Highlights of the Past Week
I met with the field representative from the US Census. The amount of federal funding Alaska receives is
over $2B annually, much of which is dependent upon population. The primary purpose of the visit was
to discuss the Complete Count Committee that each jurisdiction is encouraged to form. Based upon
past experience, the County/Borough Manager generally forms a committee of business and local
government leaders who help promote the mission of obtaining an accurate census. The vast majority
go in with paychecks, utility bills, etc. I intend to form a small committee to assist the Census.
Working with staff on
Deputy Clerk and retention issues related to the same. Reviewed salary schedule, decision and
responsibility issues. Reviewing and compiling exit interview and former staff comments. Reviewed
Personnel Manual regarding temporary duty pay as well as training reimbursement policy.

Worked with staff to ensure we physically monitored the Tsunami Sirens the Borough maintains. All
sirens tested during the weekly test, the Three Sisters Siren did not function. The Carroll Way siren
sounded briefly but then shut down. Staff is working on repairs to the two sirens.
Worked with the Borough Attorney on various issues including conflict of interest, Mission Tidegate,
Revenue limit initiative and personnel matters.
Discussed tree damage to home with staff and AMLJIA, authorized removal of damaged and potentially
hazardous trees from borough land and policy to identify and remediate potentially hazardous trees.
I met with the City Manager and discussed the SWAMC CEDS and Emergency Management. Regarding
SWAMC, we discuss
discussed training needs for Borough and City Staff, the after-action report and meeting and additional
policy and procedures that we need to put in place plus some information gathering to be done with
critical third parties.
Worked on several personnel issues including recruitment for Assessing and Community Development.
Met with Business Representative from IBEW to discuss upcoming negotiations, an extension of a
temporary laborer (E&F), future vacancies, and miscellaneous housekeeping issues related to payroll
reporting.

Future Updates
It is important to note that a Comprehensive Plan is only useful if it is current. Therefore, regular
review of this document is necessary to preserve the spirit and intent of the goals included in the
Plan. To ensure that the Plan continues to be a useful, current document until the next major
update is undertaken, periodic minor updates are recommended. It is recommended that
selected portions of the document be updated every two to three years, including the following
types of information:
AGENDA ITEM #13.C.3.
New ordinances. To the extent that new ordinances are adopted by the Borough that
significantly affect the contents of the plan, a brief description of them should be included
in the appropriate section of the Plan.
Planning documents or efforts. Results of major planning efforts should be incorporated
in new or revised sections of the Plan.
Changes in Borough structure or organization. Creation of new service areas,
departments, or functions should be identified in an update to the Local Government
chapter and other affected sections.
Significant policy decisions. Major policy initiatives adopted by the Borough Assembly

The liquor process is similar but there are notable differences. Apparently a practice of providing a
courtesy copy of the application to a borough when the city was within a borough was established
long before my time. The ABC board is very experienced and has been issuing liquor licenses for a
long, long time. When a borough sends a “protest” even though it has no right of protest under Title
4, the ABC board knows what to do with it (it has no legal effect), and the applicant knows that the
borough has no right of protest.

BAYSIDE FIRE DEPARTMENT BOILER REPLACEMENT
Projects Office staff is assisting Bayside Fire Department with replacing the existing boiler in the older
portion of the facility. Staff issued a Request for Proposals to five local mechanical contractors on
September 13, 2018, and responses were due on September 25, 2018. Three responses were received,
and a contract was issued to Larry’s Plumbing and Heating as the low bidder. The boiler installation
began on November 8, 2018, and was completed by November 15, 2018.
CHINIAK TSUNAMI SHELTER AND LIBRARY
Construction is in progress for the replacement of the Chiniak Tsunami Shelter and Library that was
destroyed in the 2015 Twin Creeks fire. The design is for a single-story building with a kitchen area,
restroom, shower room, and a large open space for community meetings or providing shelter. Friend
Contractors LLC is the contractor and began work at the end of July 2018. As of November 30, 2018,
interior finishes (painting, cabinets, flooring, etc.) were approximately 80% complete. Installation of
exterior access ramps and stairs is approximately 50% complete. The new well house has been framed
and dried in, and installation of well house equipment has begun. The project is currently scheduled to
be completed by December 15, 2018.

