11/07/2018 Special MeetingKODIAK ISLAND BOROUGH Assembly Special Meeting November 7, 2018 A special meeting of the Kodiak Island Borough Assembly was held on November 7, 2018, in the BOROUGH CONFERENCE ROOM of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 6:30 p.m. Present were Mayor Dan Rohrer, Assembly members Julie Kavanaugh, Andrew Schroeder, Rebecca Skinner, Scott Smiley, Dennis Symmons and James Turner. Also present were Borough Manager Michael Powers, and Borough Clerk Nova Javier. CITIZENS COMMENTS None. CONSIDERATION OF MATTERS IN THE CALL FOR THE SPECIAL MEETING 1. Interview of Assembly Member Candidates The Assembly interview the following candidates: a) Sherry Harmes (via -teleconference) b) Joseph Delgado c) Duane Dvorak d) Denise May e) Jeffrey Stewart f) Borghy Holm g) Scott Arndt 2. Appointment to the Kodiak Island Borough Assembly. SYMMONS moved to nominate Scott Arndt to the Assembly seat for a term to expire October 2019. SKINNER move to nominate the rest of the six candidates to the Assembly seat for a term to expire October 2019. KAVANAUGH moved to convene into executive session to discuss evaluation of the Assembly applicants, a matter which might include a discussion that could potentially prejudice the reputation and character of the applicants. ROLL CALL VOTE ON MOTION CARRIED FIVE TO ONE: Kavanaugh, Schroeder, Smiley, Symmons, and Turner (AYES); Skinner (NO). KAVANAUGH moved to invite the Mayor, Assembly, Borough Manager, and Clerk's Office Staff into executive session. Mayor Rohrer recessed the special meeting and convened the executive session at 7:54 p.m. After 30 minutes, he reconvened the special meeting. Process was followed as stated in KIBC 2.30.040 and Mr. Scott Arndt was appointed to the seat on the Assembly for a term to expire October 2019. Letter of Approval Addressed to NOAA Fisheries, Alaska Fisheries Science Center Strongly Supporting the Cooperative Research Proposal Entitled: Understanding Post -Settlement Survival for Juvenile Pacific Cod in the Gulf of Alaska. SMILEY moved to authorize the mayor to sign the letter addressed to NOAA Fisheries, Alaska Fisheries Science Center Strongly Supporting the Cooperative Research Proposal Entitled: Understanding Post -Settlement Survival for Juvenile Pacific Cod in the Gulf of Alaska. The letter is in support of Dr. Litzow's NMFS grant proposal for a second year of work regarding age 0 and age 1 juveniles of Pacific cod. Dr. Litzow gave a presentation of his continuing work to the Joint City/Borough Fisheries Working Group at their October meeting. Data from this continuing project will help in understanding the causes and effects of the recent collapse in Pacific cod stocks. Because of the significance of Pacific cod to the economy of the City of Kodiak and the Kodiak Island Borough, the joint City/Borough Fisheries Working Group felt that a letter of support for the project would be helpful. Although there were only 2 of the 4 Borough and City members of the committee present, they both favored the action. Among the 15 or so citizens present at the meeting, no one raised a concern about supporting this research. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Schroeder, Skinner, Smiley, Symmons, Turner, and Kavanaugh. 4. Resolution No. FY2019-14 Appointing the Kodiak Island Borough Attorney. SMILEY moved to adopt Ordinance No. FY2019-14. This resolution is in compliance with KIBC 2.65.020 which states that the assembly shall appoint the attorney by resolution. The current contract with Levesque Law Group, LLC expired June 26, 2017. The Assembly solicited letters of interest and received four responses. After holding the interviews on October 11 and 12, the assembly directed the manager to offer the position to Mr. Scott A. Brandt -Erichsen of Keene & Currall. This resolution also authorizes the manager to execute a contract with the approved respondent. Resolution No. FY2019-13 of the Kodiak Island Borough Assembly Authorizing The Borough To Issue General Obligation School Bonds In The Principal Amount Not To Exceed $600,000 To Provide Funds For School And Related Capital Improvements In The Borough And To Pay Costs Of Issuing The Bonds, Fixing Certain Details Of Such Bonds, Authorizing Their Sale, and Providing For Related Matters. SYMMONS moved to adopt Resolution No. FY2019-13. On October 6, 2009, Kodiak Island Borough voters approved the sale of $76,310,000 in general obligation bonds for the expansion and renovation of the Kodiak High School Facility. This resolution approves the sale and sets certain details of these bonds. This is the sixth sale of the bonds related to the project, the previous four sales add up to $65,000,000 and there is $9,310,000 remaining unissued at this time. This bond issue is reimbursable by the State of Alaska at 70%. ROLL CALL VOTE ON MOTION CARRIED UNANIMOUSLY: Smiley, Symmons, Turner, Kavanaugh, Schroeder, and Skinner. Administration of Oath to Newly Appointed Assembly member. The Clerk was directed to administer the oath of office to newly appointed Assembly member Arndt at a later date.
