A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH APPROVING
THE DISPOSAL BY SALE OF A PORTION OF LOT 5, BLOCK 7, MONASHKA BAY ALASKA
SUBDIVISION FOR THE FAIR MARKET VALUE OF $1,192.00 (P&Z Case No. 20-004).
WHEREAS, a 3,613 square foot portion of Lot 5, Block 7, Monashka Bay Alaska Subdivsion is
owned by the Kodiak Island Borough; and
WHEREAS, that portion of Lot 5, Block 7, Monashka Bay Alaska Subdivision is not a legal lot
according to KIBC 17.70.040; and
WHEREAS, that portion of Lot 5, Block 7, Monashka Bay Alaska Subdivision was acquired by
Kodiak Island Borough in 1982 after failure to reach an agreement for temporary trespass to aid
in road construction; and
WHEREAS, the parcel identified cannot serve any other public purpose; and
WHEREAS, the current owner of Lot 5, Block 7, Monashka Bay Alaska Subdivision has
expressed a desire to acquire the land at fair market value; and
WHEREAS, the Kodiak Island Borough Assessor has appraised the property at fair market value
of $1,192.00; and
WHEREAS, the Kodiak Island Borough Planning and Zoning Commission recommended
approval of the disposal by sale of that portion of Lot 5, Block 7, Monashka Bay Alaska Subdivision
by passing Planning & Zoning Resolution FY2020-03; and
WHEREAS, KIBC 18.20.030.6 states that borough land sales not subject to approval by
ordinance are subject to approval by Assembly resolution; and
WHEREAS, KIBC 18.20.030.6 further states that the resolution shall specify the terms and
conditions upon which the disposal will be offered.
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that the 3.613 square foot portion of Lot 5, Block 7, Monashka Bay Alaska Subdivision
be offered for disposal by sale.

BE IT FURTHER RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH that
the portion of Lot 5, Block 7, Monashka Bay Alaska Subdivision be sold to the current owner of
Lot 5, Block 7, Monashka Bay Alaska Subdivision for the fair market price of $1,192.00
