Dear Mr. Barry:
This is in response to your April 22, 2020 application for a Department of the Army
(DA) permit to permanently discharge 500 cubic yards of shot rock and 450 cubic yards
of concrete into a 2,500-square foot area below the High Tide Line (HTL, 10.7 feet
above the 0.00-foot Mean Lower Low Water (MLLW) contour) of Chiniak Bay, a
navigable water of the United States (U.S.), to repair a failing building foundation. The
fill will be capped by an 11-foot x 245-foot concrete slab. Additionally, 1,600 cubic yards
of shot rock will be temporarily discharged below the HTL to allow access to
the project site. A concrete retaining wall, four feet tall and 245 feet long, will be
constructed below the Mean High Water Mark (MHWM, 7.6 feet above the MLLW). No
more than 850 cubic yards of existing rock will be excavated from below the MHWM
prior to the construction of the wall. This material will be used as part of the temporary
fill and will be returned to behind the wall following construction of the wall.
A concrete block wall, 245 feet in width, will be constructed below the MHWM at the
MLLW. It will be constructed out of blocks two feet thick and will be entrenched four
feet below the MLLW. Up to 73 cubic yards of existing rock will be excavated from
500 square feet below the MHWM prior to construction of the block wall. This material
will be utilized as backfill behind the concrete retaining wall. All piles within the second
and third row of piles will be incased in concrete.
Your project has been assigned file number POA-1974-00503, Chiniak Bay (Inner
Harbor), which should be referred to in all future correspondence with this office. The
project site is located within Section 31, T. 27 S., R. 19 W., Seward Meridian; USGS
Quad Map Kodiak D-2; Latitude 57.78640 N., Longitude 152.4160010 W.; Kodiak
Borough, 517 Shelikof Street, Kodiak, Alaska.

DA permit authorization is necessary because your project will involve work, the
placement of structures, and the discharge of dredged and/or fill material into waters of
the U.S. under our regulatory jurisdiction.
Based upon the information and plans you provided, we hereby verify that the work
described above, which will be performed in accordance with the enclosed plan
(sheets 1-6), dated May 6, 2020, is authorized by Nationwide Permit (NWP) No. 3,
Maintenance. NWP No. 3 and its associated Regional and General Conditions can be
accessed at our website at: www.poa.usace.army.miI/Missions/Regulatory/Permits.
Regional Condition E, Delineation of Project Footprint, applies to your project. You
must comply with all terms and conditions associated with NWP No. 3.
Further, please note General Condition 30 requires that you submit a signed
certification to us once any work and required mitigation are completed. Enclosed is the
form for you to complete and return to us.
Unless this NWP is modified or revoked, it expires on March 18, 2022. It is
incumbent upon you to remain informed of the changes to the NWPs. Nothing in this
letter excuses you from compliance with other Federal, State, or local statutes,
ordinances, or regulations.
