AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND GH
SUPPLEMENTING ORDINANCE NO. FY2021-07 REGARDING THE DISPO 10 O A TAX
FORECLOSED PROPERTY, SETTING A MINIMUM BID AND SALE PRO S ROUGH
LAND SALE NUMBER TWENTY-ONE.
WHEREAS, the Kodiak Island Borough adopted Ordinance No. F 0 0%authorizing the sale
of a property acquired by tax foreclosure described as: LOT ), BLOCK ONE (1),
ALEUTIAN HOMES, INC. SUBDIVISION, according to Pla located in the Kodiak
Recording District, Third Judicial District, State of Alaskare It of the tax foreclosure
procedure. This parcel was previously owned by Ada I df n K. Panamarioff, 810 Hillside
Drive, Kodiak, Alaska 99615; and �`/'✓.
WHEREAS, the Assembly adopted Ordinance 2 1-07 which determined that a public
need does not exist to retain LOT FOUR ( ONE (1), ALEUTIAN HOMES, INC.
SUBDIVISION for a public purpose, and that I e sold; and
WHEREAS, Ordinance No. FY202W dkected the finance director to offer the property by
sealed bid auction with the highest b$d ak')g ownership, and setting certain terms of sale; and
WHEREAS, the Kodiak Island W4Vdesires to supplement Ordinance No. FY2021-07 to set
a minimum sale price and red1R0hQ6fflrrms of sale.
NOW, THEREFORE, BIT RbAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that: ^
Section 1: WkoraTVnce is NOT of permanent nature and shall NOT become a part of the
,^odi Island Borough Code of Ordinances.
Sectio�49t parcel identified by number 14279; Legal Description: LOT FOUR (4), BLOCK
ONE (1), ALEUTIAN HOMES, INC. SUBDIVISION, according to Plat No. 74-9 ,
Q located in the Kodiak Recording District, Third Judicial District, State of Alaska and
formerly owned by Ada L. and Susan K. Panamarioff, authorized to be sold by
Ordinance No. FY2021-07 shall be offered for sale in accordance with this
ordinance. To the extent that the sale process in this ordinance conflicts with or
modifies Ordinance No. FY2021-07, the sale process in this ordinance shall be
read as amending Ordinance No. FY2021-07.
Section 3: The finance director is directed to offer the property immediately by sealed bid
auction with public notice as provided in KIBC 18.20.140, and the property will be
sold to the highest bidder. The parcel shall be considered sold when the bid is
accepted.

Section 4: To be eligible for consideration, all sealed bids must be received in the cashier's
office by the date set by the finance director. Bidder is to enclose a 10% deposit
based on the minimum bid amount shown in the bid packet. This payment must be
in the form of a cashier's check, bank draft, certified check, or other form acceptable
to the Borough Finance Director. If successful, the remaining bid balance must be
paid within thirty (30) days of the bid date.
Section 5: This property has been appraised by the Borough Assessor within a fair mark t value
range of $30,000 - $60,000.
Section 6: For the sale of the property in accordance with KIBC 18.20.0 a imum
acceptable bid at auction shall be not less than the taxes, penalt t s d fees,
which include costs to the Borough of foreclosing and selling p e . This sale
is exempt from the requirements of KIBC 18.20.100 a be onducted as
provided in this ordinance. In the bid packet or notice of thl e, p spective buyers
shall be advised of the minimum bid and that the B=1 erves the right to
withdraw the parcel from sale and that, pursuan a property may be
repurchased by the previous owner, or their as ' s h 'rs, at any time before a
bid is accepted.
Section 7: If no qualifying bids are received, the p be listed online for sale for at
least the minimum bid price. Any parc so[ is method will be considered sold
when the Borough receives an offer A p perty if that offer is accepted.
Section 8: If the property is sold for more Xhe amount of taxes, penalties, interests and
other related costs, any excgak proNts shall be processed and allocated pursuant
to AS 29.45.480.
Section 9: The Borough will ex n eliver to the buyer of the property a quitclaim deed,
without warranty, w ' onvey any and all interest the Borough might have in
the real prope to any state or federal liens in accordance with AS
29.45.450 ect to easements, reservations and restrictions of record
including zo ing o inances and any plat requirements and covenants.
Effective Date: rjAis finance shall become effective as provided in KIBC 1.10.040.
