RECOMMENDATION:
DISCUSSION:
The Assembly has used a variety of methods and processes in the past to annually evaluate
the performance of the Clerk and Manager. Most recently, the Deputy Presiding Officer
(DPO) has been tasked with overseeing the evaluation.
As proposed, the DPO will continue to oversee the evaluation process. in it, an evaluation
form (copies included) along with a report from the manager or clerk are distributed to the
Assembly at least 4 weeks prior to the evaluation date (anniversary dates of June 3 for the
Clerk and May 25 for the Manager).
The evaluations are completed within 10 days by the Assembly and Mayor and returned to
the DPO. The DPO then tabulates and averages the scores and reviews the comments. The
average scores, plus the range, as well as the most common comments are presented to the
employee in an Assembly meeting (the employee has the choice of conducting it in open or
executive session). The employee is then to submit goals during a meeting, based upon the
evaluation, to the Assembly. These goals will provide part of the basis for the subsequent
evaluation.
ALTERNATIVES:
There are number of alternatives; however, the proposed process is based upon past
successes and failures.

A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH
MEMORIALIZING THE EVALUATION PROCESS FOR THE BOROUGH CLERK AND
BOROUGH MANAGER.
WHEREAS, sound governance principles require that the Borough Clerk and Borough
Manager's job performance be evaluated annually; and
WHEREAS, a variety of processes have been employed in the past to evaluate the clerk and
the manager; and
WHEREAS, the Borough desires to establish an ongoing policy to memorialize the current
process.
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH that:
1. The clerk and the manager's performance shall be evaluated annually at their
employment anniversaries.
2. The Deputy Presiding Officer (DPO) shall coordinate the evaluation process.
3. The DPO shall distribute evaluation forms to the Mayor and Assembly at least 30
days prior to the evaluation along with a report from the clerk or the manager.
4. The Mayor and Assembly members shall return the evaluation within 10 days to
the DPO.
5. The DPO shall average the evaluation scores, provide the range of scores and
the representative comments in writing to the employee at an Assembly meeting
with an agenda item so designated.
6. The clerk or the manager shall, within 15 days, provide a list of goals based upon
evaluation. These goals will be considered a part of the evaluations, shall be
discussed at an assembly meeting, and used, in part, to evaluate the employee
the following year.
7. During a meeting and upon completion of the evaluation, the presiding officer
shall announce any pertinent information as a result of the evaluation i.e. meeting
satisfactory requirements, increases, etc.
BE IT FURTHER RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH
that upon adoption, this evaluation process will become a part of the policy manual of the
Assembly.

INSTRUCTIONS
This evaluation form includes two parts: A quantitative score sheet, covering multiple categories
of performance criteria; and a narrative comments section. A summary of the score sheet
results and all narrative comments will be distributed to all Assembly members in executive
session, and will be used as a basis for Assembly discussion of the Borough Clerk's
performance.
Score sheet. Each of the categories contains multiple statements that describe a behavior
standard in that category. For each statement, rate the Borough Clerk's performance along the
following scale.
5 =excellent (almost always exceeds the performance standard)
4 =above average (generally exceeds the performance standard)
3 = average (generally meets the performance standard)
2 =below average (usually does not meet the performance standard)
1 = poor (rarely meets the performance standard)
If you do not have enough information to rate the Borough Clerk on a particular characteristic,
leave it blank. Blanks will not be included in the numerical scoring, but the number of blanks for

RE: Chiniak Update
There are a number of updates to provide the assembly regarding activities in Chiniak. The
following are noteworthy happenings related to Borough Facilities and resources in the Chiniak
area:
• Well -Staff is issuing a bid request for the drilling of a well that will serve both the
Tsunami Shelter and the School. We are working with KIBSD to have them provide the
maintenance.
• School Evacuation Path -we will be cleaning up the existing right of way to provide a
more direct path to the Tsunami Shelter.
Chiniak Bum Area Logging- Tree planting is well underway. In addition, we have
contracted with Jere's Trees (Jeremiah Olsen) to clean up debris (piles and logs) left by
A-1 Timber within 250 linear feet of the homes on/near King Crab Way. Clean-up work
started last week around the riparian zone. Anticipated completion is around July 15. The
Resource Management Office will be visiting the site sometime in the next week to check
progress and assess clean up work done by the contractor.
Firewood -We have stacked wood at the school site for people to cut. At last check, over
75% of the wood was still there. Once the tree planting is complete, we will open up
most of the area for firewood cutting
• Composting material -We have been approached by Mr. Olsen who was the successful
bidder on the City's composting needs. He is interested in obtaining material from us.
Once we receive a proposal, staff will review and act on it accordingly. We discussed
having an area gated off for their exclusive use (installed and maintained by the

contractor). If there is interest from others for commercial firewood, clips or other
woody materials, we address them as they present themselves.

