RESOLUTION NO. FY2017-05
A RESOLUTION OF THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH TO DISPOSE OF LOTS 2 AND 3 (AS ONE LOT), BLOCK
38, EAST ADDITION SUBDIVISION (P&Z CASE NO. 16-026)
WHEREAS, the Kodiak Island Borough Assembly has requested disposal of Lots 2 and
3, Block 38, East Addition Subdivision; and
WHEREAS, Kodiak Island Borough Code (KIBC) 18.20.030 requires each proposed
disposal of Borough land to be reviewed by the Planning &Zoning Commission before
submission to the Assembly; and
WHEREAS, the Planning & Zoning Commission is required under KIBC 18.20.030 to
make a recommendation to the Assembly by resolution regarding the proposed land
disposal; and
WHEREAS, the principal purpose of the Planning & Zoning Commission review is to
consider if the land identified is surplus to the Borough's need; and
WHEREAS, the Planning & Zoning Commission has found that the parcels identified for
disposal are surplus to the public's need based on its review; and
WHEREAS, during its review, the Planning & Zoning Commission noted lot area and
topographical constraints that would restrict the development of suitable residential
building sites on each individual lot as currently platted; and
WHEREAS, the Planning & Zoning Commission determined that the lots should be
replatted into a single parcel to ensure a suitable residential building site can be
developed; and
WHEREAS, the Planning & Zoning Commission held a public hearing on July 13, 2016
to consider this land disposal request.
NOW, THEREFORE, BE IT RESOLVED BY THE ASSEMBLY OF THE KODIAK ISLAND
BOROUGH THAT:
Section 1: The Kodiak Island Borough Assembly, in accordance with Title 18 of the
Kodiak Island Borough Code, approves disposal of Lots 2 and 3 (as one
lot), Block 38, East Addition Subdivision.
Section 2: The Kodiak Island Borough Planning & Zoning Commission, in accordance
with Title 18 of the Kodiak Island Borough Code, has determined, after a

public hearing on July 13, 2016, that the aforementioned properties are
hereby surplus to the public's need.
Section 3: The aforementioned properties should be replatted to a single parcel and
offered to the public for disposal in a subsequent land sale.
