RECOMMENDATION:
Recommend that the assembly direct staff to advertise the RFP.
DISCUSSION:
Staff has made some changes to the proposed RFP that the assembly reviewed previously to
expand on the idea of a management planning effort to go along with the mine design,
permitting and regulatory compliance focus of the original RFP. The revised RFP also adds
additional time for the process, to account for substantial assembly involvement in a project
that will assuredly exceed manager discretion to move forward. Staff also formally added the
two Chiniak rock pits to the scope of work.
The assembly is not obligated to issue a contract if it doesn't like what it sees in the returned
proposals. Putting out the RFP sooner, rather than later, would save several months that
would be lost by waiting for the new Resource Management Officer (RMO) to arrive and get
up to speed. Under the proposed timeline, staff would envision a 45 day deadline for
submittals. Adding to that an additional 30 days to schedule the proposals before the
assembly in the form of a proposed contract, the new RMO would be on staff before the
assembly has taken any irrevocable action and would be able to advise the assembly. If all
proposals are rejected, then the assembly can decide at that time whether to re -scope a new
RFP or rely on the new RMO to take on the project.

REVISED REQUEST FOR PROPOSAL
SALONIE CREEK AGGREGATE MINING DEVELOPMENT PLAN,
PERMITTING AND PROJECT MANAGEMENT
PURPOSE AND INTENT
A. As a second class borough, the Kodiak Island Borough (KIB) has received
municipal entitlement land from the State of Alaska. This land is intended to
provide a resource to new political subdivisions in lieu of direct state funding.
Among other things, this land can be used to help sustain local government,
provide a land base for the community, provide development sites for essential
services, provide opportunities for public recreation and to provide rock, timber
and water resources that can be managed to support the local economy and
contribute to the support of community governance in lieu of taxes.
B. The KIB has previously investigated borough land, identified as a Portion of Lot
1, U.S. Survey 2539, which is generally located in the Salonie Creek drainage,
upstream from the Salonie Creek Rifle Range (see map attached). There are
proven deposits of aggregate in this area which the KIB would like to bring into
production as a public material site, available to all commercial operators working
on the Kodiak road system. The proposed material site would be owned and
managed by the KIB who would be ultimately responsible for feasibility planning,
obtaining permits and regulatory compliance, developing a mining plan and
reclamation plan for the site. Commercial contractors would he permitted to have
non-exclusive access to the site to purchase and remove aggregate from the site
under material sale agreements in accord with KIBC Chapter 18.60 Material
Sales. The KIB would like to bring this aggregate mining site into production in
order to sell material "over-the-counter" for local construction and road projects.
C. The KIB has elected to keep two borrow pits open in the Chiniak area which were
previously opened in support of salvage timber harvest operations under the
auspices of the Alaska Forest Resources and Practices Act. These pits are located
within Portions of Sections 31 and 32, T29S, R18 W and Portions of Sections 5
and 6, T30S, R18 W, Seward Meridian, Excepting therefrom privately owned lots
in U.S. Survey 3473, U.S. Survey 3474, Chiniak Subdivision and adjoining -
Leisnoi Native Corporation lands (see attached map). At the conclusion of the
salvage timber harvest, the borough will need aggregate to maintain the 7 miles of
logging roads that will remain open for public access. In addition, if there is
commercial need for rock or aggregate in Chiniak or other areas of the Kodiak
road system, the KIB would like to have these pits planned, permitted and open to
sell material "over-the-counter" as generally described for the Salonie Creek
drainage.
D. It is the primary intent of this Request for Proposal to select a qualified principal
or firm to manage the mine planning, permitting and development process from
beginning to end. The selected individual or firm will be expected to provide
and/or obtain services to include, but not limited to, feasibility analysis and

market study, evaluation of long-term management options, material testings,
mining plan of operations, regulatory permitting, storm water planning,
reclamation planning and all other aspects of the projects that are required to
bring the material sites into operation as operating aggregate mines. The Salome
Creek land in question is located about .75 to 1.5 miles upstream from the Salonie
Creek Rifle Range. The site is generally located approximately 2.5 miles
southwest of Womeas Bay, generally upstream from the mouth of Salonie Creek.
The area of interest is approximately 90 acres in area and comprised of three
specific sites that are all located in the general area of interest. The goal of the
project is creation a municipal aggregate site that will serve community aggregate
needs for the next 30 to 40 years. The sites located in Chiniak are located near the
"Road's End" area near the and of the public road between MP 41 and 42 of the
Chiniak Highway. The two sites are presently several acres in size but could be
resized as appropriate once the reasonable extents of the resource have been
determined.
E. By the time a qualified individual or firm is selected for this project the KIB
expects to have surface model for the planning area in the Salonie Creek Drainage
that can be used for planning purposes going forward.
F. The work shall be performed in compliance with all applicable federal, state and
local requirements. KIB requires all work to be performed efficiently,
thoroughly, cost effectively, and according to best business practices ofthe
industry.
PROJECT SCOPE
In addition to overall project management, the successful proposer will create mine
development plans, arrange and coordinate additional survey, material testing or other
regulatory subcontract work that is necessary to obtain regulatory compliance with regard
to the following pmject elements:
• Site Identification, Survey and Evaluation
• Material Testing
• Management Plan Analysis
• Feasibility Analysis
• Market Analysis
• Mining Plan of Operations
• Identification of Off-site Impacts
• Plans to Address or Mitigate Off-site Impucts
• Regulatory Submittals and Permitting
• Reclamation Planning
• Other Relevant Matters
Interested contractors have specifically suggested that the testing should be consistent with ADOT/PF
specifications for road p ujecu. The KIB is interested in demonstrating the capability and suitability of the
resource in meet the widest range of community building and construction projects.

