FY2017-23 Dispose Lot 3, Lake Orbin Subdivision (P&Z Case No. 17-007)1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31. 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 Introduced by: Requested by: Drafted by: Introduced!: Adopted: Borough Assembly Borough Lands Committee Community Development Department 12/01/2016 12/01/2016 r_lvi" I I 1 11 #1 00a Ri 1591,21 ILI We$ I No WHEREAS, the Kodiak Island Borough Assembly has requested disposal of of Lot 3, Lake Orbin Subdivision-, and WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.030 requires each proposed disposal of Borough land to be reviewed by the Planning and Zoning Commission before submission to the Assembly; and WHEREAS, the Planning and Zoning Commission is required under KIBC 18.20,030 to make a recommendation on the disposal by resolution before it is forwarded to the Borough Assembly; and WHEREAS, the principal purpose of the Commission review is to determine if the land identified for disposal is surplus to the Borough's need; and WHEREAS, the Planning and Zoning Commission, has found that the parcel identified below for disposal is surplus to the public's need based on its review; and WHEREAS, the Planning and Zoning Commission held a public hearing on August 17, 2016 and is recommending the disposal of the parcel listed below-, NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1 The Kodiak Island Borough Assembly, in accordance with Title 18 of the Kodiak Island Borough Code, approves disposal of Lot 3, Lake Orbin Subdivision. Section 2: The Kodiak Island Borough Planning and Zoning Commission, in accordance with Title 18 of the Kodiak Island Borough Code, has determined, after a public hearing on August 17, 2016, that the aforementioned property is hereby surplus to the public's need. Section 3: The aforementioned property should be offered to the public for disposal in a subsequent land sale.
