FY2021-06 Archaeological Services Agreement Between KIB And The Alutiq MuseumARCHAEOLOGICAL SERVICES AGREEMENT between Kodiak Island Borough 710 Mill Bay Road Kodiak, AK 99615 907.486.9300 and Alutliq Museum and Archaeological Repository 215 Mission Rd., Suite 101 Kodiak, Alaska 99615 845.425.884, httos://alutiigmuseum.org PURPOSE AND AUTHORITY This Archaeological Services agreement between the Kodiak Island Borough (hereinafter referred to as "KIB") and Alutiiq Museum and Archaeological Repository (hereinafter referred to as "AMAR") is to document the partnership between the KIB and the AMAR to complete an archaeological survey of the all -terrain road system in the Saltery Cove region of northeast Kodiak Island, Alaska. PROJECT DESCRIPTION The Kodiak Island Borough (KIB) received a grant from the U.S. Fish and Wildlife Service (USFWS) Wildlife and Sport Fish Restoration (WSFR) program through the Alaska Department of Fish and Game (ADF&G) to repair and construct approximately 20 miles of all -terrain vehicle (ATV) trail in the Saltery Cove area of northeast Kodiak Island. The proposed undertaking involves repairing and improving trail conditions along three trail segments. Phase 1 follows the American River from its Intersection with the Chiniak Highway, to Saltery Cove. Phases 2 covers the spurs to Saltery Lake and phase 3 the spur to Lake Miam. As a federally -funded undertaking, this project must comply with Section 106 of the National Historic Preservation Act (NHPA) of 1966, as amended, and its implementing regulations found In 36 Code of Federal Regulations (CFR) Part 800. A review by USF&WS land managers indicates the archaeological survey is needed on the Phase 2 and Phase 3 to fulfill this requirement. This Includes evaluating known sites in the vicinity of the two trail segments, Identifying any cultural resources that have not been previously documented, and completing a technical report of survey finds with determinations of eligibility for sites In the project area. III. SCOPE OF WORK For the periods set forth below, the KIB and AMAR will provide the necessary personnel, materials, services, facilities, funds and otherwise perform all work necessary for, or Incidental to, the performance of this service agreement. Specifically, the parties to this agreement will: A. KIB will orovide: 1. A signed permit for archaeological research on private lands in the survey area delivered to AMAR by September 1, 2020. If this permit Is not provided, private lands will not be surveyed. 2. The best available project documentation including descriptions of the planned work, a definition of the project area, maps, and photographs. 3. Transportation: ATV(s) and all the fuel needed to support two (2) archaeologists and their gear, traveling in the project area for three (3) days. The KIB will arrange for the ATV(s) and fuel to be delivered to the trail head at the American River at the start of the survey and picked up at the same location at the end of the survey. The ATV(s) must be in good working order. If an ATV malfunctions, the KIB will be responsible for Its recovery and repair, and for providing alternative transportation for AMAR archaeologists so they may complete the survey as scheduled. 4. Review of the draft project report with written comments within 30 days of submission by AMAR. 5. Submission of the revised draft report to ADF&G. ADF&G will be responsible for submitting the report to USFWS. The USFWS will be responsible for submitting the report to the Alaska Office of History and Archaeology (OHA) and State Historic Preservation Officer (SHPO) for review. 6. Forwarding comments from ADF&G, USFWS, OHA and SHPO to AMAR. 7. Funding in the amount of $24,340. B. AMAR will provide: B. A completed State Cultural Resource Investigation Permit to conduct research on state lands in the project area. 9. A draft copy of an archaeological research permit for use by the KIB to solicit permission for survey on private lands. 10. Background research on the history of the Saltery Cove area and known sites In the project vicinity. 11. The personnel, gear, supplies, and food to complete three (3) days of archaeological survey on phase 2 and phase 3 12. Laboratory space, staff time, equipment and supplies to complete the processing and documentation of the archaeological collections acquired from site testing. 13. Long-term curation of all artifacts, samples, and project documentation as a long-term loan from the state of Alaska. If a site is found on private property, and cultural materials are collected from it, AMAR will offer to provide long-term curation of the collection for the property owner or return the collection to the owner. 14. Electronic copies of project field notes, photos, and a collection inventory. 15. A technical report describing the project area and its natural and cultural history, a description of field methods, a summary of project finds, recommendations of eligibility for any sites discovered in the project area, a recommendation for a finding of effect for the project, and recommendations for mitigation measures, if appropriate. 16. Edits to the technical report as requested by the KIB, ADF&G, U5FWS, OHA, and SHPO. III. CONTRIBUTIONS OF THE PARTIES and FINANCIAL ADMINISTRATION A. The KIB shall provide $24,340 to AMAR to pay for the archaeological research, the care of cultural materials, and the preparation of a technical report. B. One payment for fifty percent (50%) of the total project amount, twelve thousand one hundred and seventy dollars ($12,170), shall be made before the start of fieldwork, by no later than September 1, 2019. AMAR will invoice the KIB for this amount by July 1, 2021. C. A final payment of twelve thousand one hundred and seventy dollars ($12,170), will be due within thirty (30) days of receiving the project's technical report. AMAR will submit an invoice to the KIB with the report. D. If the USFW5 requires any additional work outside the scope of work described in Section II above, and If this work incur additional costs, the KIB and AMAR will negotiate a change order. This change order will summarize the additional work required of AMAR and stipulate the payment of all associated costs to AMAR by the KIB. IV. PERIOD OF PERFORMANCE W A This agreement will be effective when signed by all parties and it will continue in effect until June 1, 2021. B. The work Identified in section III above will be completed no later than May 1, 2021. A. The scope of work and other terms of the agreement may be modified at any time by mutual consent of the signatory parties. No change to this agreement shall be binding upon Koniag or the Museum unless and until reduced to writing and signed by both parties. 6. The parties to this agreement agree to be responsible for damages to their own property and injuries to their own employees/volunteers, except for damages/injuries resulting from the fault or negligence of the other party.
