04/05/2018 Regular MeetingKODIAK ISLAND BOROUGH Assembly Regular Meeting April 5, 2018 A regular meeting of the Kodiak Island Borough Assembly was held on April 5, 2018, in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 6:30 p.m. The invocation was given by Major Dave Davis of the Salvation Army. Mayor Rohrer led the Pledge of Allegiance. Present were Mayor Dan Rohrer, Assembly members Julie Kavanaugh, Andrew Schroeder, Rebecca Skinner, Scott Smiley, and Dennis Symmons. Also present were Borough Manager Michael Powers, Borough Clerk Nova Javier, and Deputy Clerk Laurie. KAVANAUGH moved to excuse Assembly member Crow and Van Daele who were absent due to personal leave. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF AGENDA AND CONSENT AGENDA SCHROEDER moved to approve the agenda and consent agenda. SCHROEDER moved to amend the agenda by adding "A Letter Of Support To Kodiak Area Native Association's Application ForThe FY2018 Partnership Planning Funding From the United States Economic Development Administration" under other items on the agenda. ROLL CALL VOTE ON MOTION TO AMEND CARRIED UNANIMOUSLY: Kavanaugh, Schroeder, Skinner, Smiley, and Symmons. VOICE VOTE ON MOTION TO APPROVE AS AMENDED CARRIED UNANIMOUSLY. APPROVAL OF MINUTES The regular meeting minutes of March 1, 2018 and special meeting minutes of March 8, 2018 were approved under the consent agenda. Kodiak Island Borough Assembly Regular Meeting Minutes April 5, 2018 Page 1 of 6 AWARDS AND PRESENTATIONS Mayor Rohrer proclaimed the Month of April 2018 as the Month Of The Military Child and encouraged all Kodiak residents to show appreciation, support, and understanding to the military children in out community. The proclamation was accepted by Sena and Zane Rogers. Mayor Rohrer declared April 16-20, 2018 as Week of the Young child and encouraged all citizens to work to make a good investment in early childhood in Kodiak. The proclamation was accepted by Velma Vining, Child Development Services Specialist for USCG and Arwen Botz, Infant Learning Program Coordinator. Mayor Rohrer declared April 2018 as Sexual Assault Awareness Month and encouraged all residents to support local activates and programs, which assist victims, and to learn more about the pervasiveness to sexual assault in Alaska so that we may eliminate this heinous crime. The proclamation was accepted by Rebecca Shields, Executive Director of Kodiak Women's Resource and Crisis Center. Mayor Rohrer declared April 2018 as Child Abuse Prevention Month and called upon all citizens to increase their participation in efforts to prevent child abuse, thereby strengthening the communities in which we live. COMMITTEE REPORTS Assembly member Symmons reported regarding the recently held Parks and Recreation Committee meeting. PUBLIC HEARING 1. Ordinance No. FY2018-19 Amending KIBC 17.15 (General Provisions And Use Regulations), KIBC 17.215 (Review Of Planning And Zoning Commission Decision), KIBC 17.220 (Appeals To The Planning And Zoning Commission), And KIBC 17.225 (Appeals To The Board Of Adjustment), Making The Appeal Periods For Land Use Decisions And The Removal Of Effective Date Provisions For Variances Consistent With Ordinance No. FY2018-14. SMILEY moved to adopt Ordinance No. FY2018-19. The Borough Assembly adopted Ordinance No. FY2018-14 on February 1, 2018, which amended the appeal periods identified in KIBC 17.195 (Variances), KIBC 17.200 (Conditional Use Permits), and KIBC 17.205 (Amendments and Changes) to 20 days and removed the effective date provisions for variances. The Community Development Department wished to reflect these changes in KIBC 17.15 (General Provisions and Use Regulations), KIBC 17.215 (Review of Planning and Zoning Commission Decision), KIBC 17.220 (Appeals to the Planning and Zoning Commission), and KIBC 17.225 (Appeals to the Board of Adjustment) to provide consistency. Based on discussion at the March 8, 2018 Work Session, staff included in the Regular Meeting packet a Version 2 for Assembly consideration, which would change the period for filing a Kodiak Island Borough Assembly Regular Meeting Minutes April 5, 2018 Page 2 of 6 reconsideration