1991-19 Exchange Of Lot 17, Block 1, Russian Creek Alaska Subdivision For Tract E Of Tract A, Bells Flats Alaska SubdivisionIntroduced by: Mayor Selby Recommended by: � Planning & Zoning Commiss'6n Drafted by: CDD Di ctor Introduced: 0 /02/91 Died: 6/20/91 KODIAK ISLAND BOROUGH RESOLUTION NO. 91-19 A RESOLUTION AUTHORIZING THE EXCHANGE OF LOT 1'f, BLOCK 1, RUSSIAN CREEK ALASKA SUBDIVISION FOR TRACT F TRACT A, BELLS FLATS ALASKA SUBDIVISION WHEREAS, the Kodiak Island Borough Planning and Zonip6 Commission and Assembly have previously reviewed and recommend d for disposal Lot 17, Block 1, Russian Creek Alaska Subdivision, with determination that it is no longer required for municipal purposes; and WHEREAS, the Kodiak Island Borough Kodiak Island Borough recommended that the Boro Alaska Subdivision for Traci and anog and Zoning Commission and the -1' and Recreation Committee have exchange Lot 17, Block 1, Russian Creek of Tract A, Bells Flats Alaska Subdivision; WHEREAS, Tract E of TracZBell lats Alaska Subdivisionis available for exchange; and WHEREAS, there is a neeand for off-street parking to support sport fishing activity in thehe tract to be acquired; and WHEREAS, the Kodiak stand Borough exercises non -area wide parks and recreation power a has the authority to provide recreation facilities for residents and visitors and WHEREAS, KI Section 2.43.010 states that the Parks and Recreation Committee is powered to identify existing and future recreational demands including Indoor and outdoor recreation; and WHEREAS, unregulated parking by sportfishing enthusiasts and sightseers has created / congestion at the Russian Creek Bridge; and this congestion has created a hazard for vehicles traveling Rezanof Drive Road and pedestrians crossing the highway to view or fish for Salmon; and Kodiak Island Borough, Alaska Resolution No. 91-19 Page 1 of 3 WHEREAS, Tract E of Tract A, Bells Flats Alaska Subdivision has been identified a a suitable site for a parking area and is of adequate size to accomm ate other community uses that require a centralized location in theW mens Bay Area; and WHEREAS, the Parks and Recreation Committee has recommended t t funds be dedicated to provide for project completion by the Syeh f 1991; and WHEREAS, alternative locations for off—street parking will not mcurrent and future parking demands as well as the tract to be acnd WHEREAS, the exchange is in the Borough's best interest, in at the real property to be acquired, as part of the exchange, will be de loped to provide support for recreational activities (sport fishing) as well as to reduce traffic congestion and safety hazards that result fro intensive recreation activity in the area during the fishing season. NOW, THEREFORE, BE IT RESOLVED BY T KODIAK ISLAND BOROUGH ASSEMBLY THAT: The Borough Mayor is authoriz to exchange Lot 17, Block 1, Russian Creek Alaska Subdivision for Tract E of Tra A, Bells Flats Alaska Subdivision subject to the following terms and conditions: 1./nd value of the real pro 6rties shall be determined by the Kodiak Island Borough sor. The exchange s II be for equivalent values (i.e., if the properties are not equallue the difference ' I be made up in cash); 2.idence of market le title of the real properties shall be determined by a current tiort for each of a properties; and 3.y costs asso ' ted with the exchange are to be borne equally by the private prowner an he Borough. 4.at steps b taken in conjunction with this land exchange to create safe access tofrom th river, including but not limited to: the eduction of the speed limit in the vicinity of the Russian Creek Bridge; aa installation of warning lights in the vicinity of the Russian Creek Bridge;athe creation of a pedestrian crosswalk.
