WHEREAS, Leisnoi, Inc., an Alaska Native Corporation, is willing to sell a conservation
easement on approximately 1,028 acres of land it owns at Termination Point to benefit
habitat conservation and allow for public access; and,
WHEREAS, the Kodiak Island Borough has been offered the opportunity to hold this
conservation easement to benefit the members of its community, and,
WHEREAS, Great Land Trust (CLT), a conservation organization serving the Kodiak
area, has presented to the Kodiak Island Borough Assembly a number times regarding this
potential conservation easement; and,
WHEREAS, the Kodiak Island Borough Assembly voted on October 15, 2015, in
resollution number FY2016-13, to support negotiations between CLT and Leisnoi, Inc. to
investigate the terms of a potential conservation easement at Termination Point; and,
WHEREAS, the Exxon Valdez Oil Spill Trustee Council (EVOSTC) voted in November of
2015 to approve funding to purchase this conservation easement from Leisnoi, Inc. out of
Exxon Valdez Oil Spill settlement funds; and,
WHEREAS, GLT, on behalf of EVOSTC, has completed extensive due diligence
activities on the conservation easement property, including a Phase I environmental
assessment, an appraisal to substantiate the value of the easement, and title review, all of
which have been communicated to the Kodiak Island Borough Assembly; and,
WHEREAS, a draft conservation easement has been jointly developed between Leisnoi,
Inc., the Kodiak Island Borough, EVOSTC, the U.S. Department of Interior, and the State
of Alaska Department of Natural Resources; and,
WHEREAS, this conservation easement document has been reviewed by the Kodiak
Island Borough and is substantially complete for the purpose of review and acceptance by
the Kodiak Island Borough.
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH TYAT:
Section 1: The Kodiak Island Borough Assembly recognizes the benefit to its community
in holding the conservation easement on the Termination Point property.

Section 2: The Kodiak Island Borough Assembly hereby authorizes staff to finalize the
conservation easement and oversee completion of due diligence, and
authorizes its signing officer(s) to execute all forms or documents necessary
to effectuate the Kodiak Island Borough's acceptance and holding of this
conservation easement in perpetuity.