with the Planning & Zoning Commission from 10 working days to 20 days, to be consistent with the administrative appeals processes. Mayor Rohrer opened the public hearing. Hearing and seeing none, Mayor Rohrer closed the public hearing. BOROUGH MANAGER'S REPORT Manager powers briefly reported on the following: • April is also National Foster Care Month • Presentation during the Rural Leadership Forum with Local Government Representative Jane Baer Staff was in contact with the Local Boundary Commission for a presentation in Kodiak Meeting with the Emergency Services Council and the review of the tsunami after action report MESSAGES FROM THE BOROUGH MAYOR Mayor Rohrer briefly reported on the following: • Change of request from the school district budget, School Superintendent and School Board President were available to answer questions • Memo update was provided regarding school district technology renewal and replacement UNFINISHED BUSINESS None. NEW BUSINESS Contracts 1. Contract No. FY2018-26 Household Hazardous Waste Disposal Contract. SKINNER moved to authorize the manager to execute Contract No. FY2018-26 Household Hazardous Waste Disposal with NRC Alaska LLC. Proposals were requested for the household hazardous waste collection event conducted during Kodiak's annual community Spring Clean -Up scheduled for the first weekend in May. Three responses were received; Clean Harbors Environmental Services, Inc., NRC Alaska, LLC, and Stericycle Environmental Solutions. These organizations are among a handful in the nation that have the necessary qualifications to conduct this type of work. The request for proposals included a cost proposal sheet. Evaluation of the costs consisted of comparing the three contractors cost proposals and the amounts and types of wastes a typical Kodiak event would generate. Staff also ran two other scenarios where they put one of every type of waste possibly collected on each contractors pricing and ran the renewal cost for contractor with the following years adjustments that were requested in the proposal. Staff found that the same contractor NRC Alaska, LL C came to the top in every scenario. This was a time and material contract with a not to exceed the budgeted amount of $40,000. Staff could only estimate how much waste they will collect on the cleanup day and what they will collect through the landfill within the year. All prices were set forth through the RFP from salaries, supplies needed and cost Kodiak Island Borough Assembly Regular Meeting Minutes April 5, 2018 Page 3 of 6 for each material to be either recycled or disposed of. The estimated cost from each contractor, on an annual basis if staff were to collect what was collected last year were as follows: Clean Harbors $38,315 Stericycle Environmental Solutions $34,576 NRC Alaska $29,164 The requested contract term is for four years with one five-year optional extension and is a unit price contract / Time and Material Contract. After careful review of the bids a selection of NRC Alaska LL C. was the more beneficial time and material contract for the Kodiak Island Borough. The Kodiak Island Borough Code 3.30.020 Limitation on Manager's Authority states that a contract exceeding $25,000 requires Assembly approval. Staff recommended the award of this contract to NRC Alaska LL C. Palmer, AK. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Schroeder, Skinner, Smiley, Symmons, and Kavanaugh. Resolutions Ordinances for Introduction 1. Ordinance No. FY2019-01 Levying Taxes On All Taxable Real And Personal Property Within The Kodiak Island Borough For All The Expenses And Liabilities Of The Kodiak Island Borough For The Fiscal Year Commencing On The First Day Of July 2018 And Ending On The Thirtieth Day Of June 2018 (Fiscal Year 2019 Budget). SKINNER moved to advance Ordinance No. FY2019-01 to public hearing at the next regular meeting of the Assembly. SKINNER moved to amend Ordinance No. FY2019-01, lines 41-45, to read: General Fund 1.10 mills Education Support 6.90 mills Debt Service 1.87 mills R&R .88 mills SKINNER move to postpone the amendment to the next meeting and also hold a public hearing at the next regular meeting. ROLL CALL VOTE ON THE MOTION TO POSTPONE CARRIED UNANIMOUSLY: Skinner, Symmons, Kavanaugh, and Schroeder (Ayes); Smiley (No). 