Bayside sponsored a 40 hour EVOC Course (Emergency Vehicle Driving Course)
in September of 2018 with 18 students passing the course.
All 14,000 feet of fire hose has been tested, numbered and recorded –done
annually.
Sharing services with the Kodiak Fire Department (fit testing, ladder testing,
and training).
Donated the Grumman Fire Engine 11 to Old Harbor.
Fire department training at Port Lions.
Fire department training at Ouzinkie.
New led Lighting in Training Room and Upper Bay.
All gutters cleaned at the station API Separator in the lower bay was cleaned and
inspected.
Wood rot on the hose tower was repaired.
Drive was restriped.
Fire hose washer was purchased and all 1”, 1½” and 2½ was washed.
Upper garage was repainted by fire fighters.
New System 2000 Boiler was installed replacing a 40 year old unit and the boiler
room was repainted by fire fighters.
The engineering on the Source capture system is complete and ready to put an
RFP out for bid.
Working with Engineering and Facilities to get pricing on new siding, windows
and roof on the old building so an RFP can be let.
New Led lights over the bays doors have been installed.
A security camera system is being priced so a RFP can be let on this item.

3. KANA tour of the station with fire prevention 10 students and 3 teachers –1.5 hours.
4. Hope Cottage Station Tour with fire prevention 12 student and 12 teachers –2 hours.
5. Run the Rock, Communications Bus supported 75 runners for the race –5 firefighters
for 6 hours.
6. Bayside provided EMTS for all Kodiak Race weekends –60 hours.
7.Nazarene Halloween Party with 75 adults and children –2 hours.
8.Other activities that were attended by Bayside at no cost.
Awarded (2017) from AFG (Assistance to Firefighters Grant) $154,000 for 27 new Scott
Air Packs.
Awarded (2018) from AFG (Assistance to Firefighters Grant) $89,000 for a Source Capture
Diesel Exhaust Extraction System.
Awarded (2017) $7,500 from the Alaska Department of Natural Resources –VFA
(Volunteer Fire Assistance) for forest fire supplies.
Awarded (2018) $7,500 from the Alaska Department of Natural Resources –VFA
(Volunteer Fire Assistance) for forest fire supplies.
Applied (2019) $7,000 from the Alaska Department of Natural Resources –VFA
(Volunteer Fire Assistance) for forest fire supplies.
Applied (2019)from AFG (Assistance to Firefighters Grant) $156,000 for new radios,
pagers, and thermal imaging cameras.
Applied (2019) from AFG (Assistance to Firefighters Grant) $100,000 for a Fire Prevention
Trailer to be shared with Kodiak Fire Department, U. S. C. G. Fire Department and
Women's Bay Fire departments.
Applied (2019) from Homeland Security for $400,000 for a new 3 story fully integrated
burn building.
Offer an Alaska State Certified Fire Fighter 1 / 2 Course in the fall of
2019.
Continue recruitment (retention) to get 45 members.
Work with ISO to get a lower ISO rating.
Continued maintenance plan and equipment upgrades through
accurate budget forecasting for the Bayside Fire Department.
Improve record keeping for the Bayside Fire Department.
Continue training for the department.

FUTURE LAND USE DESIGNATION, ZONING, AND USE
“Bed and breakfast (B&B)” means overnight accommodations and a morning meal in a
dwelling unit provided to transients for compensation. The operator of the B&B must reside
on the premises and the maximum number of rooms that can be rented out is five. In
addition to the off-street parking requirements of KIBC 17.175.040for a single-family
dwelling, a B&B with up to two guest rooms must provide one additional parking space; a
B&B with three to four guest rooms must provide two additional parking spaces; and a B&B
with fiveguest rooms must provide three additional parking spaces.
“Lodge” means a building or group of buildings containing both rooms and dwelling units
available for temporary rental to transient individuals or families. The types of activities
supported by a lodge may include, but are not limited to, fishing, hunting, wildlife
photography and viewing, and passive recreational activities.