RE: Discussion of Methods of Land Disposal in KIBC Title 18, Onion Bay
Conservation Lot
At the P&Z Commission work session last month, the Commission voted to enter
into non-competitive land sale negotiations with Mr. David Townsend and Mr.
Rob Baer for a 21 -acre land disposal in Onion Bay. The Commission cited a
precedent in which the Kodiak Island Borough sold land in a non-competitive
direct sale to a Mr. Larry Van Daele (2014). With the support of the previous
Resource Manager, the Commission recommended the Assembly move ahead with
this land sale.
The Manager's Office and Resource Management Office have reviewed the history
of direct-negotiation/non-competitive land sales within Kodiak Island Borough and
are of the opinion that previous direct -negotiation land sales were a
misinterpretation of the law. The correct mechanism for disposal of land to private
citizens is covered within the Land Sales procedures.
Currently, any citizen may nominate parcel for review and potential disposal in a
public outcry auction. This mechanism has been employed in 19 land sales in
town. The land sale to Mr. Van Daele and other previous direct -negotiation land
sales were arguably illegal, and certainly outside the spirit of the Title 18 law.

A. Where specifically permitted under this title, direct negotiations with
interested parties to seek to acquire borough lands...
In the opinion of Legal Counsel and the KIB Manager's Office, the permission for
direct negotiation is reserved for specifically permitted parties under the KIB
Code, which are called out in KIBC 18.20.100(B).
MC 18.20.100 (B) covers disposal of real property at fair market value and
reads as follows:
The borough may dispose of borough land to the United States, the State of Alaska,
or any political subdivision thereof, non-profit corporation or association, for less
than the fair market value of the interest disposed of, upon finding by the assembly
that the disposal will allow the use of the land for a public purpose beneficial to
the borough. It may do so by direct negotiation with the organization acquiring the
land, without conforming to KIBC 18.20.120 through 18.20.155, unless otherwise
directed by the assembly.
Direct negotiation for land disposal with private land owners without going
through the public lands disposal outcry auction, or other land disposal method
outlined in KIBC 18.20.120 is not in the intent of the code, and should not be
continued. Further, the Kodiak Island Borough does not have very many remote
properties, and it should be the aim of the Kodiak Island Borough to maintain a
variety of public lands for subsistence, hunting, gathering, and outdoor recreation
opportunities.
The parcel in question was selected by Mr. Baer and Mr. Townsend for its unique
upland qualities. The 21 -acre parcel would more than quintuple Mr. Baer's and
Mr. Townsend's current land holdings in Onion Bay. Their selected parcel is
sizeable, contains full waterfront access, and much more than enough timber and
land for solar panels (their stated reasons for needing this land). There was a
lengthy discussion in the P&Z Commission work session and P&Z general meeting
about the numerous wetlands in the area and the restriction of development due to
the wetlands status. Presumably, the disposal of this parcel would leave only
wetlands and generally inaccessible borough land available in Onion bay for the
enjoyment, subsistence, and recreation of the Kodiak Public at large.

Remote properties in Kodiak are highly sought after, and currently most remote
lands are tied up in either ANCSA allotments, Federal National Wildlife Refuge,
State of Alaska lands, or Military reserve. It is critical that the Kodiak Island
Borough work to maintain remote lands and associated subsistence and recreation
opportunities for the public. Future management of Kodiak Island Borough
Remote properties could include a public use cabin system, public use trails, and/or
land leases for agricultural pursuits including grazing, kelp farming, or other land-
based agricultural activities. Sale of this public asset to private entities would
prevent this land from being used for future economic endeavors, cultural
enrichment activities, or parks space. Staff opines that it is not in the best interest
of the public to turn this valuable land asset into a private retirement cabin site.
Future taxes levied on this private property do not stand to be more valuable to the
people of Kodiak than the subsistence and recreation opportunities currently
afforded the public. Further, staff recommends that a review of all borough
properties take place with the properties evaluated for their recreational, housing,
economic and other uses so that the Assembly can deem which properties should
be retained long-term. Recreational properties should be mapped and information
presented to the public regarding accessing and using such properties (similar to
the "Trails Map").
Additionally, the Kodiak Island Borough needs to correct a past misinterpretation
of the law, as well as modify Title 18 to clarify the language regarding land sale
requests.
In regard to the request by Mr. Townsend and Mr. Baer, the mechanisms in place
for timber harvest can be worked with to allow them the harvest of some timber in
the area. To install a solar array, Mr. Townsend and Mr. Baer could pursue a utility
facility lease or utility easement from the Kodiak Island Borough. This would
allow them to construct their utility array without loss of recreation and subsistence
opportunity for the Public.
Kodiak Island Borough needs to seek legal counsel to prevent future business
dealings in this manner. It is possible that past transgressions must be left alone,
but we should find a way get back to our prescribed equal -opportunity, legal means
of land disposal.
