Addendum to Purchase Agreement: Occupancy Prior to Closing

WHEREAS, the Seller has agreed to sell to the Bu er the above Premises, according to the
Purchase Agreement dated ;, , 2016, and the Buyer has made
application for mortgage financing, and the closing is pending; and
WHEREAS, the Premises is available for occupancy and the Buyer is desirous of occupying the
same prior to closing; and the Seller is agreeable thereto under the following terms and
conditions.
1. Supplement to Agreement. This Agreement shall be a supplement to and a part of the
Agreement which will otherwise remain in full force and effect.
2. Occupancy and Closing. The Buyer may occupy the Premises prior to closing. Buyer shall
close in the timeline agreed to in the Agreement, and pay over at closing the balance of the
purchase price, together with any adjustments due under the Agreement.
3. Occupancy Date. The date of occupancy by the buyer shall be on the date this document is
signed.
4. Daily Rental and Security Deposit. Seller has agreed that NO monthly rent is required and
that NO security deposit is required, aside from earnest money paid at the signing of Agreement
which shall be credited against the purchase price at closing.
5. Utilities. Gas, electric, sewer and water shall be placed in Buyer's name immediately upon
occupancy, including bills for any installation of any utilities and bills for usage of any utilities.
6. As Is. Notwithstanding anything to the contrary in the Agreement, the Buyer agrees to accept
the Premises in "as is" condition as of the date of occupancy, and the Seller is under no
obligation to make any repairs or improvements.
7. Alterations. The Seller agrees to allow the Buyer to make alterations and improvements to
the Premises, such as clearing, excavating, and leveling the lot, digging trenches for utilities and
drainage, adding gravel and dirt, and any other lot improvements that would serve to raise the
value of the property.
8. Storage. The Seller agrees to allow the Buyer to store on the Premises any personal
properties, including one Mobile Home, one RV, personal vehicles, shed, building materials, and
any other personal property.
9. No Closing. Should the sale not be consummated on or before the closing date set forth in
the Agreement, Buyer shall vacate the Premises within 10 days from the receipt of notification
from the Seller, including full removal of any personal property, and in such an event,
A. If failure to close is on the part of the Seller, the Seller shall reimburse the Buyer any monies
spent on lot improvement, including clearing, excavating, efforts toward installing utilities, or
any improvements that would serve to raise the value of the Premises.
B. If failure to close is on the part of the Buyer, the Buyer shall not hold the Seller responsible
for any monies spent on improvement of the Premises, and shall pay all outstanding bills for
said improvements.
10. Insurance. The Buyer shall be responsible to obtain personal property insurance and shall
not hold Seller liable for any loss or damage occurring to the Buyer's personal property on the
Premises.
11. No Landlord/Tenant Relationship. This agreement is intended only to give the Buyer the
right of occupancy pending closing and is not intended to establish a landlord and tenant
relationship.
12. Binding. This agreement is binding on both parties, and their personal representatives and
distributes.
