Excavation and fill related to test pits and temporary construction of roads that are required to facilitate geotechnical testing for a
proposed project that will realign, lengthen, and widen the existing airport runway to meet current FAA standards. This proposed
action is a process that is required for developing the project design.

contractors or agents, to enter upon the subsurface of land owned by KONIAG, INCORPORATED, whose
address is 194 Alimaq Drive, Kodiak, AK 99615, and is described as follows:
The subsurface of the following -described tracts of land:
Tract 4, Tract 5, Tract 6, Tract 8, Tract 9 and Tract 11 of ANCSA (14c), Plat 2006-8, and the Dependent
Resurvey of Portions of U.S. Survey No. 5509 and 1736, Kodiak Recording District, Third Judicial

that lie within the current lines of Alaska Project Z527960000, delineated as to said land on project plats.
For the purposes of:
performing geotechnical soil sampling and survey by standard approved methods and to bring onto said
lands the necessary equipment for that purpose; and to do those reasonable acts necessary to accomplish
the aforementioned tasks, including but not limited to excavating, drilling, and accomplishing all
necessary incidentals thereto
It is understood that this permission is not a waiver in any way of the right to compensation for such land or of
any remedy authorized by law to secure payment therefore. If it is determined that additional land interests are
necessary, the State will negotiate with the undersigned to agree upon terms of compensation, and if an agreement
cannot be reached, eminent domain proceedings will commence to establish just compensation.
This permission is granted to further transportation planning, engineering, design, construction and incidentals
thereto, in consideration of a minimum payment of $100.00 and shall terminate upon completion of the testing
and survey mentioned or eight months after the date of execution of this document. No further promise of
purchase of real property rights is made or implied. Nor does this agreement limit the State in potential
negotiations for additional real property rights for the aforementioned project. Should the Owner require and
request, every reasonable attempt shall be made to give no less than 24-hour notice to enter the said property,
given adequate contact information as provided to the State. The State of Alaska, shall leave said premises in a
clean and presentable condition when said investigation has been completed.