RECOMMENDATION:
Staff recommends that the assembly introduce the two ordinances and set them for public
hearing at a subsequent meeting.
DISCUSSION:
Staff has been working with the Borough Lands Committee for the past 16 months in order to
identify potentially surplus borough lands for disposal to the public and other entities. The
principal focus of the committee, thus far, has been to make land available for residential
development to satisfy the perceived need for additional housing in the community. In this
regard, the committee has prioritized looking for land along constructed roads within
established service areas, where municipal utilities and electrical services are available. In
addition to reviewing the inventory of available borough lands, the committee has also been
looking to streamline the disposal process and to provide new or improved tools to make the
disposal process more efficient and responsive to community needs.
In looking at the borough's inventory of land for potential disposal, much of the land remaining
in borough control has constraints of one sort or another that may make them challenging to
develop. In addition, there are larger parcels that would require substantial investment in
roads, utilities and surveying before the borough would have saleable land to auction.
In KIB Ordinance No. FY2017-29, the committee has proposed amendments to existing code
(KIBC 18.20.090 (Development Plans) in order to provide a more robust process for Public -
Private Partnerships, as an alternative to the typical land sale by auction approach. As
envisioned, this would provide the assembly and staff with a better tool to dispose of larger
parcels of raw land which may have constraints to development or which may need
substantial infrastructure investment to develop. The intent is also to provide some ties to
other public plans and public process so that the community has opportunity to weigh in on
these proposals at key points in the process. This amendment would provide a better
strategy for the borough to specify a certain type of residential product and then using the
land, in a competitive process, to leverage a willing development partner to undertake the
work and up front investment in a project selected by the assembly.
The intent of amendments proposed in KIB Ordinance No. FY2017-30 regarding payment and
notice requirements are much more limited in scope. The suggested amendments rely on
lessons learned from recent land sales in order make the language of KIBC 18.20.080
(Deposit Costs) consistent with the language in KIBC 18.30 (Land Sales) with regard to the
down payment requirements at auction or other land sale. The public notice requirements
have also been recommended for expansion to ensure that prospective buyers have access
to all public information pertaining to borough land before the sale so that the interested public

community to get the kind of development that is needed or expressed in adopted
comprehensive plan guidance without having to become it's own developer. It would also
reduce or eliminate the need for the borough to invest large sums of cash into a project that
could take years to come to fruition.

19 the borough land disposal process; and,
20 WHEREAS, the subcommittee, atter several meetings, has developed a limited number of
21 recommended changes to KIBC Chapter 18.20, that it believes should be implemented by the
22 assembly prior to the next land sale; and,
23 WHEREAS, the full Borough Lands Committee hereby recommends the code amendments
24 set forth In the attached draft ordinances that It believes will help reline the land disposal
25 process and provide better tools In the borough land disposal process.

WHEREAS, the Kodiak Island Borough Lands Committee has reviewed KIBC Title 18 with the
16
intent to improve the land sale notice and sale process; and

WHEREAS, the Borough Lands Committee has discussed the potential language changes
19
recommended below as amendments to the Kodiak Island Borough Code of Ordinances over
20
the course of several meetings in September through December of 2016; and
21

WHEREAS, the Borough Lands Committee has also reviewed KIBC Chapter 18,30 and has
23
recommended specific language changes to ensure that both KIBC Chapters 18.20 and 18.30
24
are consistent; and

WHEREAS, the Borough Lands Committee has concluded its review and editing of proposed
27
changes to KIBC Title 18 and hereby recommends the following amendments to the Kodiak
28
Island Borough Code of Ordinances; and

NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND

Section 1: This ordinance is of a general and permanent nature and shall become a part of the
34
Kodiak Island Borough Code of Ordinances.

