04/07/2016 Regular MeetingKODIAK ISLAND BOROUGH Assembly Regular Meeting April 7, 2016 A regular meeting of the Kodiak Island Borough Assembly was held on April 7, 2016, in the Assembly Chambers of the Kodiak Island Borough Building, 710 Mill Bay Road. The meeting was called to order at 6:30 p.m. The invocation was given by Major Richard Greene of the Salvation Army. Mayor Friend led the Pledge of Allegiance. Present were Mayor Jerrol Friend, Assembly members Kyle Crow, Larry LeDoux, Frank Peterson, Mel Stephens, and Dennis Symmons. Also present were Administrative Official Bill Roberts, Borough Clerk Nova Javier, and Assistant Clerk Laurie Pardoe. PETERSON moved to excuse Assembly members Dan Rohrer and Rebecca Skinner who were absent due to personal leave. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF AGENDA AND CONSENT AGENDA LEDOUX moved to suspend the rules by moving citizens' comments after awards and presentations. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. CROW moved to approve the agenda and consent agenda as amended. VOICE VOTE ON MOTION CARRIED UNANIMOUSLY. APPROVAL OF MINUTES Regular Meeting Minutes of February 18 and March 3, 2016 and Special Meeting Minutes of February 15, February 25, and March 10, 2016 were approved under the consent agenda. CITIZENS' COMMENTS Monique Lewis, Betty MacTavish, and Marissa Cornett spoke against Contract No. FY2016-44. Judi Kidder spoke in appreciation of the Arctic Care Innovative Readiness Training program and spoke against Contract No. FY2016-44. Jonathan Strong spoke in favor of the democratic process in regards to Contract No. FY2016- 44. AWARDS AND PRESENTATIONS Mayor Friend proclaimed the Month of April 2016 as Child Abuse Prevention Month and called upon all citizens to increase their participation in our efforts to prevent child abuse, thereby strengthening the communities in which we live. Mayor Friend proclaimed the month of April 2016 as Sexual Assault Awareness Month and encouraged all residents to support local activities and programs, which assist victims, and to Kodiak Island Borough Assembly Regular Meeting Minutes April 7, 2016 Page 1662 learn more about the pervasiveness to sexual assault in Alaska so we may eliminate this heinous crime. Mayor Friend proclaimed the month of April 2016 as Month of the Military Child and encouraged all Kodiak residents to show appreciation, support, and understanding to the military children in our community. Mayor Friend proclaimed the week of April 10 through April 16, 2016 as the Week of the Young ChildTM in Kodiak, Alaska and encouraged all citizens to work to make a good investment in early childhood in Kodiak, Alaska. COMMITTEE REPORTS Assembly member Crow reported on the Joint Building Code Review Committee meetings of March 30 and April 6, 2016 discussing the 2012 residential building codes and other new codes recently adopted by the State of Alaska. PUBLIC HEARING None. BOROUGH MANAGER'S REPORT Administrative Official Roberts announced the following: • The Clerk's office moved into a space near the Assembly chambers • Meagan Christiansen would be the new Procurement Officer for the Kodiak Island Borough • The bill for the Chiniak timber study came in approximately $5,500.00 under budget • Presented a short update on the potential development of a timber harvest contract MESSAGES FROM THE BOROUGH MAYOR Mayor Friend reported that he received a phone call from Senator Stevens in response to letters he received from the Kodiak Island Borough regarding the landfill. Mayor Friend also reported on Senator Sullivan's recent visit to Kodiak for the Comfish Alaska Convention and items that were discussed in a meeting between Senator Sullivan and other mayors within the Borough. UNFINISHED BUSINESS None. NEW BUSINESS Contracts 1. Contract No. FY2016-44 Employment Contract Between the Kodiak Island Borough Assembly and Mr. Michael Powers as Borough Manager. PETERSON moved to approve Contract No. FY2016-44 Employment Contract Between the Kodiak Island Borough and Mr. Michael Powers as Borough Manager. The process of hiring for the Kodiak Island Borough Manager started in November of 2015. The Assembly interviewed two candidates and decided to offer the position to Mr. Michael Powers. A negotiating team comprised of Assembly members Larry LeDoux and Frank Peterson Jr. was formed by the Assembly to discuss the terms of the contract with Mr. Powers. Assembly member Peterson originally voted yes and changed his vote to no. Resolutions 1. Resolution No. FY2016-33 Approving a Lease Agreement Between the Kodiak Island Borough and the General Services Administration for a Portion of the Kodiak Fisheries Research Center. LEDOUX moved to approve Resolution FY2016-33. The Kodiak Island Borough entered into a lease agreement with the General Services Administration in March 1997 for the use of the Kodiak Fisheries Research Center by National Oceanic and Atmospheric Administration (NOAA). Throughout the term of the lease, there have been points of disagreement between GSA and KIB regarding definition and interpretation of certain items within the lease such as space allocation, operating costs, R&R/major maintenance, building support staff, etc. GSA proposed a "superseding lease" meaning a new lease with new terms would go into effect before the expiration of the existing lease. As such, staff from GSA, NOAA and KIB have been meeting regularly and working cooperatively to negotiate a new lease that is agreeable and clear to all parties involved. The new lease was for 20 years with 15 years firm and a possible five-year extension. LEDOUX moved to postpone Resolution No. FY2016-33 to a special meeting of the assembly. CROW moved to amend to postpone Resolution No. FY2016-33 to the next regular meeting of the assembly. ROLL CALL VOTE ON MOTION TO POSTPONE CARRIED UNANIMOUSLY: LeDoux, Peterson, Stephens, Symmons, and Crow. ROLL CALL VOTE ON MOTION AS AMENDED CARRIED UNANIMOUSLY: Peterson, Stephens, Symmons, Crow and LeDoux. Ordinances for Introduction None. Other Items None. CITIZENS' COMMENTS Betty MacTavish spoke against Contract No. FY2016-44. Judi Kidder spoke in support of reconsideration of Contract No. FY2016-44 at a future date because the entire Assembly should be present to vote on important issues. Sam Rohrer spoke in support of assembly discussion within a public meeting rather than comments through public media. Kodiak Island Borough Assembly Regular Meeting Minutes April 7, 2016 Page 1664 ASSEMBLY MEMBERS' COMMENTS Assembly member Symmons asked citizens to apply for a seat on the Marijuana Task Force, and expressed gratitude to Scott Bonney as a representative of Chiniak. Assembly member Stephens expressed disappointment that some believe one must limit their right of free speech upon election to public office. Assembly member LeDoux suggested that someone should write a letter of gratitude for the Arctic Care Innovative Readiness Training program, encouraged citizens to buy a pass to the Alaska State Parks, and expressed appreciation for the public comments. Assembly member Peterson expressed gratitude for the parliamentary procedure process. Assembly member Crow expressed his gratitude for being a part of the Assembly and encouraged involved citizens to run in the next election. Announcements Mayor Friend announced that the next Assembly work session would be held on Thursday, April 14 at 6:30 p.m. in the Borough Conference Room and the next Assembly regular meeting was scheduled for Thursday, April 21 at 6:30 p.m. in the Borough Assembly Chambers. He encouraged people to apply for a seat on the Marijuana Task Force. ADJOURNMENT PETERSON moved to adjourn the meeting.
