LEASE WITH OPTION TO PURCHASE
This Agreement, dated _``____ --- 2019, by and between 2 individuals known
as Michael and Stacie Fields of 3103 W Park Street, Phoenix, Arizona 85401,
hereinafter known as the "Landlord
AND
2 individuals known as Christina and Stanley Radeski, hereinafter known as the
"Tenant(s)", agree to following:
OCCUPANT(S): The Premises is to be occupied as a residential dwelling with the
following Two (2) Occupants to reside on the Premises in addition to the Tenant(s)
mentioned above: Audrey Radeski and Abbigial Radeski, hereinafter known as the
"Occupant(s)".
OFFER TO RENT: The Landlord hereby rents to the Tenant(s), subject to the following
terms and conditions of this Agreement, a single-family home with the address of 1724
Simeonoff Street, Kodiak, Alaska, 99615 consisting of 2.5 bathroom(s) and 4
bedroom(s) hereinafter known as the "Premises". The Landlord may also use the
address for notices sent to the Tenant(s).
PURPOSE: The Tenant(s) and any Occupant(s) may use the Premises as a residential
dwelling. It can also be used for Tenant(s) business to include licensed FFL sales,
repairs, and assembly in accordance with local ordinances and state and federal law.
APPLIANCES: The Landlord shall provide the following appliances:
Dishwasher, Hot Water Heater, Microwave, Oven(s), Refrigerator, Stove(s), and Pellet
Stove. All other appliances to be provided by the Tenant(s).
LEASE TERM: This Agreement shall be a fixed -period arrangement beginning on
January 1, 2020 and ending on December 31, 2021 with the Tenant(s) having the
option to continue to occupy the Premises under the same terms and conditions of this
Agreement under a Month -to -Month arrangement (Tenancy at Will) with either the
Landlord or Tenant having the option to cancel the tenancy with at least sixty (60) days'
notice.
RENT: Tenant(s) shall pay the Landlord in equal monthly installments of $2,350.00 (US
Dollars) hereinafter know as the "Rent". The Rent will be due on the First (1st) of every
month and be paid via Deposit to Account at Alaska USA Bank. In the event of raise in
property taxes, the Landlord agrees to discuss adjustment of monthly installments at
least one month prior to any changes.
POSSESSION: Tenant(s) shall examin the condition of the Premises and by taking
possession acknowledges that they have accepted the Premises in good order and in
its current condition or shall notify the landlord in writing of unacceptable conditions prior
to moving in. Landlord agrees to allow Tenant(s) the opportunity to move in belonging
starting on December 14, 2019, if utilities are placed in Tenant(s) name prior to.
Landlord also agrees to allow Tenant(s) to occupy -the Premises on or after December
21, 2019.
OPTION TO PURCHASE: The Tenant(s) shall have the right to purchase the Premises
described herein for fair market value at that time, or a mutually agreed upon sales price
at any time during the course of the Lease Term, along with any renewal periods or
extensions. The Tenant(s) agree to attempt to purchase the Premises at least one time
within the original Lease Term and at least one time during the renewal periods, not to
extend beyond five (5) years.
ACCESS: The Landlord agress to give access to the Tenant(s) in the form of keys,
fobs, cards, or any type of keyless security entry as needed to enter the common areas
and the Premises.
MOVE -IN' INSPECTION: Before, at the time of the Tenant(s) accepting poses, or
shortly thereafter, the Landlord and Tenant(s) shall perform an inspection of the
Premises.
UTILITIES: The Landlord agrees to pay for the monthly water bill with all other utilities
and services to be the responsibility of the Tenant(s). The Tenant(s) also agrees to
keep the Fuel Oil on a constant fill plan to ensure the heating of the Premise is
maintained.
MAINTENANCE, REPAIRS, OR ALTERATIONS: The Tenant(s) shall, at their own
expense and at all times, maintain premises in a clean and sanitary manner, and shall
surrender the same at termination thereof, in as good condition as received, normal
wear and tear excepted. The Landlord shall be responsible for all repairs to the interior
and exterior of the building with exception to those damages caused by the Tenant(s).
PETS: The Tenant(s) shall be allowed to have pets on the Premise within accordance
to any and all local regulations.
NOISE/WASTE: The Tenant(s) agrees not to commit waste on the premises, maintain,
or permit to be maintained, a nuisance thereon, or use, or permit the premises to be
used, in an unlawful manner. The Tenant(s) further agrees to abide by any and all
local, county, and State noise ordinances.
SMOKING POLICY: Tobacco and/or marijuana smoking on the Premises is prohibited
on the entire property, including common areas.
COMPLIANCE WITH LAW: The Tenant(s) agrees that during the term of the
Agreement, to properly comply with any present and future laws, ordinances, orders,
rules, regulations, and requirements of the Federal, State, County, City, and Municipal
government or any of their departments, bureaus, boards, commissions and officials
thereof with respect to the premises, or the use or occupancy thereof, whether said
compliance shall be ordered or directed to or against the Tenant(s), the Landlord, or
both.
NOTICES: Any notice to be sent by the Landlord to the Tenant(s) to each other shall
