KODIAK ISLAND BOROUGH STAFF REPORT JANUARY 4, 2018 ,s ASSEMBLY REGULAR MEETING l% SUBJECT: Mayoral Appointments Of Assembly Member Representatives To Different Boards, Committees, Commissions, And Councils; and Assembly Representatives To The Different Cities, Communities, and Villages (With The Exemption Of The Lands Committee). ORIGINATOR: Laurie Pardoe RECOMMENDATION: Move to confirm the mayoral appointments of assembly member representatives to different Boards, Committees, Commissions, Cities and Villages as reflected to the attached list. DISCUSSION: At the last regular meeting of December 28, 2017, the Assembly divided the motion and separated the appointments to the Lands Committee and that motion to appoint Assembly member Van Daele and Assembly member Kavanaugh failed. The Assembly also decided to postpone the rest of the appointments to the January 4th meeting. A REVISED list will be attached as soon as it becomes available. The Lands Committee appointments were excluded and separated from this item and will be dealt with later on the agenda under other items. ALTERNATIVES: FISCAL IMPACT: OTHER INFORMATION: Appointments. Members of boards, committees, and commissions, except for members of the board of adjustment, members of the board of equalization, and elected service area board members, are appointed by the mayor and confirmed by the assembly unless otherwise specifically provided elsewhere in this code. An appointment not confirmed by the assembly shall not become effective. The mayor shall appoint a new applicant until an appointment is confirmed by the assembly. The mayor may not appoint again the same person whose confirmation was failed by the assembly for the same board, committee, or commission until the next annual appointment process unless authorized by the assembly. Applications must be submitted annually by municipalities to receive an allocation from the program. This year the deadline is February 15, 2018. This resolution will allow the Kodiak Island Borough to submit its application for the FY2018 Shared Fisheries Business Tax Program using an alternative method. The resolution indicating approval of the application is a required portion of the application. The FY2018 Shared Fisheries Business Tax allocation will be based on the population of each of the cities within the Borough, and the Borough's allocation will be based on the total population of the Borough, less the population of each of the cities (Ahkiok, Kodiak, Larsen Bay, Old Harbor, Ouzinkie and Port Lions.) Last year, the Kodiak Island Borough received $60,422.12 as their share. The total allocation to the Kodiak area FMA for FY2017 was $246,159. For FY2018, the Kodiak Island Borough is estimated to receive $80,515.51 as its share and the total allocation to the Kodiak FMA is estimated at $252,914.79. This is proposed under consent agenda since this is a routine and annual item. ALTERNATIVES: 1. General Guidelines for Developing an Alternative Allocation Method All municipalities in a fisheries management area must agree on the alternative method: There must be unanimous agreement among all eligible municipalities in a fisheries management area with regard to alternative allocation methods. It is the responsibility of community leaders in the area to work together to negotiate an alternative which is acceptable to all municipalities. The department may be consulted at any time regarding what kinds of formula approaches are considered acceptable by the department. Alternative methods must incorporate some measure of the relative significant effects experienced by the respective municipalities in the area. The measure of significant effects may take many forms. One area might agree to use the number of commercial fishing boat visits -per -year per community as a measure of significant effects. Another area might use the linear foot -length ofpublic docks as a measure. Another area might use community population figures as an indication of the significant effects of fisheries business activity. Another area might share one half of the funding equally between the respective municipalities and share the other half based upon community population figures. Page 41 of 71 FY 18 SHARED FISHERIES BUSINESS TAX PROGRAM DESCRIPTION The purpose of the Shared Fisheries Business Tax Program is to provide for an annual sharing of fish tax collected outside municipal boundaries to municipalities that can demonstrate they suffered significant effects from fisheries business activities. This program is administered separately from the state fish tax sharing program administered by the Department of Revenue which shares fish tax revenues collected inside municipal boundaries. Program Eligibility To be eligible for an allocation under this program, applicants must: I. Be a municipality (city or borough); and 2. Demonstrate the municipality suffered significant effects as a result of fisheries business activity that occurred within its respective fisheries management area(s). Program Funding The funding available for the program this year is equal to half the amount of stale fisheries business tax revenues collected outside of municipal boundaries during calendar year 2016. Program funding is allocated in two stages: 1st Stage: Nineteen Fisheries Management Areas (FMAs) were established using existing commercial fishing area boundaries. The available funding is allocated among these 19 FMAs based on the pounds of fish and shellfish processed in the whole state during die 2016 calendar year. For example, if an area processed 10% of all the fish and shellfish processed in the whole state during 2016, then that area would receive 10% of the funding available for the program this year. These allocations are calculated based on Fisheries Business Tax Return information for calendar year 2016. 