A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH AUTHORIZING
A MEMORANDUM OF AGREEMENT WITH THE ALASKA DEPARTMENT OF
TRANSPORTATION & PUBLIC FACILITIES FOR CONSTRUCTION OF THE OTMELOI WAY
REHABILITATION PROJECT
WHEREAS, Otmeloi Way is a road located in Kodiak Island Borough, owned by the State of
Alaska and maintained by the Alaska Department of Transportation and Public Facilities
(DOT&PF); and
WHEREAS, Kodiak Island Borough Resolution No. 97-05 declared a willingness to accept
maintenance and operation responsibility for Otmeloi Way when it is improved by the State of
Alaska to Kodiak Island Borough (road) standards; and
WHEREAS, a 2005 State Legislative Grant provided $3,300,000 for road reconstruction and
improvements within the Otmeloi Way Rehabilitation project, which would result in the transfer of
ownership of the road to the Kodiak Island Borough. A reconnaissance study and planning and
design were initiated with a portion of this grant funding; and
WHEREAS, the October 4, 2016 local election included a proposition for altering the boundaries
of Road Service Area No. 1 to include Otmeloi Way so that the Borough would have the power to
maintain the road should ownership be assumed; and this proposition passed; and
WHEREAS, Kodiak Island Borough Resolution No. FY2019-23 authorized the Manager to
submit an application to the DOT&PF for use of Community Transportation Program funds for the
Otmeloi Way Rehabilitation project, which would use the balance of the State grant funds as a
match for requesting federal funds to fully fund the project cost; and
WHEREAS, in 2020, the DOT&PF Community Transportation Program Project Evaluation
Board awarded federal funding to the project; and
WHEREAS, a Memorandum of Agreement with the DOT&PF must be executed for the federal
funds to be obligated to the project, and to facilitate the planning, design, and construction
necessary to complete the project; and
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
the Kodiak Island Borough Manager is authorized to enter into a Memorandum of Agreement with
the Alaska Department of Transportation and Public Facilities for construction of the Otmeloi Way
Rehabilitation Project.
