Assembly Special Meeting
April 28, 2022
A special meeting of the Kodiak Island Borough Assembly was held on April 28, 2022, in the
Borough Assembly Chambers. The meeting was called to order at 8:40 p.m. Staff present were
Borough Manager Roxanne Murphy and Borough Clerk Nova Javier.
ROLL CALL
Present were Mayor William Roberts, Assembly members Scott Arndt, Joseph Delgado, Jared
Griffin, Scott Smiley, James Turner, and Aimee Williams.
SMILEY moved to excuse Assembly member Smith who was absent due to personal leave.
VOICE VOTE ON MOTION CARRIED UNANIMOUSLY.
CITIZENS COMMENTS
None.
CONSIDERATION OF MATTER(S) IN THE CALL FOR THE SPECIAL MEETING
1. Discussion Of Borough Obligations In A Tax Matter
ARNDT Move to convene into executive session under the authority of KIBC. 2.30.030 (F)(1)(a)
for discussion of a matter which could potentially lead to litigation and KIBC 2.30.030(F)(1)(b)
matters, the immediate knowledge of which would tend to affect adversely the finances of the
borough.
Assembly member Turner declared a conflict of interest due to his employment with the company
that is being discussed. Mayor Roberts ruled there was a conflict and excused Assembly member
Turner.
ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Arndt, Delgado, Griffin,
Smiley, and Williams.
ARNDT moved to invite the Mayor and Assembly into Executive Session as well as the Borough
Finance Director, Assessor, Manager, Clerk and Borough Attorney.
VOICE VOTE ON MOTION CARRIED UNANIMOUSLY.
The executive session is recommended in order to provide a confidential discussion of the
Borough's rights, obligations, and options, and to discuss strategy for resolving a potential claim
for a tax refund. The issue caries the potential for litigation, and open discussion of the Borough's
options and strategy for processing through the issue would tend to adversely impact the
Boroughs finances as it could limit the options available for moving forward.

Mayor Roberts recessed the special meeting and convened into executive session at 8:45 p.m.
At 9:04 p.m. Mayor Roberts reconvened the special meeting and announced direction was given
to the Attorney on how to proceed.
ADJOURNMENT
ARNDT moved to adjourn the meeting at 9:06 p.m.
