RESOLUTION NO. 93-01
A RESOLUTION URGING THE SECRETARY OF COMMERCE TO RETURN THE
SABLEFISH/HALIBUT IFQ PROPOSAL TO THE NORTH PACIFIC FISHERY
MANAGEMENT COUNCIL UNTIL ANALYSIS AND COMPARISON
OF THE SUPERIOR TRADITIONAL MANAGEMENT PACKAGE IS COMPLETED
WHEREAS, the U.S. Secretary of Commerce (Secretary) has the authority to
approve, disapprove or partially disapprove Proposed Plan Amendments
and Proposed Regulations that are submitted by the North Pacific Fishery
Management Council (Council); and
WHEREAS, the Secretary has the responsibility and authority to ensure that
Proposed Plan Amendments and Proposed Regulations are within the
guidelines of the Magnuson Fisheries Conservation and Management Act
(MFCMA); and
WHEREAS, the Secretary has the responsibility and authority to ensure that the
Council has adequately, fairly and reasonably considered and analyzed
available and reasonable options and alternatives during the process of
developing Proposed Plan Amendments and Proposed Regulations; and
WHEREAS, the Secretary has received Proposed Plan Amendments and Proposed
Regulations from the Council that intend to implement an IFQ Program
for sablefish and halibut off Alaska (Council IFQ Proposal); and
WHEREAS, the Council has failed to fulfill their responsibility to adequately, fairly
and reasonably consider and analyze a package of traditional
management methodologies that has been proposed, submitted and
supported by the fishing industry; and
WHEREAS, such industry package of traditional management methodologies may
actually provide better protection and conservation of the sablefish and
halibut resources and provide for better management and enforcement
opportunities on the fishing grounds; and

WHEREAS, such package of traditional management methodologies can be
implemented at substantially lower costs in terms of human and financial
resources than otherwise will be required to implement the Proposed
Plan Amendments and Proposed Regulations that have been submitted
by the Council; and
WHEREAS, neither the National Marine Fisheries Service, the federal government,
the taxpayer nor the fishing industry can afford the unnecessary,
wasteful, inflationary and inefficient high cost in terms of human and
financial resources to implement the Council IFQ Proposal; and
WHEREAS, the MFCMA, E.O. 12291, the Regulatory Flexibility Act, the Paperwork
Reduction Act, National Environmental Protection Act, and other
applicable laws and guidelines require that a Cost -Benefit Analysis,
Economic Impact Analysis, and a Social -Impact Assessment be
completed regarding Proposed Plan Amendments and Proposed
Regulations; and
WHEREAS, such analysis and assessments had not been reasonably, fairly or
adequately developed or completed before the Council IFQ Proposal was
submitted to the Secretary; and
WHEREAS, there is overwhelming opposition to the Council IFQ Proposal by Alaskan
municipalities, the fishing industry, and the residents of Alaska; and
WHEREAS, the Council IFQ Proposal results in exclusive ownership of the resource;
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: The U.S. Secretary of Commerce is urged to disapprove the Proposed
Plan Amendments and the Proposed Regulations that are intended to
implement the Council IFQ Proposal.
Section 2: The U.S. Secretary of Commerce is urged to return the Sablefish/Halibut
IFQ Proposal to the North Pacific Fishery Management Council so that
the package of traditional management methods can be analyzed and
compared to the Council IFQ Proposal, with a clear decision as to which
is the superior method of managing the sablefish and halibut resources
before being returned to the Secretary for approval of the superior
methodology.