2nd Stage: The funding available within each FMA will be allocated among the municipalities in that area based on the level of fishing industry significant effects suffered by each municipality compared to the level of effects experienced by the other municipalities in that FMA. Some boroughs, because of their extensive area, are included in more than one fisheries management area. In these cases, the borough must submit a separate program application for each area. Page 42 of 71 FY 18 Shared Fisheries Business Tax Program Application Instructions ALTERNATE METHOD The Process • In the alternate method application process all municipalities in a fisheries management area may work together to develop an alternative allocation formula for distributing the available program funding among municipalities in the area. It is advised that the department be consulted during this process if the municipalities have questions or concerns about what constitutes an acceptable alternative to the standard allocation method. • All the municipalities in an area must reach an agreement in writing on an alternative allocation formula. • By January 15, the department must receive the proposed alternative method. If the alternative method is not acceptable, the department will work with the municipalities to resolve the problems. • If the municipalities in an area fail to satisfy the department regarding the acceptability of the alternative allocation method proposed, then each municipality in the region must return to the standard application process and submit separate applications as required by that process. • If the department finds the alternative allocation method satisfactory, each municipality must then complete an alternative method application consisting of a cover page and resolution. The resolution must be adopted by the governing body and it must clearly describe the approved alternative allocation method within that area. No later than April 15 Commerce reviews applications, makes a determination as to the validity of the submitted Impacts, and notifies the municipalities of this determination. Within 30 days Municipalities have 30 days in which to appeal Commerce's determinations regarding submitted impacts. Within 20 days Commerce will respond to appeals within 20 days after receiving them. r— After all appeals are resolved Commerce will perform the formula calculations for each FMA based on the relative impacts approved for each municipality in the FMA, and distribute the funding allocations. He combined positions and brought Chief Rue for firefighting, we moved Mayor Pat Bransen to elected official alternate, combined the Coast Guard reps and community health representatives, we have a primary and secondary for hospitals, community groups and public at large, It reduced the required voting members that have to be present, either the primary or their alternate, for a quorum from six to 10. We weren't going to have a quorum if he didn't jump on this right away. It had to be done because if we continued to not have a quorum we could have lost our grant. We have a new tent and interactive training aids. There will also be emergency management information. New Business a. SFY2017 13T .2ND , and 3`d Quarter LEPC Grant Reports Maker stated the grant reports are included in the packet. It talks about how much of the grant was there in Quarter 1, how much was used, and how much is still available. As you can see on the third quarter report, Item K Grant balance not reimbursed or encumbered is $8,367.99. We typically spend more than half the grant in the last quarter or last two quarters and that's due to the grant paying staff wages, travel, per diem, and hotel when attending the Emergency Preparedness Conference. We also paid for the vice chair to attend. Right now, we have about $2500 left on the grant. That will likely be taken up with staff hours for the outreach booth as well as the tier II right to know ad that is published in the newspaper. b. Revised DHS&EM LEPC Funding Classification Criteria Maker stated at the Fall Emergency Preparedness Conference, at the LEPCA meeting there was discussion about revamping the way they disperse LEPC funds. Over the years, the LEPC's have evolved into an all hazard type approach to outreach and preparedness. They are catching up with all the documentation to reflect that. c. Spring Emergency Preparedness Conference and LEPCA Meeting Brief Maker stated that Vice Chair Trosvig and he attended the Spring Emergency Preparedness Conference in Anchorage. A lot of it was focused on law enforcement and terrorist acts, active shooters, and those types of things. There was a lot of good