FY2017-06 7 8 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND 9 BOROUGH REZONING LOT 7A, BLOCK 2, MONASHKA BAY 10 SUBDIVISION FROM PL -PUBLIC USE LANDS DISTRICT TO RR1- 11 RURAL RESIDENTIAL ONE DISTRICT (P&Z CASE NO. 16-025) 12 13 WHEREAS, as a second class borough, the Kodiak Island Borough exercises planning, 14 platting, and land use regulations on an area wide basis pursuant to Chapter 29.40 Alaska 15 Statutes; and 16 17 WHEREAS, in accordance with AS 29.40, the Kodiak Island Borough adopted the 2008 18 Comprehensive Plan update on December 6, 2007 (Ordinance No. FY2008-10) to replace 19 the 1968 Comprehensive Plan; and 20 21 WHEREAS, the Kodiak Island Borough has adopted KIBC Title 17 (Zoning) in 22 accordance with AS 29.40 to implement the Kodiak Island Borough Comprehensive Plan; 23 and 24 25 WHEREAS, KIBC 17.205.010 provides that 'Whenever the public necessity, 26 convenience, general welfare or good zoning practice requires, the assembly may, by 27 ordinance and after report thereon by the commission and public hearing as required by 28 law, amend, supplement, modify, repeal or otherwise change these regulations and the 29 boundaries of the districts"; and 30 31 WHEREAS, The Borough Lands Committee recommended and the Borough Assembly 32 initiated a rezone of Lot 7A, Block 2, Monashka Bay Subdivision from PL -Public Use 33 Lands District to FIR 1 -Rural Residential One District; and 34 35 WHEREAS, at an advertised public hearing, consistent with Kodiak Island Borough 36 Code 17.205.040, the Planning and Zoning Commission considered the merits of the 37 rezone request; and 38 39 WHEREAS, the Commission voted to recommend to the Borough Assembly that the site 40 be rezoned from PL -Public Use Lands District to RR1-Rural Residential One District 41 finding that the public necessity, convenience, general welfare, and good zoning practice 42 would be enhanced by such action; and 43 44 WHEREAS, the Commission hereby recommends that this rezone be reviewed and 45 approved by the Borough Assembly. 46 47 48 49 Kodiak Island Borough, Alaska Ordinance No. FY2017-06 Page 1 of 2 50 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND 51 BOROUGH THAT: 52 53 Section 1: This ordinance is not of a general and permanent nature and shall not 54 become a part of the Kodiak Island Borough Code of Ordinances. 55 56 Section 2: Lot 7A, Block 2, Monashka Bay Subdivision is hereby rezoned from PL - 57 Public Use Lands District to RR1-Rural Residential One District. 58 59 Section 3: By this ordinance, the Borough Assembly adopts the following findings of 60 fact in support of their approval of this rezone. 61 62 1. Developable residential lots are a known need throughough the 63 Borough. 64 2. The subject parcel is adjacent to RR1-Rural Residential One zoned land 65 and uses. 66 3. The subject parcel is of sufficient area and is capable of providing 67 suitable rural residential building sites. 68 4. The rezone is consistent with the adopted 2008 Comprehensive Plan 69 Rural Residential Future Land Use Designation per Case No. 16-024. 70 5. The rezone is consistent with, and will further implement, various goals, 71 policies, and implementation actions identified in the adopted 72 Comprehensive Plan. 73 6.
