11 FOR THE YEARS 2015-2020

13 WHEREAS, a strategic plan consisting of priorities of the Borough is needed to guide the
14 budget process and ensure that the Assembly clearly communicates its priorities to
15 Borough staff and the public;and

17 WHEREAS, the Kodiak Island Borough Assembly conducted a strategic planning
18 meeting on Saturday,January 17,2015 to determine the priorities for the Borough;and
19
20 WHEREAS, the Assembly identified four strategic directions and seven 2015 priorities
21 for its strategic plan and desires to adopt these by resolution; and
22
23 NOW, THEREFORE BE IT RESOLVED BY THE KODIAK ISLAND BOROUGH
24 ASSEMBLY THAT that the Kodiak Island Borough Strategic Plan for the years 2015-2020
25 is hereby adopted; and

27 NOW, BE IT FURTHER RESOLVED BY THE KODIAK ISLAND BOROUGH ASSEMBLY
28 THAT Borough staff is hereby directed to develop action plans on the seven 2015 priorities
29 and in a period of six months to a year, submit performance measure reports on how these
30 priorities were addressed.

beyond any exercised renewal options will be considered a "month-to-month"
extension. All terms and conditions as see forth in this Contract shall remain in

desired date or cancellation.
B. Termination: The Borough Manager may terminate this Contract upon thirty
(30)days prior notice, Example if the Contractor receives three letters from the
Borough Manager or designee for documented non-performance,,which bus not
been amended or resolved in a timely manner,or for multiple equipment break
downs,or for unavailability of equipment or labor needed to complete the work as
described in the Contract. The Borough Manager may rely on any
recommendations made by the Engineering and Facilities Director
3. RESPONSE TIME
A. The Contractor shall begin snow removal or sanding within 2 hours of directive
notification or as previously scheduled. If the Contractor does not respond in a
timely manner,the EnginecringtFocilitics Director or ku14wo,ticsignec may utilize
another contractor to respond to the work. The Contractor shall supply contact
numbers (cell, pager or message machine) that will allow the Kodiak Island
Borough to contact the Contractor anytime during the contract period.
B. Non-exclusive Work: If the Contractor does not respond to a non-emergency
work order in a timely manner,the Engineering and Facilities Director or hF,,A40F
designee and/or the Kodiak Island Borough Engineering and Facilities Director or
kw4wv,-dcsigncc may utilize a Contractor from one of the other service areas

4. SPECIAL EQUIPMENT
A. Sanders:The Contractor shall have two (2)sunders available with the primary
sander having a minimum eight(8)yard capacity,the secondary sander may have
a minimum of yard capacity,The Contractor shall Furnish sending
equipment suitable for spreading DI, rock chips, sand andfor salt on roadways
and parking lots.
H. Extraordinary Circumstances, In cases of heavy snowfall the Contractor
would be expected to work together with Engineering and Facilities Director or
designee to open driveways and parking lots as soon as possible and
would be able to charge for these extraordinary circumstances with prior
approval.
S. COSTS OF MATERIALS,SUPPLIES,AND EQUIPMENT
A. hlaterialst For all Borough approved materials actually used in the work, the
Contractor shall be reimbursed at rates set forth in the Bid Schedules. Material
transportation costs shall be provided for under the bid schedule and the
equipment rental rules.
B. Equipment: Two(2)Graders shall have a minimum of 1441.blades one must be
within a 2 hour delivery- One (1) loader with a minimum 3-yard bucket for
clearing intersections and heavy accumulated areas, and one(1) Loader,if used
for snow removal, can have a minimum of a 12-ft. blade capable of hydraulic
angle adjustment or a bucket capacity of 3 to 4 cubic yards. All equipment listed
in the equipment schedule must be in good working condition suitable for the
purpose for which the equipment is to be used. r44-p4m,amy and

Individual pieces of equipment or tools having a replacement value of one
hundred (IGO) dollars or less, whether or not consumed by use, shall be
considered to be small tools and no payment will be made therefore.
All equipment requiring license plates must have up
to date Alaska Plates. Vehicles and equipment must be clearly marked or
placarded with the contracting company name or Logo.All equipment must have
functioning surety warning I ights and all other lighting required to meet State and
Federal safety requirements.