2. Ordinance No. FY2018-21 Amending Title 3 Revenue And Finance, Chapter 3.35 Real Property Tax By Adding Section 3.35.045 Tax Adjustment On A Property Affected By A Disaster. SKINNER moved to advance Ordinance No. FY2018-21 to public hearing at the next regular meeting of the Assembly. The Ordinance would give the Assembly the ability to exercise its authority granted to it by AS29.45.230 to alleviate the effects of a disaster on property owners using the following requirements and method to qualify for the adjustment. Kodiak Island Borough Assembly Regular Meeting Minutes April 5, 2018 Page 4 of 6 Requirements: • Sworn statement of the taxpayer who has incurred losses in excess of $10,000 and only on losses in excess of $10,000 • Taxpayer must provide evidence of the loss estimate • Assessor or designee must inspect or investigate claim to determine the extent of the damage • Reduction is for one year only and can be used for the current or following year • If repairs exceed Assessor's value of the improvement the reduction will be based on the Assessor's value • If damage occurs after June 30, and is more than 50%, reduction will be prorated by the percentage of the remaining year Method shall be the estimated cost to repair the improvement. The Assembly requested definition clarification on disasters. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Smiley, Symmons, Kavanaugh, Schroeder, and Skinner. Other Items 1. Confirmation Of A Mayoral Appointment to the City Seat On The Planning and Zoning Commission (Mr. James E. Scholz). SKINNER moved to confirm the mayoral appointment of Mr. James Scholz to the Planning and Zoning Commission City seat for a term to expire December 2020. There was one vacancy on the Planning and Zoning Commission that was designated as a city seat. On March 23, 2018, the Clerks office received a letter addressed to Mayor Rohrer from the City of Kodiak Council recommending the appointment of Mr. James Scholz to the vacant city seat. ROLL CALL MOTE ON THE MOTION CARRIED UNANIMOUSLY: Symmons, Kavanaugh, Schroeder, Skinner, and Smiley. 2. A Letter Of Support To Kodiak Area Native Association's Application For The FY2018 Partnership Planning Funding From the United States Economic Development Administration. SYMMONS moved to approve a letter of support to Kodiak Area Native Association's application for funding. SKINNER strike out those two last sentences. This item was added when the Assembly voted to amend the agenda. The Native Village of Afognak and Port Lions. Last year, they did not get funding. VOICE VOTE ON MOTION TO AMEND CARRIED UNANIMOUSLY. Mike Milligan commented regarding the Shuyak Facilities Fund and consolidation. Jeff Stewart spoke regarding the budget. Mel Stephens commented regarding the benefits of having the budget early for discussion and also spoke regarding the preservation of the Shuyak Facilities Fund. ASSEMBLY MEMBERS'COMMENTS Assembly member Skinner reminded the Assembly regarding the evaluation period for the Clerk and Manager. Assembly member Kavanaugh announced the Rural Forum, proposals for the Board of Fish, Board of Game, Kodiak Rodeo and State Fair Meeting at the Fairgrounds. She reminded everyone about the junk car lottery and commented that to reduce hours of borough staff would require renegotiations with IBEW. Assembly member Symmons encouraged the public to call him. Assembly member Smiley commented where Kodiak is when it comes to percentage of income and also on taxes. Assembly member Schroeder noted that the Assembly should look for every opportunity to fund needs, mentioning that Shuyak funds are perfectly appropriate place to look to meet obligations. Announcements Mayor Rohrer announced that the next Assembly work session was scheduled on Thursday, April 12, 2018 at 6:30 p.m. in the School District Conference Room. The next regular meeting was scheduled on Thursday, April 19, 2018 at 6:30 p.m. in the Borough Assembly Chambers. ADJOURNMENT SYMMONS moved to adjourn the meeting.