Larsen Bay Land Use Goal:Enhance flexibility of land use regulations.
Policy:Address concerns about the social impacts of some lodges located within
neighborhoods.
o Implementation Action:Allow small scale commercial and more bed-and-
breakfasts and lodges under certain circumstances, such as in mixed-use
zones.
Larsen Bay Economic Goal:Retain residents.
Policy:Improve economic opportunities in Larsen Bay.
o Implementation Action:Develop additional industries and businesses that
are attractive to Larsen Bay.

The Borough Community Development Department proposes ğƒĻƓķźƓŭ ƷŷĻ ĭǒƩƩĻƓƷ
\[ğƩƭĻƓ .ğǤ /ƚƒƦƩĻŷĻƓƭźǝĻ tƌğƓ (Case 17-025) IN ORDER TO FACILITATE a rezone request
(Case 17-026). The Borough shows no consideration for our Community when taking such an
aggressive position in support of Case #17-026, a request to rezone 4 R-1 lots to Business. I
strongly oppose any amendment to the Comprehensive Plan at this time.
In discussion with the Planning and Zoning on CASE 17-025 at the Public Hearing on April
19, 2017, Commissioners used the terms VARIANCE and AMENDMENT to the Comprehensive
Plan interchangeably. Chapter 17.205 defines AMENDMENTS as a process giving the Borough
wide authority to change regulations to address public necessity, convenience, general welfare
or good zoning practice. Chapter 17.195 of Borough Code Describes the process to be followed
by the Planning and Zoning Commission when considering an application for a VARIANCE.
ĭźƩĭǒƒƭƷğƓĭĻƭ. The use of VARIANCE as opposed to AMENDMENT as I interpret it lightens the
high handedness of the Borough over the local community.
We are a small secluded community. I believe that all Larsen Bay property owners and
residents should have the opportunity to comment on an ğƒĻƓķƒĻƓƷ Ʒƚ ƚǒƩ /ƚƒƦƩĻŷĻƓƭźǝĻ
tƌğƓ͵ The current Comprehensive Plan was written in 1984 and then reviewed in 2008. I recall a
significant effort and input by the Council and the Community during the 2008 process. The
current Comprehensive Plan does not allow for such a large amount of land to be rezoned from
R-1 to Business.
I believe a moratorium on rezone requests from Residential to Business will give the
Community of Larsen Bay the opportunity for all property owners to come together and discuss
future land use plans.
/ğƭĻ ϔЊАΏЉЋЏ
Based on the information I have I am also opposed to the rezone request (case #17-
026). The owner knew when purchasing the lots in question that they were zoned Single Family
Residential properties. Why the requested change? Is this request part of the owners original
Plan for the property? Does he feel he can come in to a Community and do as he pleases
without regard for the standing law? As far as I am aware the property owner never discussed
this rezone request with anyone in the Community. In addition to the 4 lots being proposed for
a rezone an additional 3 adjacent lots are owned by the same family in the form of business
entities. These 7 lots encompass access to Moses which is a well used community
beach. What is the big picture here? I would like to hear what the property owner has in mind.
Once the first 4 lots are rezoned, will a request be made for the additional 3 lots to be rezoned?
If the lots are rezoned the property owner would be able to develop the property however he
chose. On a recent bike ride I saw a substantial amount of building materials on the lots
proposed for the rezone. Does the owner feel that his rezone request is a done deal? Is he
expanding his business despite the current single family zoning?
Chapter 17.195 of Borough Code outlines the conditions under which a VARIANCE is
approved/denied. Following is a rebuttal to each of the six points to be considered before a
VARIANCE can be permitted in Case 17-26.
A. Approval
report and receipt of testimony at the public hearing, that the use proposed in the
