FY2017-09 7 8 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND 9 BOROUGH AMENDING THE 2008 COMPREHENSIVE LAND USE 10 PLAN TO CHANGE THE FUTURE LAND USE DESIGNATION OF A t 11 20,000 SQUARE FOOT PORTION OF LOT 29, U.S. SURVEY 3099 12 FROM PUBLIC FACILITIES/OWNERSHIP TO URBAN RESIDENTIAL 13 (P&Z CASE NO. 16-036) 14 15 WHEREAS, as a second class borough, the Kodiak Island Borough exercises planning, 16 platting, and land use regulations on an area wide basis pursuant to Chapter 29.40 Alaska 17 Statutes; and 18 19 WHEREAS, in accordance with AS 29.40, the Kodiak Island Borough adopted the 2008 20 Comprehensive Plan update on December 6, 2007 (Ordinance No. FY2008-10) to replace 21 the 1968 Comprehensive Plan; and 22 23 WHEREAS, the Kodiak Island Borough has adopted KIBC Title 17 (Zoning) in 24 accordance with AS 29.40 to implement the Kodiak Island Borough Comprehensive Plan; 25 and 26 27 WHEREAS, KIBC 17.205.010 provides that 'Whenever the public necessity, 28 convenience, general welfare or good zoning practice requires, the assembly may, by 29 ordinance and after report thereon by the commission and public hearing as required by 30 law, amend, supplement, modify, repeal or otherwise change these regulations and the 31 boundaries of the districts'; and 32 33 WHEREAS, The Borough Lands Committee recommended and the Borough Assembly 34 initiated an amendment to the 2008 Comprehensive Plan to change the Future Land Use 35 Designation of a t 15,000 square foot portion of Lot 29, U.S. Survey 3099; and 36 37 WHEREAS, at an advertised public hearing, consistent with Kodiak Island Borough 38 Code 17.205.040, the Planning and Zoning Commission considered the merits of the 39 Comprehensive Plan and amendment request; and 40 41 WHEREAS, the Commission voted to recommend to the Borough Assembly that the 42 Comprehensive Plan Future Land Use Designation of this lot be changed finding that the 43 public necessity, convenience, general welfare, and good zoning practice would be 44 enhanced by such action; and 45 46 WHEREAS, the Commission hereby recommends that this amendment be reviewed and 47 approved by the Borough Assembly. 48 Kodiak Island Borough, Alaska Ordinance No. FY2017-09 Page 1 of 2 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 88 89 90 91 92 93 94 95 96 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH THAT: Section 1: This ordinance is not of a general and permanent nature and shall not become a part of the Kodiak Island Borough Code of Ordinances. Section 2: The 2008 Comprehensive Plan Future Land Use Designation of a t 20,000 square foot portion of Lot 29, U.S. Survey 3099 is hereby changed from Public Facilities/Ownership to Urban Residential. Section 3: This ordinance shall become effective upon the recording of a plat that defines the actual surveyed boundary of the t 20,000 square foot portion that is subject to this Future Land Use Designation change. Section 4: By this ordinance, the Borough Assembly adopts the following findings of fact in support of their approval of this amendment. 1. Developable residential lots are a known need throughout the Borough. 2. The subject parcel is adjacent to properties with a Future Land Use Designation of Urban Residential. 3. The subject parcel is of sufficient area and are capable of providing suitable urban residential building sites. 4. The amendment is consistent with, and will further implement, various goals, policies, and implementation actions identified in the adopted Comprehensive Plan. 5. The amendment is necessary to allow for a subsequent rezone from PL -Public Use Lands District to R2 -Two -Family Residential District. 6. The Planning and Zoning Commission recommends that the Borough Assembly approve this Comprehensive Plan amendment.
