Island Borough Engineering & Facilities Department (EF), hereinafter referred to as the
EF, and the Bayside Fire Department, hereinafter referred to as the BFD. The Red Ford Truck
with VIN number ending in 7354, license plate number XYC 534, and its entirety will hereinafter
be referred to as TRUCK.

WHEREAS the EF is the original owner to the TRUCK. Said TRUCK is physically convenient
and capable of being used by the BFD. The use of the TRUCK for BFD is in the best interests of
the parties hereto and the public.
NOW THEREFORE in consideration of the above, the undertaking, and covenants of each of the
parties as hereinafter set forth, it is agreed by and between the parties as follows:
AGREEMENT
1. TERMS:
This agreement shall be affective starting January 20, 2023, until BFD receives their
purchased fire response vehicle. The agreement may be terminated by either party
giving 30 days' written notice or immediate termination may occur based on violation
of terms of this agreement.
2. PRIORITY OF USE OF TRUCK:
Priority of use is relative and reflects the intended primary use of the TRUCK to be
used as transportation for the Fire Chief of BFD.
3. BFD OBLIGATION:
The BFD'S responsibility is as follows:
i. Provide any costs related to the use of the TRUCK.

2. Repairs and Maintenance
3. Preventative Maintenance

ii. Keep the truck in proper working condition with repairs, maintenance, and
preventative maintenance.
iii. Report any and all accidents in the correct manner through EF and the
AMLJIA insurance procedures.
iv. Provide for safe storage and handling the TRUCK used during BFD's
possession.
4. PROPERTY DAMAGE:
The TRUCK or property thereon damaged or destroyed by reason of negligence or acts
of the BFD employees or persons using the TRUCK under the BFD' S supervision shall
be the responsibility of the BFD and reimbursement for replacement or repair shall be
made by the BFD to the EF; however, nothing herein contained shall be construed to
obligate the BFD to make repairs for damage which is due to ordinary wear and tear.
5. LIABILITY INSURANCE
The BFD shall be responsible for the vehicle insurance portion of the KIB insurance
premium during the term of use for the vehicle.
6. ASSIGNMENT:
The BFD shall not allow any third parties to use the TRUCK named in this agreement
to a third party without written notification to, and written permission of the EF.