information. They are reducing it to one annual conference instead of twice a year, two LEPCA meetings and two State Emergency Response Committee meetings a year. d. Western States Seismic Policy Council Earthquake and Tsunami Workshop Brief Maker stated the Department of Homeland Security held an earthquake and tsunami workshop in Anchorage May 9 — 11, 2017. Maker, the borough manager, and Tom Trosvig attended it. There was a lot of good information about the technical aspects of earthquakes. e. Alaska Division of Geological & Geophysical Surveys Draft Updated Kodiak Area Tsunami Inundation Maps CHAIR MULLICAN stated Homeland Security came to Kodiak to present the maps to the IMT Team. These maps are drastically different than out previous maps. In our previous training, if you are above 100 feet, you are OK. That is no longer true. Through advance computer dynamics and applying new applied sciences, they have reformatted how they predict the heights of tsunami's. These are draft maps, they haven't been formerly accepted yet. Services Council together so we can also accept the maps. Then we will begin to train the public of what to do when they hear a tsunami siren, when they see the waters go out, and that kind of thing. Creating uniformity in KIBC 17.195 (Variances), KIBC 17.200 (Conditional Use Permits), and KIBC 17.205 (Amendments and Changes) will ease administrative burdens for staff and will enable the public to more easily engage in land use actions. 4. Page 71 of 71 January 4, 2018 Mayor Rohrer and Members of the Assembly, I was very disappointed with the tenor and content of last week's Assembly meeting. There were numerous breeches of parliamentary procedure, personal judgements on a single Assembly member who was not given sufficient opportunity to defend himself, and there were actions taken based on nuanced attorney opinions without the guidance of legal counsel. Any of these could be argued as cause for nullifying the actions taken and even a formal grievance by the Assembly member singled out in the discussions. I was also appalled by the disrespect shown to me by one of the Assembly members during my testimony. All of you are tasked with serving the public, and a large part of that task is to actively listen to what we are saying. Although I was careful not to call out the member by name, I asked three different times that he look at me while I was speaking and not continue to look at his computer. This behavior is unacceptable for a public servant. If this meeting is a harbinger of the future, I fear the Assembly will be paralyzed into inaction as you routinely revisit items that have already been decided and subjectively argue about who is too conflicted to participate in votes. This is a recipe for disaster because feuding factions will be embroiled in never ending attempts to get their way and conflict -out their opponents. I request you consider the following to move forward: 1) Reconsider all the committee/workgroup assignments you were discussing at the last meeting, including the Lands Committee, and postpone final assignments for a month. 2) Have each assembly member submit an ethics disclosure statement to be read into the public record at least twice a year. For the Boards of Fish and Game we are required to do that for every meeting (I can provide you a copy of my most recent one if you like). This allows the public and the assembly to know of any potential or perceived conflicts ofinterest. 3) Convene an Executive Session that includes all assembly members and your attorney to develop a Borough Conflict of Interest Policy. This internal discussion will allow you to get an actual legal opinion on not just one Assembly member, but everyone in the group, and it will be the appropriate venue to discuss person -specific concerns that are not appropriately discussed in an open forum like the other night. It may also be beneficial to call on the services of an actual ethics specialist like we use for our Boards. 4) Once you develop a Conflict of Interest Policy share it with the public and let everyone know that these will be your guidelines from here on out. That should minimize disjointed and unfair activities like we saw at the last meeting by leveling the playing field and providing transparency. 5) When the Policy is in place, revisit your committee assignments by putting the Assembly members with the best knowledge, experience and interest into the appropriate committees/workgroups with the expressed instruction that if they are conflicted on any specific items that come up in those committees they will inform the committee, the Assembly and the public and not participate on that particular subject. Their decision to stand down will be based on what's in your new Policy. This is a serious issue with long-term ramifications and it cannot be taken lightly. Whenever a publicly elected official is denied the right to deliberate and/or vote, you are taking away a large portion of the publics' right to be heard. Such actions, coupled with any signs of disregard or disrespect of public testimony is contrary to the democratic process we hold dear and definitely not in the spirit of our Kodiak tradition of helping each other out and finding ways to get along.
