FY2018-27 A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH DISPOSING OF A PORTION OF LOT 5A -1B, U.S. SURVEY 2538A, BY LEASE, FOR THE SPECIFIC PURPOSE OF PROVIDING MENTAL HEALTH SERVICES TO THE KODIAK COMMUNITY (P&Z CASE NO. 18-013) WHEREAS, the Kodiak Island Borough Manager's Office has requested disposal, by lease, of a portion of Lot 5A -1B, U.S. Survey 2538A for the specific purpose of providing mental health services to the Kodiak Community; and WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.030 requires that each proposed disposal of Borough land be reviewed by the Planning & Zoning Commission before submission to the Assembly; and WHEREAS, KIBC 18.20.030 also requires that the Planning & Zoning Commission make a recommendation to the Assembly by resolution regarding proposed land disposals; and WHEREAS, the principal purpose of the Planning & Zoning Commission review of a disposal by lease is to consider if the identified land will be used in a manner that will be of benefit to the public; and WHEREAS, the land identified for disposal has been leased for the specific purpose of providing essential mental health services to the Kodiak community for more than 20 years; and WHEREAS, the ability to provide those crucial services within the Borough for the past two decades has been a fundamental element in maintaining the community's wellbeing; and WHEREAS, the disposal will facilitate the continued provision of those crucial services, thus sustaining the public benefit that has been gained by their long-established availability in the community; and WHEREAS, the disposal is consistent with, and will allow for the continued implementation of, certain land use and public facilities & services goals, policies, and implementation actions listed in the adopted Comprehensive Plan; and WHEREAS, for those reasons, the Planning & Zoning Commission determined that disposal of the identified land by lease would be of benefit to the public; and WHEREAS, the Planning & Zoning Commission held a public hearing on January 24, 2018 to consider this land disposal request; and Kodiak Island Borough, Alaska Resolution No. FY2018-27 Page 1 of 2 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 WHEREAS, following that public hearing, the Planning and Zoning Commission voted to adopt KIB Planning and Zoning Commission Resolution No. FY2018-05 recommending that the disposal, by lease, be approved; and WHEREAS, at their regular meeting on March 22, 2018, the Kodiak Island Borough Assembly reviewed and accepted the Planning and Zoning Commission's recommendation to approve the disposal by lease. NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: The Kodiak Island Borough Assembly, in accordance with Title 18 of the Kodiak Island Borough Code, approves the disposal, by lease, of a portion of Lot 5A -1B, U.S. Survey 2538A for the specific purpose of providing mental health services to the Kodiak community. Section 2: The Kodiak Island Borough Planning & Zoning Commission, in accordance with Title 18 of the Kodiak Island Borough Code, has determined, after a public hearing on January 24, 2018, that disposal by lease of the aforementioned property for the specified purpose would be to the benefit of the public. Section 3: The Kodiak Island Borough Assembly authorizes the Borough Manager to negotiate a lease of the aforementioned property to an entity that is licensed to provide mental health services in the state of Alaska. Said lease shall be for the specific purpose of providing such services to the Kodiak community. ADOPTED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THIS TWENTY SECOND DAY OF MARCH, 2018.