KODIAK FISHERIES RESEARCH CENTER & KODIAK HIGH SCHOOL ELECTRIC BOILERS
On September 6, 2018, the Assembly approved joint agreements with Kodiak Electric Association (KEA)
and Kodiak Island Borough School District (KIBSD) for interruptible electric service at Kodiak Fisheries
Research Center and Kodiak High School. As part of the agreements KEA will reimburse KIB for the costs
to install electric boilers at both buildings, and offer a reduced rate for the power to operate the boilers
at 90% the cost of fuel oil. KIB has contracted with RSA Engineers (RSA) to provide design and bid

AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH CALLING FOR
A SPECIAL BY -MAIL ELECTION TO SUBMIT TO THE QUALIFIED VOTERS THE QUESTION
OF ABOLISHING THE MISSION LAKE TIDEGATE SERVICE AREA
WHEREAS, Ordinance 2002-02 established the Mission Lake Tidegate Service Area to provide
construction, operation and maintenance of the Mission Lake tidegate; and
WHEREAS, a special by -mail election was held on May 13, 2002 and the establishment of the
Mission Lake Tidegate Service Area was submitted to the voters; and
WHEREAS, on October 31, 2018, a petition to abolish the Mission Lake Tidegate Service Area
was submitted to the Clerk's office and it was found to be in conformity with Kodiak Island Borough
Code of Ordinances (KIBC) 4.05.020 and KIBC 4.05.030(A); and
WHEREAS, the Mission Lake tidegate is located on an easement across property owned by
the Spruce Haven Lot Owner's Association, and is owned by the Mission Lake Tidegate Service
Area; and
WHEREAS, the Mission Lake tidegate easement is accessible from Spruce Haven Lane, a
private road, but is not readily accessible from a public roadway; and
WHEREAS, the Kodiak Island Borough lacks authority to accept ownership and maintenance
of the Mission Lake tidegate except by adoption of a new power or a determination that it is in the
public interest to do so as the exercise of an existing power; and
WHEREAS, the Assembly finds that in order to dissolve the Mission Lake Service Area in an
orderly manner there must be a plan for future ownership and operation of the tidegate and for
satisfaction of any Service Area liabilities and distribution of Service Area assets, including
disposition of the Service Area fund balance; and
WHEREAS, the Assembly finds that it is in the public interest that the Service Area Board have
the opportunity to have input on the proposed disposition of Service Area assets, and that the
voters deciding whether to dissolve the Service Area have information as to the plan for
disposition of Service Area assets and liabilities and future operation of the tidegate; and
WHEREAS, the Assembly finds that assumption of Service Area assets and liabilities as an
areawide function of the Borough is not supported by any existing Borough areawide power; and

WHEREAS, KIBC 4.05.050 provides that the assembly shall initiate any action to alter a service
area by introducing an ordinance effecting the proposed actions; and
WHEREAS, KIBC 4.05.060 provides that an ordinance abolishing a service area shall not be
effective unless approved by a majority of the qualified voters voting on the question in each area
affected by the ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: Classification. Section 8 of this ordinance is of a general and permanent nature
and shall become a part of the Code of Ordinances of the Kodiak Island Borough.
The remainder shall not be codified.
Section 2: Election. Upon the adoption of this ordinance, a special by -mail election shall be
held within the area shown on the map attached hereto, to place before the
registered voters residing within said proposed service area the following question:
"Shall the Kodiak Island Borough abolish the Mission Lake Service Area as
provided in Ordinance FY2019-12?"

Section 3: Qualifications. A person is qualified to receive an election pamphlet and ballot if
their voter registration address is within the Mission Lake Tidegate Service Area
indicated on the attached map.
Section 4: Election Date. The election date specified in Kodiak Island Borough Code of
Ordinances section 7.70.020 shall be set by the Clerk within 45 days of adoption
of a resolution designating the disposition of the tidegate and other Mission Lake
Tidegate Service Area assets.
Section 5: Notice. Notice of the special election shall be published not less than twenty days
prior to the election in the form and manner specified in the Kodiak Island Borough
Code of Ordinances section 7.10.060.
Section 6: Mailing of Ballots. The clerk shall mail ballots and pamphlets to the qualified voters
as specified in KIBC 7.70.010c on or before the 22nd day before the election.
Section 7: Abolishment of Service area. The Mission Lake Tidegate Service Area shall be
abolished, all Service Area liabilities shall be paid, and the tidegate shall be
transferred and any remaining assets shall be distributed as provided in a
resolution approved by the Assembly after allowing recommendations from the
Service Area Board.

