KODIAK ISLAND BOROUGH STAFF REPORT C" JUNE 14, 2018 ,._ ASSEMBLY WORK SESSION { 1 , SUBJECT: Accessory Dwelling Unit and Residential Small Lot Update ORIGINATOR: Sara Mason RECOMMENDATION: N/A -- Presentation Item DISCUSSION: At the Assembly Regular Meeting on March 21, 2018, public testimony was received about the hurdles currently being experienced by community members wishing to utilize the provisions of the recently adopted Accessory Dwelling Unit (ADU) and Residential Small Lot (RSL) ordinances. In response, staff was asked by the Borough Manager to place an item on a Work Session agenda to provide the Assembly with pertinent information. ADUs Since the ADU ordinance was passed, no ADUs have been permitted. The 3 most common reasons for this are: - The 480 square foot size limitation; - The prohibition of ADUs in the R3 -Multi -Family Residential zoning district; and - The prohibition of the development of an ADU within an existing accessory structure that is nonconforming with regards to setbacks. The prohibition of ADUs in the R3 zoning district and the size limitation have been overcome, in some cases, by the approval of a recent Similar Use Determination by the Planning & Zoning Commission, which determined that in any residential district where they are allowed, two detached single-family dwellings are similar to one attached two-family dwelling. A variance from some provisions of the ADU ordinance may be obtained from the Planning & Zoning Commission, but no potential applicants have opted to go that route at this time. RSLs Since the RSL ordinance was passed, no applications for the rezone/subdivision of parcels into RSL lots have been received. Two interested parties have inquired about the process, but have opted not to pursue the RSL option at this time. The two reasons for this are: - The 1.5 acre parent parcel size requirement; and - The minimum lot requirement of 10 lots. Interested parties may obtain a variance from these requirements from the Planning & Zoning Commission, but to -date no one has chosen to do this. Manager's Report Michael Powers June 14, 2018 • Conducted interviews for Assessor -offered position. • Approved background check for E&F Director. Phillip Kovacs will start on July 2, 2018. • Met with St. Mary's Thrift store and staff regarding dumping. Observed first hand on June 9, 2018. • Continued to work on ICS training. • Talked with several residents on various issues including off-road vehicles and trails, land use (in and outside of the City limits) and fireworks. • Followed up with staff and attorney regarding Alaska Aerospace. • Met with City regarding various contracts, opportunities for additional shared services, dispatch and GIS support. • Discussed various economic development issues with KANA. • Discussed and directed staff to begin a GAP analysis. • Discussed and directed staff to begin work on a surplus sale.
