FY2017-36 A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH TO DISPOSE OF THE 11.419 ACRE PARCEL TRACT A, PORT LIONS SCHOOL RESERVE IN EXCHANGE FOR THE 6.33 ACRE PARCEL WITH A LEGAL DESCRIPTION OF PORT LIONS SUBDIVISION FIRST ADDITION SCHOOL RESERVE (P&Z CASE NO. 17-020) WHEREAS, the City of Port Lions has requested disposal of Tract A, Port Lions School Reserve, in exchange for Port Lions School Reserve First Addition; and WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.030 requires each proposed disposal of Borough land to be reviewed by the Planning & Zoning Commission before submission to the Assembly; and WHEREAS, the Planning & Zoning Commission is required under KIBC 18.20.030 to make a recommendation to the Assembly by resolution regarding the proposed land disposal; and WHEREAS, the principal purpose of the Planning & Zoning Commission review is to consider if the land identified is surplus to the Borough's need; and WHEREAS, the Planning & Zoning Commission has found that the parcel identified for disposal is surplus to the public's need based on its review; and WHEREAS, Kodiak Island Borough code allows for the disposal of land in exchange for other land, and WHEREAS, Kodiak Island Borough code allows for the disposal of land for less than fair market value when the land will be used for a public purpose beneficial to the borough. WHEREAS, This parcel in question will be used for a public purpose beneficial to the borough and so can be disposed of for less than market value. NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: The Kodiak Island Borough Assembly, in accordance with Title 18 of the Kodiak Island Borough Code, approves disposal and exchange of Tract A, Port Lions School Reserve. Section 2: The Kodiak Island Borough Planning & Zoning Commission, in accordance with Title 18 of the Kodiak Island Borough Code, has determined, after a public hearing on March 22, 2017, that the aforementioned properties are hereby surplus to the public's need. Kodiak Island Borough, Alaska Resolution No. FY2017-36 Page 1 of 2 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 Section 3: The aforementioned property should be exchanged for the tract of land owned by the City of Port Lions called Port Lions School Reserve First Addition for the purposes of creating a contiguous lot. Section 4: To ensure that the adjacent Airport Road right-of-way width satisfies the requirements of Title 16 of the Borough Code, the Kodiak Island Borough Planning & Zoning Commission recommends that the 10 foot wide portion of Tract A, Port Lions School Reserve that abuts Airport Road be dedicated as right-of-way prior to finalizing the land exchange. Section 5: The Kodiak Island Borough Planning & Zoning Commission recommends that all surveying expenses associated with this land exchange be shared equally between the Kodiak Island Borough and the City of Port Lions.
