RESOLUTION NO. FY2018-33
A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH TO DISPOSE BY
LEASE LOT 3A, BLOCK 5, MILLER POINT SUBDIVISION TO FIRE PROTECTION AREA
NUMBER ONE (P & Z CASE NO. 17- 022)
WHEREAS, the Kodiak Island Borough Resource Management Department has requested
disposal by lease of Lot 3A, Block 5, Miller Point Subdivision; and
WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.030 requires each proposed disposal
of Borough land by lease to be reviewed by the Planning & Zoning Commission before submission
to the Assembly; and
WHEREAS, the Planning & Zoning Commission is required under KIBC 18.20.030 to make a
recommendation to the Assembly by resolution regarding the proposed land disposal by lease;
and
WHEREAS, the principal purpose of the Planning & Zoning Commission review is to consider
if the identified land will be to the benefit of the public if disposed of by lease to Fire Protection
Area Number One (1); and
WHEREAS, the parcel identified for disposal has been in use as a fire department for several
decades; and
WHEREAS, the Planning & Zoning Commission held public hearings on April 19, 2017, July
19, 2017, and March 21, 2018 to consider this land disposal request; and
WHEREAS, the Planning & Zoning Commission has found that, following review, it would be to
the benefit of the public to dispose of the identified parcel by lease to Fire Protection Area Number
One (1).
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that
Section 1: The Kodiak Island Borough Assembly, in accordance with Title 18 of the Kodiak
Island Borough Code, approves disposal by lease of Lot 3A, Block 5, Miller Point
Subdivision.
Section 2: The Kodiak Island Borough Planning & Zoning Commission, in accordance with
Title 18 of the Kodiak Island Borough Code, has determined, after a public hearing

on March 21, 2018, that disposal by lease of the aforementioned property would
be to the benefit of the public.
Section 3: The aforementioned property shall be disposed of by lease to Fire Protection Area
Number One.
