03/01/2018 Regular MeetingKODIAK ISLAND BOROUGH Assembly Regular Meeting March 1, 2018 A regular meeting of the Kodiak Island Borough Assembly was held on March 1, 2018, in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 6:30 p.m. The invocation was given by Sergeant Major Dave Blacketer of the Salvation Army. Mayor Rohrer led the Pledge of Allegiance. Present were Mayor Dan Rohrer, Assembly members Kyle Crow, Julie Kavanaugh, Andrew Schroeder, Scott Smiley, and Matthew Van Daele. Also present were Administrative Official Bill Roberts, Borough Clerk Nova Javier, and Deputy Clerk Laurie Pardoe. VAN DAELE moved to excuse Assembly members Skinner and Symmons who were absent due to attendance of the Southwest Alaska Municipal Conference. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF AGENDA SCHROEDER moved to approve the agenda. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF MINUTES None. CITIZENS' COMMENTS Judi Kidder expressed concern regarding trees on borough properties falling on private properties. She suggested that it would be beneficial if the borough sent someone to examine damage along the property lines and put a procedure in place for responding to these type of situations quickly. Taten Shariden, Alen Fugleberg, Hunter Blair, Barb Brown, Robyn Callahan, Nancy Castro, and Thia Falcone asked the Assembly to maintain current funding level in support of Kodiak College. Patrick O'Donnell encouraged the Assembly to act in a way to protect Kodiak's pollock industry. Jeff Stewart spoke concerning recent conflict of interest issues that have occurred during Assembly meetings. AWARDS AND PRESENTATIONS Mayor Rohrer presented the Women's History Month and Choose Respect Proclamations to the Kodiak Women's Resource and Crisis Center (KWRCC). BOROUGH MANAGER'S REPORT Administrative Official Roberts announced that tax assessments were mailed and invited anyone who would like to appeal their property assessment to visit the Assessor's office to discuss possible adjustments. MESSAGES FROM THE BOROUGH MAYOR Mayor Rohrer announced that there would be an Assembly special budget work session held on Tuesday, March 6, 2018 in the Borough Conference room. UNFINISHED BUSINESS None. NEW BUSINESS Contracts None. Resolutions 1. Resolution No. FY2018-24 Authorizing The Parks And Recreation Committee To Move Forward With An Update To The Kodiak Island Borough Comprehensive Parks And Recreation Plan That Was Adopted January 9, 1981 (P&Z Case No. 18-012). SMILEY moved to adopt Resolution No. FY2018-24. The existing Comprehensive Parks & Recreation Plan was adopted in 1981 and needed to be updated. This resolution of the Borough Assembly authorized the Parks and Recreation Committee to move forward with an update to the Kodiak Island Borough Comprehensive Parks and Recreation Plan that was adopted January 9, 1981 (P&Z Case No. 18-012). At the public hearing on January 24, 2018, the Planning & Zoning Commission voted unanimously to forward the resolution to the Assembly with a recommendation for approval. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Crow, Kavanaugh, Schroeder, Smiley, and Van Daele. 2. Resolution No. FY2018-29 Joint Borough and City of Kodiak Resolution Urging the Governor of the State of Alaska To Declare A Disaster and To Request the Secretary of Commerce To Declare a Commercial Fishery Failure and a Disaster for the 2018 Gulf of Alaska Pacific Cod Fishery. CROW moved to adopt Resolution No. FY2018-29. Kodiak Island Borough Assembly Regular Meeting Minutes March 1, 2018 Page 2 of 5 At the last KFWG meeting, Representative Stutes requested that both the City and Borough adopt a resolution urging the Governor of the State of Alaska to declare a disaster and to request the Secretary of Commerce to declare a commercial fishery failure and a disaster for the 2018 Gulf of Alaska Pacific Cod Fishery. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Kavanaugh, Schroeder, Smiley, Van Daele, and Crow. Ordinances for Introduction 1. Ordinance No. FY2018-17 Amending Various Sections Of Title 17 To Provide For Additional Regulation Of Communications Towers (P&Z Case No. 18-011). VAN DAELE moved to advance Ordinance No. FY2018-17 to public hearing at the next regular meeting of the Assembly. Usage of mobile devices and personal electronics had expanded considerably in the past several years with a corresponding increase in the need for new and expanded types of telecommunications infrastructure. The Kodiak Island Borough lacked language in its zoning code to regulate this infrastructure. This ordinance created regulations and processes for the land use - related permitting of these towers. Community Development Department staff held one public meeting and the Planning & Zoning Commission held 8 work sessions and one public hearing. At the public hearing on January 24, 2018, the Commission voted unanimously to forward the ordinance to the Assembly for review approval. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Schroeder, Smiley, Van Daele, Crow, and Kavanaugh. 2. Ordinance No. FY2018-18 Amending KIBC Title 2 Administration And Personnel, Chapter 2.20 Borough Mayor, Section 2.20.070 Miscellaneous And Chapter 2.30 Rules Of The Assembly, Section 30.100 Miscellaneous To Revise The Mayor And Assembly Member Insurance Benefits VAN DAELE moved to advance Ordinance No. FY2018-18 to public hearing at the next regular meeting of the Assembly. Borough code reflected that the Borough Mayor and Assembly members may be included in the Borough health and life insurance plan. The Mayor and Assembly had not received coverage under the Borough health and life insurance plan for many years. At that time, under the Kodiak Island Borough's special agreement with the Alaska Electrical Trust Fund (AETF), medical insurance benefits only extended to its full-time employees defined as those working 120 hours or more per month. Ordinance No. FY2018-18 was intended to correct borough code to reflect the most recent agreement. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Smiley, Van Daele, Crow, Kavanaugh, and Schroeder. VAN DAELE moved that the Peterson Roof Replacement Project be forwarded to the State for consideration should a capital budget opportunity arise. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Van Daele, Crow, Kavanaugh, Schroeder, and Smiley. 2. National Weather Service Letter SMILEY moved to authorize the Mayor to send a letter to the congressional delegation regarding continued cuts to the National Weather Service resulting in closure of the Weather Service Office in Kodiak. ROLL CALL VOTE ON THE MOTION CARRIED UNANIMOUSLY: Crow, Kavanaugh, Schroeder, Smiley, and Van Daele. CITIZENS' COMMENTS Judi Kidder spoke concerning the special weather circumstances in Kodiak and the necessity of advocating for local forecasting. Joseph Griskowis spoke concerning the National Weather Service issues in Kodiak. Cindy Trussell spoke in support of the National Weather Service letter, promoted the domestic violence training available at Kodiak College, and asked for continued funding for Kodiak College. Jeff Stewart noted some benefits that the community receives from Kodiak College. ASSEMBLY MEMBERS'COMMENTS Assembly member Schroeder noted that he was disappointed that there are already difficulties with the Conflict of Interest definitions and noted that section needs more work. He reported on the meeting he attended regarding the Killarney Hills master plan. Assembly member Smiley briefly reported on the Alaska Municipal League meeting that he attended in Juneau. Assembly member Van Daele commended the efforts of the Kodiak Electric Association (KEA), Department of Transportation (DOT) and Kodiak's first responders for their work repairing the damage from the windstorm on Monday. Assembly member Kavanaugh also recognized the efforts of KEA, DOT, and first responders. She encouraged citizens to apply for vacant seats on various committees and stressed the necessity of filling them quickly. Announcements Mayor Rohrer announced that the Assembly would hold a special work session on March 06, 2018 in the borough conference room. The next Assembly work session was scheduled on Thursday, March 8, 2018 at 6:30 p.m. followed by a special meeting at 9:30 p.m. in the School District conference room. The City Council and Borough Assembly would hold a Joint Work Session on March 21, 2018 at 7:30 p.m. in the School District conference room. Mayor Rohrer also reminded everyone that there was no Assembly meeting scheduled on March 15th. The next regular meeting was scheduled for Thursday, March 22, 2018 at 6:30 p.m. in the School District Conference Room. ADJOURNMENT SMILEY moved to adjourn the meeting.
