9 AN ORDINANCE OF THE ASSEMBLY OF THE KODIAK ISLAND
10 BOROUGH AMENDING THE 2008 COMPREHENSIVE PLAN BY
11 CHANGING THE FUTURE LAND USE DESIGNATION OF A ± 28.9
12 ACRE PORTION OF TRACT B, U.S. SURVEY 4793 FROM

16 WHEREAS, as a second class Borough, the Kodiak Island Borough excercises
17 planning, platting, and land use regulations on an area wide basis pursuant to Chapter
18 29.40 Alaska Statutes; and
19
20 WHEREAS, in accordance with AS 29.40, the Kodiak Island Borough adopted the 2008
21 Comprehensive Plan update on December 6, 2007 (Ordinance No. FY2008-10) to replace
22 the 1968 Comprehensive Plan; and
23
24 WHEREAS, the Kodiak Island Borough has adopted KIBC Title 17 (Zoning) in
25 accordance with AS 29.40 to implement the Kodiak Island Borough Comprehensive Plan;
26 and
27
28 WHEREAS, KIBC 17.205.010 provides that "Whenever the public necessity,
29 convenience, general welfare or good zoning practice requires, the assembly may, by
30 ordinance and after report thereon by the commission and public hearing as required by
31 law, amend, supplement, modify, repeal or otherwise change these regulations and the
32 boundaries of the districts;" and
33
34 WHEREAS, the Planning and Zoning Commission received a request to amend the
35 2008 Comprehensive Plan to change the Future Land Use Designation of a portion of
36 Tract B, U.S. Survey 4793 from Conservation to Industrial/Light Industrial; and
37
38 WHEREAS, at an advertised public hearing, consistent with Kodiak Island Borough
39 Code 17.205.040, the Commission considered the merits of the Comprehensive Plan
40 amendment request; and
41
42 WHEREAS, the Commission voted to recommend to the Borough Assembly that the
43 Comprehensive Plan Future Land Use Designation of this site be changed from
44 Conservation to Industrial/Light Industrial finding that the public necessity, convenience,
45 general welfare, and good zoning practice would be enhanced by such action; and
46
47 WHEREAS, the Commission hereby recommends that this amendment request be
48 reviewed and approved by the Borough Assembly.

52 NOW, THEREFORE, BE IT ORDAINED BY THE ASSEMBLY OF THE KODIAK ISLAND
53 BOROUGH that:

55 Section 1: This ordinance is not of a general and permanent nature and shall not
56 become a part of the Kodiak Island Borough Code of Ordinances; and
57
58 Section 2: The 2008 Comprehensive Plan Future Land Use Designation of a ± 28.9
59 acre portion of Tract B, U.S. Survey 4793, as shown in attached Exhibit A,
60 is hereby changed from Conservation to Industrial/Light Industrial.
