FY2017-39 10 11 A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH TO DISPOSE 12 OF A±21 ACRE PORTION OF T24S R24W TL 3301 ONION BAY (P & Z CASE NO. 17-021) 13 14 WHEREAS, Dave Townsend and Rob Baer have requested disposal of a ± 21 acre portion of 15 T24S R24W TL 3301 Onion Bay; and 16 17 WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.030 requires each proposed disposal 18 of Borough land to be reviewed by the Planning & Zoning Commission before submission to the 19 Assembly; and 20 21 WHEREAS, the Planning & Zoning Commission is required under KIBC 18.20.030 to make a 22 recommendation to the Assembly by resolution regarding the proposed land disposal; and 23 24 WHEREAS, the principal purpose of the Planning & Zoning Commission review is to consider 25 if the land identified is surplus to the Borough's need; and 26 27 WHEREAS, the Planning & Zoning Commission has found that the parcel identified for 28 disposal is surplus to the public's need based on its review; and 29 30 WHEREAS, the Planning & Zoning Commission held a public hearing on April 19, 2017 to 31 consider this land disposal request. 32 33 NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND 34 BOROUGH that 35 36 Section 1: The Kodiak Island Borough Assembly, in accordance with Title 18 of the Kodiak 37 Island Borough Code, approves disposal of ± 21 acre portion of T24S R24W TL 38 3301 Onion Bay. 39 40 Section 2: The Kodiak Island Borough Planning & Zoning Commission, in accordance with 41 Title 18 of the Kodiak Island Borough Code, has determined, after a public 42 hearing on April 19, 2016, that the aforementioned property is surplus to the 43 public's need. 44 45 Section 3: The aforementioned property should be offered for sale by direct negotiation or at 46 public auction. 47 48 Section 4: The section of the parcel that is sold shall include all appropriate easements to 49 ensure continued access for land-locked property owners in the immediate area.