Section 8: Title 4 of the Kodiak Island Borough Code of Ordinances is amended by deleting
Chapter 4.130.
Section 9: Effective Date. Sections 1 through 6 shall become effective at midnight on the day
of adoption of this ordinance. Sections 7 and 8 shall become effective on the first
day of the fiscal year following certification of the special by -mail election, if a
majority of those qualified voters cast their ballots in favor of abolishing the Mission
Lake Tidegate Service Area.

AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH CALLING FOR
A SPECIAL BY -MAIL ELECTION TO SUBMIT TO THE QUALIFIED VOTERS THE QUESTION
OF ABOLISHING THE MISSION LAKE TIDEGATE SERVICE AREA
WHEREAS, Ordinance 2002-02 established the Mission Lake Tidegate Service Area to provide
construction, operation and maintenance of the Mission Lake tidegate; and
WHEREAS, a special by -mail election was held on May 13, 2002 and the establishment of the
Mission Lake Tidegate Service Area was submitted to the voters; and
WHEREAS, on October 31, 2018, a petition to abolish the Mission Lake Tidegate Service Area
was submitted to the Clerk's office and it was found to be in conformity with Kodiak Island Borough
Code of Ordinances (KIBC) 4.05.020 and KIBC 4.05.030(A); and
WHEREAS, the Mission Lake tidegate is located on an easement across property owned by
the Spruce Haven Lot Owner's Association, and is owned by the Mission Lake Tidegate Service
Area; and
WHEREAS, the Mission Lake tidegate easement is accessible from Spruce Haven Lane, a
private road, but is not readily accessible from a public roadway; and
WHEREAS, the Kodiak Island Borough lacks authority to accept ownership and maintenance
of the Mission Lake tidegate except by adoption of a new power or a determination that it is in the
public interest to do so as the exercise of an existing power; and
WHEREAS, the voters of the Kodiak Island Borough adopted non-areawide Recreational
Facilities powers approving the proposition placed before the voters by Resolution 76-45-R; and
WHEREAS, the Assembly finds that the general public frequently makes recreational use of
Mission Lake, and therefore finds that acquisition of the Mission Lake tidegate and maintenance
of that tidegate is an appropriate exercise of its non-areawide Recreational Facilities powers; and
WHEREAS, the Assembly finds that it is in the public interest for the Borough to accept the
Mission Lake tidegate on the following conditions: 1) that acceptance of the tidegate is conditioned
on the Borough receiving legal road access to the tidegate and an easement for tidegate
construction, reconstruction, repair and maintenance; 2) the Borough is not obligated to continue
maintenance of the tidegate, and future maintenance repair or reconstruction will be at the

Borough accepts ownership of the tidegate, the remaining fund balance in the Service Area will
be transferred to the non-areawide fund for repair and replacement of the tidegate as needed;
and
WHEREAS, KIBC 4.05.050 provides that the assembly shall initiate any action to alter a service

Area fund balance, and legal road access to the tidegate, shall be transferred to
the Kodiak Island Borough as assets associated with exercise of its non-areawide
Recreational Facilities powers; and
Section 8: Title 4 of the Kodiak Island Borough Code of Ordinances is amended by deleting
Chapter 4.130.
Section 9: Effective Date. Sections 1 through 6 shall become effective at midnight on the day
of adoption of this ordinance. Sections 7 and 8 shall become effective on the first
day of the fiscal year following the last to occur of 1) certification of the special by -
mail election, if a majority of those qualified voters cast their ballots in favor of
abolishing the Mission Lake Tidegate Service Area, and 2) execution of
documents, in a form acceptable to the Borough Manager, conveying easements
or other rights of access to the Kodiak Island Borough to construct, reconstruct,
repair and maintain the Mission Lake tidegate.
