10/03/2019 Regular MeetingKODIAK ISLAND BOROUGH Assembly Regular Meeting October 3, 2019 A regular meeting of the Kodiak Island Borough Assembly was held on October 3, 2019 in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 6:30 p.m. The invocation was given by Major David Davis of the Salvation Army. Mayor Rohrer led the Pledge of Allegiance. Present were Mayor Dan Rohrer, Assembly members Scott Arndt, Andy Schroeder, Scott Smiley, and James Turner. Also present were Borough Manager Michael Powers, Borough Clerk Tara Welinsky and Deputy Clerk Alise Rice. ARNDT moved to excuse Assembly member Kavanaugh, Assembly member Skinner, and Assembly member Symmons due to personal leave. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF AGENDA AND CONSENT AGENDA ARNDT moved to approve the agenda and the consent agenda. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF MINUTES Regular Meeting Minutes of September 19, 2019 and Special Meeting Minutes of September 23, 2019 were approved under consent agenda. CITIZENS' COMMENTS (Limited To Three Minutes Per Speaker) The following spoke under citizen's comments: • Dave Davis • Howard Rue, Bayside Fire Department • Kent Cross • Pat Holms AWARDS AND PRESENTATIONS Mayor Rohrer proclaimed the Month of October 2019 as Domestic Violence Awareness Month. Accepting the proclamation on behalf of the Kodiak Island Women's Resource and Crisis Center was Outreach Advocate, Ellamy Tiller. COMMITTEE REPORTS • Assembly member Turner reported on current events from the Community Advisory Board meeting and the Consolidation Committee. • Assembly member Smiley reported on the Kodiak Fisheries Work Group meeting. Kodiak Island Borough Assembly Regular Meeting Minutes October 3, 2019 Page 1 of 5 PUBLIC HEARING Ordinance No. FY2019-20 Amending Chapters 17.160 KIBC (Accessory Buildings and Accessory Dwelling Units), And Related Chapters 17.65 KIBC (RR - Rural Residential District) and 17.70 KIBC (RR1 - Rural Residential One District) To Change Permitted Uses, Conditional Uses and Development Standards Related to Parking and Size Limit. TURNER moved to amend the motion to take RR (Rural Residential) and RR1 (Rural Resident One Family) back to what they currently are in code today. ROLL CALL VOTE ON THE MAIN MOTION AS AMENDED CARRIED UNANIMOUSLY: Schroeder, Smiley, Turner, and Arndt. 2. Ordinance No. FY2020-04 An Ordinance Of The Assembly Of The Kodiak Island Borough Amending Kodiak Island Borough Code Title 3 Revenue And Finance, Chapter 3.35 Real Property Tax, Section 3.35.030 Real And Personal Property Exempted From Taxation. At 7:56 p.m. Mayor Rohrer called for a short minute break. At 8:08 p.m. Mayor Rohrer reconvened the meeting. ARNDT moved to adopt Ordinance No. FY2020-04. Mayor Rohrer opened the public hearing. Ordinance FY2020-06 To Amend KIBC 17.10.030 Comprehensive Plan To Include The City Of Kodiak Near Island Development Plan - Concept A, Minimum Development. ARNDT moved to adopt Ordinance No. FY2020-06. Mayor Rohrer opened the public hearing. BOROUGH MANAGER'S REPORT Manager Michael Powers reported on the following: • Met with Providence Hospital to discuss the long term facility lease, Medicaid services, capital issues related to the Medicare audit, fuel tank project, drill work on the wall, and their priority projects. • Met with Kodiak Island Sportsmen's Association (KISA) representatives to review location of the pistol range cover, beginning construction, and clearing for parking. • Referred several inquires about non-operative vehicles to the appropriate department. • Worked with Acting Director for Community Development, Erin Welty, in regard to a staff disciplinary issue. • Assisted staff with Janel Day's (KIB GIS Analyst) letter of resignation. • Interviews for the Environmental Specialist position were conducted, and additional candidate interviews were scheduled. • Reviewed potential for changing staffing and reviewed current applicants for the Revenue Accountant position. • Worked on ways to potentially address the school bond debt. • Presented at the Rural Forum. • Traveling during the month of October for Manager/Superintendent Conference, International City County Managers Association Conference, and six days of personal leave. Darning the month of November I have medical leave. MESSAGES FROM THE BOROUGH MAYOR Borough Mayor Rohrer reported on the following: • Recognized the Clerks for a great job on the Elections. • Attended the Cliff Point open house. UNFINISHED BUSINESS None. NEW BUSINESS A. Contracts 1. Contract No. FY2020-07 Approval of 1 -Year Contract with Matson Navigation Company of Alaska, Inc. for Metals Processing and Hauling. ARNDT moved to approve Contract No. FY -2020-07. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Turner, Arndt, Schroeder, and Smiley. B. Resolutions 1. Resolution No. FY2020-11 Granting A Nonexclusive Easement For Access, Both To Ingress And Egress, For Vehicular And Pedestrian Traffic, And In Favor Of Peggy J. Purdy And Any Successors And Assignees Upon The Property Described In Exhibit "A" For The Benefit Of Lot 4, Block 8, Monashka Bay Subdivision And Any Future Subdivisions Of That Parcel. ARNDT moved to adopt Resolution No. FY2020-11. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Arndt, Schroeder, Smiley, and Turner. C. Ordinances For Introduction 1. Ordinance No. FY2020-01A Amending Ordinance No. FY2020-01, Fiscal Year 2020 Budget, By Amending Budgets To Account For Various Revenues That Are Over Budget, Providing For Additional Expenditures And Moving Funds Between Projects. ARNDT moved to advance Ordinance No. FY2020-01A to public hearing at the next regular meeting of the Assembly on October 17, 2019. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Schroeder, Smiley, Turner, and Arndt. 2. Ordinance No. FY2020-10 Amending Kodiak Island Borough Code of Ordinances Title 3 Revenue And Finance Chapter 3.05 Fiscal Policy Section 3.05.080 Reserve Policies. ARNDT moved to advance Ordinance No. FY2020-10 to public hearing at the next regular meeting of the Assembly on October 17, 2019. Support Letter For Funding From Exxon Valdez Oil Spill (EVOS) Trustee Council For Antone Larson Bay/Sharatin Bay Project - The Great Lands Trust. CITIZENS' COMMENTS The following spoke under citizens' comments: • Chief Rue, Bayside Fire Department • Kent Cross ASSEMBLY MEMBERS' COMMENTS Assembly member Arndt spoke about the Great Lands Trust letter and congratulated the new members of the Assembly and School Board. Assembly member Smiley spoke about the School Board, Assembly, and Mayoral race results. Assembly member Schroeder remarked about the ADU ordinance and how development and recreation can co -exist. He also congratulated the newly elected members. Assembly member Turner had no comment. Announcements The next Assembly work session is scheduled for Thursday, October 10, 2019, at 6:30 p.m. in the School District Conference Room. The next regular meeting is scheduled on Thursday, October 17, 2019, at 6:30 p.m. in the Borough Assembly Chambers. EXECUTIVE SESSION None. ADJOURNMENT ARNDT moved to adjourn the meeting.