Section 2: That KIBC Chapter 18.20 Is hereby amended by amending section 18.20.080 to

read:

18.20.080 Deposit costs and Payment.

A. The applicant may be required, upon 30 days' written notice, to deposit with the borough an
41
amount equal to the estimated costs of processing an application for the disposal of borough
42
land, including but not limited to costs of survey, appraisal, and advertising of the area subject to
43
the application, If the applicant fails to make the deposit, the application shall be canceled. If the
44
applicant does not accept a disposal contract within 30 days after receiving an offer thereof, all
45
deposit money spent or encumbered for survey, appraisal, or advertising shall be forfeited, and
46
the balance, if any, shall be returned to the applicant. If the real property that is the subject of a
47
cost deposit is conveyed to another, the latter shall be required to pay the actual costs of

48 application processing, survey, appraisal, and advertising, and the original deposit shall be
49 returned to the depositor. Where the applicant becomes the purchaser, the full amount of any
50 deposit by the applicant shall be credited to payments due under the contract. All survey,
51 appraisal, and advertising shall be performed only under the authorization of the borough, and
52 any such work performed without such authorization will not be accepted.

54 B. The manager may establish an application processing fee schedule for applications having
55 similar circumstances.

57 C. At the time of sale or auction, the purchaser shall pay to the borough not less than t0
58
percent of the minimum appraised value established for the sale parcel. The difference
59
between the 10 percent minimum appraised value and 10 Percent of the total price bid for
60
the Parcel shall be Paid to the borough at the time the Purchase contract is executed. The
61
balance of the purchase price shall be paid, and Its payment secured, In accordance with
62
the to rms of the sale approved by the assembly.

Section 3: That section 18.20.090 of the Kodiak Island Borough Code of Ordinances is hereby

amended to read as follows:

18.20.140 Public notice.

Notice of disposal of borough land by compe8live bidding or proposals, or at public auction,
69
shall, at a minimum, be published in a newspaper of general circulation within the borough once
70
each weak for two successive weeks, not less than 20 days prior to the date of the auction or
71
opening of bids or proposals, and shall be posted in at least three public places within the
72
borough, one of which shall be in the community nearest to the subject borough land, for at
73
least 30 days prior to the disposal. Additional notice may be given by any means determined to
74
be reasonable by the manager or the assembly. The notice must contain a brief description of
75
the land, Its size and general location, the proposed use, term, minimum offer, limitations, and
76
special considerations, if any, and time and place set for the auction or bid opening. The land
77
status file of the parcel will be available to the public upon request. All prospective
78
parties are strongly urged to personally examine the parcel prior to the sale. There Is no
79
representation or warmnly concerning the condition of the property. the presence or
80
absence of any environmental pollution, or the suitability of the property for any
81
particular use.

In October 2016 the Borough Assembly passed Ordinance No. FY2017-17. This
ordinance did two things:
1) Placed a moratorium on the enforcement of land use regulations prohibiting
the keeping of chickens and other small animals useful to people on urban
residential lots (roosters were not included in the moratorium); and
2) Directed the Planning and Zoning Commission to conduct a review of Title 17
(Zoning) regulations relating to the keeping of small animals useful to people on
residential lots.
During this meeting, staff was directed to do the following:
1) Conduct a review of Title 6 (Animal Control) concurrently with the Planning
and Zoning Commission's aforementioned review of Title 17.
Review of Titles 6 and 17 must be completed and, if applicable, adopted by April 2018.
In the absence of adopted amendments, the moratorium will expire in October 2018
and existing Borough Code will once again be enforced.
Ordinance No. FY2017-17 was enacted in response to several community members
voicing concerns over the enforcement of Borough land use codes which prohibit the
keeping of small livestock in urban residential zoning districts.
The "chicken ordinance" was introduced to the Planning and Zoning Commission at
their work session on February 8, 2017.
A public meeting was held March 4, 2017. At this meeting the consensus among
attendees was that:
1) The keeping of small animals useful to people should be allowed in all
residential zoning districts.
2) The keeping of these animals, aside from their being listed as a permitted use,
should not be regulated by land use codes.

3) The keeping of these animals should be regulated by Title 6 and should focus
on animal welfare and nuisance regulations.
Public input was also solicited by written survey from March 4, 2017 to March 20, 2017.
The results of this survey are posted on the Borough's website under "News Flash" and
are available in the Community Development Department. The results of the
community survey indicate that survey respondents generally are in agreement with
the consensus reached at the March 4, 2017 public meeting.
The "chicken ordinance" was again discussed by the Planning and Zoning Commission
at their March 15, 2017 work session. They were given a verbal summary of the public
meeting and survey results to -date and, after discussion, staff was directed to begin
drafting an ordinance based on public input.
Assembly members Kyle Crow and Matt Van Daele met with the Community
Development Director on March 28, 2017 to present proposed language to be
included in the draft ordinance.
Staff is currently working on a draft ordinance to modify Titles 6 and 17.
Moving forward, staff plans on participating in KMXT's Talk of the Rock radio program in
late April/early May and holding an additional public meeting in May. Staff will then
bring the draft ordinance before the Planning and Zoning Commission as a work session
agenda item an June 14, 2017.