application, or under appropriate conditions or restrictions, meets all of the following,
the variance shall be granted:
1. That there are exceptional physical circumstances or conditions applicable to the property or
to its intended use or development which do not apply generally to other properties in the
same land use district;
Current zoning category and zoning at time of purchase is/was Single Family, Residential and
all surrounding properties are single family, residential. Zoning at time of purchase would
preclude the owners intent to develop the property.
2. That the strict application of the provisions of this title would result in practical difficulties or
unnecessary hardship;
The lots in discussion have always been single family residential and were single family
residential at the time of their purchase (2007 and 2009). How could a property owner claim
unnecessary hardship when he knew the lots zoning category at time of purchase? Was it
property owners intent to buy up residential property with the intent of pushing for a
business/commercial rezone at a later date?
3. That the granting of the variance will not result in material damage or prejudice to other
Adjacent property owners object to noise and traffic associated with large groups of people
with a vacationing/anything goes mind set.
There is also a question of the City being able to provide adequate water and electrical
utilities. The land is low lying and swampy which raises the question of supporting a septic
system for sewage for a commercial property. The EPA would need to be consulted as to if the
property could support an appropriate septic system and to protect the public health.
4. That the granting of the variance will not be contrary to the objectives of the comprehensive
plan;
The rezone of 4 lots from residential to commercial is contrary to the objectives of the Larsen
Bay Comprehensive Plan as written in 1984 and reviewed in 2008.
5. That actions of the applicant did not cause special conditions or financial hardship or
inconvenience from which relief is being sought by a variance; and
There is a substantial amount of building material on the lots proposed for the rezone which
are indicative of the owners intent to develop the property prior to an approved rezone. Is the
owners moving forward prior to approval an attempt to get relief from his investment?
6. That granting the variance will not permit a prohibited land use in the district involved.
Following is a description in KIB Zoning Code which clearly shows the rezoning to business or
commercial is a prohibited land use for these four Single Family Resident lots.
17.75.010 Description and intent.
The R1 single-family residential zoning district is established as a land use district for small
lot, single-family residential dwellings where public water and sewer services are available.
For the single-family residential district, in promoting the general purposes of this title, the
specific intentions of this chapter are:
A. To encourage the construction of single-family dwellings;
B. To prohibit commercial and industrial land uses and any other use of the land which would
interfere with the development or continuation of single-family dwellings in the district;
C. To encourage the discontinuance of existing uses that are not permitted under the
provisions of this chapter;
D. To discourage any use which would generate other than normal vehicular traffic on streets
serving residents on those streets; and
E. To prohibit any use which, because of its character or size, would create requirements and
costs for public services, such as police and fire protection, water supply and sewerage, before
such service can systematically and adequately be provided. \[Ord. 83-17-O §2, 1983. Formerly

