FY2016-16 7 8 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND 9 BOROUGH REZONING A t 28.9 ACRE PORTION OF TRACT B, U.S. 10 SURVEY 4793 FROM R1-SINGLE FAMILY RESIDENTIAL DISTRICT 11 TO 1-INDUSTRIAL DISTRICT (P&Z CASE NO. 16-009) 12 13 WHEREAS, as a second class Borough, the Kodiak Island Borough excercises planning, 14 platting, and land use regulations on an area wide basis pursuant to Chapter 29.40 Alaska 15 Statutes; and 16 17 WHEREAS, in accordance with AS 29.40, the Kodiak Island Borough adopted the 2008 18 Comprehensive Plan update on December 6, 2007 (Ordinance No. FY2008-10) to replace 19 the 1968 Comprehensive Plan; and 20 21 WHEREAS, the Kodiak Island Borough has adopted KIBC Title 17 (Zoning) in accordance 22 with AS 29.40 to implement the Kodiak Island Borough Comprehensive Plan; and 23 24 WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity, convenience, 25 general welfare or good zoning practice requires, the assembly may, by ordinance and 26 after report thereon by the commission and public hearing as required by law, amend, 27 supplement, modify, repeal or otherwise change these regulations and the boundaries of 28 the districts;" and 29 30 WHEREAS, the Planning and Zoning Commission received a request to rezone a portion 31 of Tract B, U.S. Survey 4793 from R1-Single-family Residential District to I-Industrial 32 District; and 33 34 WHEREAS, at an advertised public hearing, consistent with Kodiak Island Borough Code 35 17.205.040, the Commission considered the merits of the rezone request; and 36 37 WHEREAS, the Commission voted to recommend to the Borough Assembly that site be 38 rezoned from R1-Single-family Residential District to I-Industrial District finding that the 39 public necessity, convenience, general welfare, and good zoning practice would be 40 enhanced by such action; and 41 42 WHEREAS, the Commission hereby recommends that this rezone request be reviewed 43 and approved by the Borough Assembly. 44 45 46 Kodiak Island Borough, Alaska Ordinance No. FY2016-16 Page 1 of 2 47 48 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND 49 BOROUGH that: 50 51 Section 1: This ordinance is not of a general and permanent nature and shall not 52 become a part of the Kodiak Island Borough Code of Ordinances; and 53 54 Section 2: A t 28.9 acre portion of Tract B, U.S. Survey 4793, as shown in attached 55 Exhibit A, is hereby rezoned from R1-Single-family Residential District to I- 56 Industrial District. 57 58 ADOPTED BY THE ASSEMBLY OF THE KODIAK ISLAND BOROUGH 59 THIS THIRD DAY OF MARCH, 2016 60 61 KODIAK ISLAND BOROUGH 62 63 64 65 rrol Frien , Borough Mayor 66 67 ATTEST: 68 nA 69 70 nm 71 Nova M.
