I have included the zoning code for R3- multi family residential, which is what the lots at 111 E. Hillcrest, 115 E. Hillcrest and 114 Natalia are all zoned. I have also included the Abbreviated plat code, application and surveyor names, in case you wish to pursue subdividing 115 E. Hillcrest. Plat 2000-2 is the plat for 115 E. Hillcrest, Kodiak Townsite, Block 14, Lot 17A. This is the plat in which your father obtained a portion of the city right-of-way to make sure all of the house was on his lot. I have also included the as -built that was done in 1988, that does not reflect the additional land obtained by the city. Subdividing that lot to build an additional 3-plex would be the cleanest method to accomplish your goal, if you have enough buildable space to accommodate the structure and parking spaces once the subdivision is done. It appears, preliminarily, that the front yard setback for any new structure on a vacation lot created by subdividing 115 E. Hillcrest would only have to be 3.2 feet, based on setback averaging. This would be subject to a final determination. As a planner, I would be more comfortable with a minimum 5 foot setback from the lot line. I have attached what appears to be a portion of an as -built for 114 Natalia, Kodiak Townsite, Block 16 Lot 13A. I was unable to find the full as -built or the plat creating Lot 13A, which is a little odd. There was an investigation done of the neighbor's deck construction in 2003 based on a complaint I am guessing was submitted by your father. The determination was that the deck is fully contained on the neighbor's lot, sitting only 0.4 feet from the lot line. This means that their deck is in non-compliance with zoning code, but does not appear to be crossing into your property. As I mentioned, you could hire a surveyor to look at it from your side, but it is a civil matter. Please note that KIB zoning code 17.160.030E does not allow for accessory buildings, such as detached garages, to be built on residential zoned lots without the presence of a main building used as a residence on the same lot.