My name is Chad Elmer from Kodiak Legends Lodge. I would like request the Kodiak Island
Borough Assembly to consider reintroducing ordinance No. FY2019-03, the rezoning of lots
from residential to business for Uyak Bay LLC DBA Kodiak Legends Lodge at the February
7th Assembly meeting.
Back in October I sent in a petition from the residents and business owners in Larsen Bay in
support of the rezoning and I believe you have also received letters from the City of Larsen
Bay in support also.

The Borough Community Development Department proposes ğƒĻƓķźƓŭ ƷŷĻ ĭǒƩƩĻƓƷ
\[ğƩƭĻƓ .ğǤ /ƚƒƦƩĻŷĻƓƭźǝĻ tƌğƓ (Case 17-025) IN ORDER TO FACILITATE a rezone request
(Case 17-026). The Borough shows no consideration for our Community when taking such an
aggressive position in support of Case #17-026, a request to rezone 4 R-1 lots to Business. I
strongly oppose any amendment to the Comprehensive Plan at this time.
In discussion with the Planning and Zoning on CASE 17-025 at the Public Hearing on April
19, 2017, Commissioners used the terms VARIANCE and AMENDMENT to the Comprehensive
Plan interchangeably. Chapter 17.205 defines AMENDMENTS as a process giving the Borough
wide authority to change regulations to address public necessity, convenience, general welfare
or good zoning practice. Chapter 17.195 of Borough Code Describes the process to be followed
by the Planning and Zoning Commission when considering an application for a VARIANCE.
ğƩźğƓĭĻƭ ğƩĻ ƦƩƚǝźķĻķͶ͵͵ ŅƚƩ ƷŷĻ ƦǒƩƦƚƭĻ ƚŅ ƩĻƌğǣźƓŭ ǩƚƓźƓŭ ķźƭƷƩźĭƷ ƩĻƨǒźƩĻƒĻƓƷƭ źƓ ƭƦĻĭźğƌ
ĭźƩĭǒƒƭƷğƓĭĻƭ. The use of VARIANCE as opposed to AMENDMENT as I interpret it lightens the
high handedness of the Borough over the local community.
We are a small secluded community. I believe that all Larsen Bay property owners and
residents should have the opportunity to comment on an ğƒĻƓķƒĻƓƷ Ʒƚ ƚǒƩ /ƚƒƦƩĻŷĻƓƭźǝĻ
tƌğƓ͵ The current Comprehensive Plan was written in 1984 and then reviewed in 2008. I recall a
significant effort and input by the Council and the Community during the 2008 process. The
current Comprehensive Plan does not allow for such a large amount of land to be rezoned from
R-1 to Business.
I believe a moratorium on rezone requests from Residential to Business will give the
Community of Larsen Bay the opportunity for all property owners to come together and discuss
future land use plans.

Based on the information I have I am also opposed to the rezone request (case #17-
026). The owner knew when purchasing the lots in question that they were zoned Single Family
Residential properties. Why the requested change? Is this request part of the owners original
Plan for the property? Does he feel he can come in to a Community and do as he pleases
without regard for the standing law? As far as I am aware the property owner never discussed
this rezone request with anyone in the Community. In addition to the 4 lots being proposed for
a rezone an additional 3 adjacent lots are owned by the same family in the form of business
entities. These 7 lots encompass access to MoƭĻƭƭ .Ļğĭŷ Ǟŷźĭŷ źƭ ğ ǞĻƌƌ ǒƭĻķ ĭƚƒƒǒƓźƷǤ

beach. What is the big picture here? I would like to hear what the property owner has in mind.
Once the first 4 lots are rezoned, will a request be made for the additional 3 lots to be rezoned?
If the lots are rezoned the property owner would be able to develop the property however he
chose. On a recent bike ride I saw a substantial amount of building materials on the lots
proposed for the rezone. Does the owner feel that his rezone request is a done deal? Is he
expanding his business despite the current single family zoning?
Chapter 17.195 of Borough Code outlines the conditions under which a VARIANCE is
approved/denied. Following is a rebuttal to each of the six points to be considered before a
VARIANCE can be permitted in Case 17-26.

report and receipt of testimony at the public hearing, that the use proposed in the
application, or under appropriate conditions or restrictions, meets all of the following,
the variance shall be granted:
1. That there are exceptional physical circumstances or conditions applicable to the property or
to its intended use or development which do not apply generally to other properties in the
same land use district;
Current zoning category and zoning at time of purchase is/was Single Family, Residential and
all surrounding properties are single family, residential. Zoning at time of purchase would
preclude the owners intent to develop the property.
2. That the strict application of the provisions of this title would result in practical difficulties or
unnecessary hardship;
The lots in discussion have always been single family residential and were single family
residential at the time of their purchase (2007 and 2009). How could a property owner claim
unnecessary hardship when he knew the lots zoning category at time of purchase? Was it
property owners intent to buy up residential property with the intent of pushing for a
business/commercial rezone at a later date?
3. That the granting of the variance will not result in material damage or prejudice to other
properties in the vicinity nor be detrimental to ƷŷĻ ƦǒĬƌźĭƭ ŷĻğƌƷŷͲ ƭğŅĻƷǤ ƚƩ ŭĻƓĻƩğƌ ǞĻƌŅğƩĻ
Adjacent property owners object to noise and traffic associated with large groups of people
with a vacationing/anything goes mind set.
There is also a question of the City being able to provide adequate water and electrical
utilities. The land is low lying and swampy which raises the question of supporting a septic
system for sewage for a commercial property. The EPA would need to be consulted as to if the
property could support an appropriate septic system and to protect the public health.
4. That the granting of the variance will not be contrary to the objectives of the comprehensive
plan;
The rezone of 4 lots from residential to commercial is contrary to the objectives of the Larsen
Bay Comprehensive Plan as written in 1984 and reviewed in 2008.

