Hi Sara,
When it comes to commercial structures the exemption reads: One-story detached accessory structures used as tool
and storage sheds, playhouses and similar uses, provided the floor area is not greater than 120 square feet. So I don't think
this would apply to a marijuana establishment doing retail sales and a building permit would be required.
Yes, if the separation is at least 20' between buildings no fire resistance rating is required for exterior walls,
generally.
The review could be for more than just the new structure if they were changing the occupancy of the existing
structure.

Good morning, Ted.
A few days ago I stopped by and asked a few questions of Paul, but I just wanted to get your take as well before I passed any word
along to the public. The questions are in reference to the construction of a building for use as a marijuana retail establishment.
1. Do all commercial structures need a building permit, or only those larger than 120/200 square feet?
2. If the new structure is located on a parcel that has an existing structure, but is located far enough away from the existing
structure, there will be no requirement for firewall installation (or other modifications) to the existing structure, correct? It is
anticipated that the new structure will be approximately 100 feet from the existing structure.
3. In terms of the Building Official and Fire Marshal reviews of the State of Alaska licensing application for this proposed retail
marijuana facility (yet to be filed), is the review limited only to the new structure?
We've got a business owner in the Flats who is considering constructing a >200 sf building on a B -Business zoned lot for the purposes
of renting space to a retail marijuana outfit. But, they don't want to move forward until they understand the ins and outs, and if there's
going to be any impact—from a regulatory perspective—on their existing business/building.
