FY2020-05 A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH AUTHORIZING SHORT TERM RENTALS OF THE KODIAK FISHERIES RESEARCH CENTER APARTMENTS WHEREAS, the Kodiak Island Borough is the owner of the Kodiak Fisheries Research Center (KFRC) and associated buildings; and WHEREAS, the apartments co -located with the KFRC facility, were built to house scientists visiting on behalf of the University of Alaska, an original tenant of and financial contributor to the establishment of the KFRC; and WHEREAS, the University of Alaska is no longer a tenant in the KFRC, and the apartments have remained vacant for one year; and WHEREAS, other agencies within the Kodiak community have expressed interest in renting (leasing) the apartments on a short-term basis; and WHEREAS, allowing short term rentals of the apartments would bring in revenue that would offset the costs of providing utilities and maintenance to the apartment building; and WHEREAS, Kodiak Island Borough Code (KIBC) 18.40 LEASING OF REAL PROPERTY OR INTEREST THEREIN does not provide for leasing on a short-term basis; and WHEREAS, the Assembly desires that the Manager facilitate the rental of the apartments for short term rentals on a trial basis, and report back with recommendations for a longer term program for management and rental of those apartments. NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH that the Manager is authorized to develop procedures for short term leases on a trial basis through March of 2020, and to report back with recommendations for an on-going program for managing the apartments as rentals. Terms for such rentals shall be consistent with the following: a. The rentals shall be consistent with the Alaska Uniform Landlord Tenant Act; b. Rental terms shall be not less than 30 days; Kodiak Island Borough, Alaska Resolution No. FY2020-05 Page 1 of 2 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 c. Rental rates shall be consistent with market rates, as determined by the Manager, for similarly situated apartments; d. Tenants shall be responsible for their own telecommunications charges; e. Units shall be non-smoking and subject to rules for use and occupancy substantially similar to the rules applied by the University of Alaska for the prior housing use of the units; f. Where more than one entity is requesting to rent a unit, selection of the tenant entity shall be by drawing lots or some similar random selection method; and 2. These rentals are exempt from the lease procedures in KIBC 18.40; The Manager is authorized to negotiate and enter into short term rental agreements for the Kodiak Fisheries Center Apartments consistent with section 1 of this resolution; and 3. By no later than March 1, 2020 the Manager shall report to the Assembly concerning the success of the short term rental program and recommend any ongoing program for rental and management of these units.