5. That actions of the applicant did not cause special conditions or financial hardship or
inconvenience from which relief is being sought by a variance; and
There is a substantial amount of building material on the lots proposed for the rezone which
are indicative of the owners intent to develop the property prior to an approved rezone. Is the
owners moving forward prior to approval an attempt to get relief from his investment?
6. That granting the variance will not permit a prohibited land use in the district involved.
Following is a description in KIB Zoning Code which clearly shows the rezoning to business or
commercial is a prohibited land use for these four Single Family Resident lots.
17.75.010 Description and intent.
The R1 single-family residential zoning district is established as a land use district for small
lot, single-family residential dwellings where public water and sewer services are available.
For the single-family residential district, in promoting the general purposes of this title, the
specific intentions of this chapter are:
A. To encourage the construction of single-family dwellings;
B. To prohibit commercial and industrial land uses and any other use of the land which would
interfere with the development or continuation of single-family dwellings in the district;
C. To encourage the discontinuance of existing uses that are not permitted under the
provisions of this chapter;
D. To discourage any use which would generate other than normal vehicular traffic on streets
serving residents on those streets; and
E. To prohibit any use which, because of its character or size, would create requirements and
costs for public services, such as police and fire protection, water supply and sewerage, before
such service can systematically and adequately be provided. \[Ord. 83-17-O §2, 1983. Formerly

BAYSIDE FIRE DEPARTMENT EXHAUST SYSTEM
Projects Office staff is assisting Bayside Fire Department with procurement and installation of a vehicle
exhaust system for both garages. Currently exhaust fans activate for 15 minutes when any garage door
is opened, but this is inefficient and costly. The new system will connect to the exhaust pipe of each
vehicle and activate when the vehicle is turned on. Projects Office staff is currently working through the
design process with Bayside staff and Jernstrom Engineering from Anchorage. The anticipated schedule
is to put the project out for bid in February 2019 and complete construction by late spring 2019.
CHINIAK TSUNAMI SHELTER AND LIBRARY
Construction is in progress for the replacement of the Chiniak Tsunami Shelter and Library that was
destroyed in the 2015 Twin Creeks fire. The design is for a single-story building with a kitchen area,
restroom, shower room, and a large open space for community meetings or providing shelter. Friend
Contractors LLC is the contractor and began work at the end of July 2018. As of December 31, 2018, all
interior finishes were complete, plumbing fixtures have been installed, and installation of exterior access
ramps and stairs is approximately 85% complete. The new well house is complete and well house
equipment has been installed. The well will need to be tested before an appropriate treatment system
can be designed and the system needs to be certified by the Alaska Department of Environmental
Conservation. The completion date for the project has been extended to April 15, 2019, but it is
expected to be substantially complete by mid-January 2019.
Kitchen CabinetsPlumbing Fixtures Exterior Deck/Landing
KODIAK FISHERIES RESEARCH CENTER & KODIAK HIGH SCHOOL ELECTRIC BOILERS
On September 6, 2018, the Assembly approved joint agreements with Kodiak Electric Association (KEA)
and Kodiak Island Borough School District (KIBSD) for interruptible electric service at Kodiak Fisheries
Research Center and Kodiak High School. As part of the agreements KEA will reimburse KIB for the costs
to install electric boilers at both buildings, and offer a reduced rate for the power to operate the boilers
at 90% the cost of fuel oil. KIB has contracted with RSA Engineers (RSA) to provide design and bid
documents for both new boilers. RSA performed a site visit on October 18, 2018, to document existing
conditions and meet with KIBSD and KEA to get input on the design. RSA provided 65% design
documents in mid-November 2018 which were reviewed and approved by the Architectural/Engineering
Review Board on December 4, 2018. RSA is now completing 95% documents. The tentative schedule is
to issue a bid package in early 2019 for the installation of both boilers, with construction scheduled for
summer 2019.
KODIAK MIDDLE SCHOOL BOILER ROOM REMODEL
This project is for the replacement of the remaining fuel oil boiler at Kodiak Middle School (KMS) and
infrastructure (pumps, domestic water supply, hot water heater, etc). Staff received approval from the
Alaska Department of Education and Early Development (DEED) to redirect excess funds from recently
completed bond projects to fund the boiler room work. RSA Engineers provided design documents
which were reviewed and approved by the Architectural/Engineering Review Board. The project was
issued for public bid in October 2018, three bids were received, and on December 20, 2018, the
Assembly approved a contract for the low bidder, Bering Industrial Contractors. Construction is planned
for summer 2019.
LANDFILL BALER BUILDING ROOF AND SIDING REPLACEMENT
This project is the replacement of the metal roof and siding at the Landfill Baler Building with a new
insulated panel system as well as other exterior improvements (doors, windows, canopies, etc.) Friend
Contractors LLC is the contractor and started construction in July 2018. As of December 31, 2018, new
wall and roof panels have been completed at the control room and lower garage sections of the
building. The contract completion date has been extended to June 28, 2019.
PROVIDENCE KODIAK ISLAND MEDICAL CENTER CONDITION SURVEY
In May 2018 the Assembly approved a term contract for Jensen Yorba Lott (JYL) for design services for
projects at Providence Kodiak Island Medical Center (PKIMC). Two representatives from JYL traveled to
Kodiak in June 2018 to meet with KIB and PKIMC personnel, tour the hospital, and discuss the priority
for renewal and replacement projects. During those meetings it was discussed that there has not been a
recent comprehensive assessment of the hospital facility and its systems. As such KIB has issued a
change order to JYL to perform a survey of the hospital to document its existing condition and then
provide recommendations for highest priority renewal and replacement projects. A team of architects
and engineers visited the hospital in early October 2018, and the condition survey was received in early
December 2018. The survey report is currently under review by KIB and PKIMC staff

Announcements
The Borough Assembly is going to meet with the City Council at a Joint Work Session on
Wednesday, February 13 at 7:30 p.m. in the School District Conference room.
The next Assembly work session is scheduled on Thursday, February 14 at 6:30 p.m. in
the School District Conference Room. The Assembly is also going to hold a Budget
Special Work Session on Saturday, February 16 at 9 a.m. in the Borough Assembly
Chambers.
The next regular meeting is scheduled on Thursday, February 21, 2019 at 6:30 p.m. in
the Assembly Chambers.
16. ADJOURNMENT
Recommended motion: Move to adjourn the meeting.
VOICE VOTE ON MOTION.
KIBC 2.30.030 A.... Meetings shall adjourn at 10:30 p.m. unless the time is extended by
a ma'ori of the votes to which the assembly is entitled. No meeting shall be extended
beyond 11 p.m., unless extended by a two-thirds vote of the assembly, except the
meeting shall be extended to set the time and place for resumption of the meeting.

Dear Manager and Assembly:
We are requesting that this letter be read at the next regular assembly meeting on February 711, 2019.
The Pasagshak community is requesting funding for the installation and purchase of a simple tsunami siren in
our community.
We are working with Kodiak Electric Association to gain approval to install the siren on a pole near the
entrance of the Pasagshak bridge. This would allow access for power to the siren. It would also allow access
to all residents in the area to turn on the siren if a warning is in effect, alerting other residents or visitors that
may not have been notified.
We are hoping to be included in any Borough budgeting or funding for these type of tsunami warning
improvements now or in the near future.