6. SNOW REMOVAL
Requirements shall be performed in accordance with the following response
priorities The contractor or designee must contact the KIB, Engineering and
Facilities Director or designee by phone or text as to the start and stop times of all
priority level completion of each snow ccaent.The Contractor will inform the KIB,
Engineering and Facilities Director or designee by phone or text if any work
stoppage longer than 30 minutes occurs during work performance. Any damage

A. Priority I: Response-Bayside Fire Mall
Priority 2: Response—All School District parking areas,Borough

B. Special Circumstances: (i.e.unusually severe weather,heavy snow,freezing
conditions etc)may require a change in snow removal priorities. In those

13. STATE RATES
The Contractor shall famish necessary additional labor,not included in equipment rental
rates,at the rate specified in the Bid Schedule for straight time including ffirl benefits.
Premium rates for overtime will be paid for work performed under this contract above
eight (8) hours per day or rutty (40) hours per week. This overtime rate will be an
incremental amount to be applied on top of the straight hourly rate included in the Bid
Schedule.

la. BILLING DEADLINE
A. Invoicing.The Contractor shall submit to the Borough at the end of each month
invoices for the services and materials supplied during that month, Invoices for
that month will not be paid if not received by the Borough within thirty(30)
calendar days from the end of the month in which lie work was performed or
materials were supplied.
B. Renoris and Logs: The Contractor shall prepare and submit a "Daily Work
Report, Road Work Log and a copy of the Work Order if one was assigned"with
signed time sheets for each employee's day during periods when authorized work
is in progress Copia of all the forms are attached as Appendix B with exception
of the time sheets that will be provided by the Contractor.
15. 1NSII,'ILiNCE AND INDEMNIFICATION
1. Indemnification: To the fullest extent permitted by law, Contractor agrees to
defend, pay on behalf of, indemnify and hold harmless the Borough, its elected
and appointed officials,employees and volunteers and others working on behalf
of the Borouf,h against any and all claims,demands,suits or kiss, including all
costs connected therewith,,and for any damages which may be asserted,claimed
or recovered against or from the Borough, its elected and appointed officials,
employees and volunteers and others working on behalf of the Borough, by
reason of personal injury, including bodily injury or death and/or property
damage, including loss of use thereof, which arises out of or is in any way
connected or associated with this Contract.
B. Insurance: The Contractor shall not commence work until the Contractor has
obtained all the insurance required under this Contract and such insurance hos
been approved by the Owner,nor shall the Contractor allow any subcontractor to
commence work on its subcontract until the insurance required has been so
obtained. The Contractor shall maintain such insurance as will protect it From
claims under Workers' Compensation Acts and other employee benefit acts for
damages because of bodily injury,including death,to its employees and all others
for damages to property,any or all of which may arise out of or result rmm the
Contractor's operations under the Contract whether such operations be by itself or
by any subcontractor or anyone directly or indirectly employed by either of them.
Without limiting the Contractor's indemnification,it is agreed that the Contractor
will purchase„ at its own expense and maintain in force at all times during the
term of this Contract, the following policies of insurance. Failure to maintain
insurance may,at the option of the Borough Manager,is grounds for default and
the Borough Manager may terminate this Contract. Where specific limits are
shown, it is understood that they will be the minimum acceptable limits. If the

Contractor's policy contains higher limits, the Borough shall be entitled to
coverage to the extent of such higher limits. Contractor is responsible for all
deductibles. As a condition or award, certificates or insurance, with
endorsements, must be rumished to the Borough Engineering and facilities
Department.
These certificates must provide thirty(30)days prior notice to the Borough in the
event or cancellation,non-renewal or a material change in the policy. Proof of
insurance is required of the following:
A. Workers' Compensation Insurance; The Contractor shall provide and
maintain, foe all employees or the Contractor engaged in work under this
Contract, Workers!Compensation Insurance as required by applicable stoic law
(AS 23,30 045)for all employees to be engaged in work at the site of the project
under this Contract. This coverage must include statutory coverage for States in
which employees an engaging in work and employer's liability protection not less
than S 1,000,000 per person,S 1,000,000 per occurrence.
R. Comprehensive (Commerciall General Liability Insurance: with coverage
limits not less than two million ($2,000,000)dollars per occurrence and annual
aggregates where gencralty applicable and will include premise operations,
independent Contractors, products/completed operations, broad farm property
damage,blanket contractual and personal injury endorsements.
C. Comprehensive Automobile Liabil[JX Insurance: covering all owned, hired,
and non-owned vehicles and with coverage limits not less than $1,000,000 per
person, $1,000,000 per occurrence bodilyinjury, and $1,000,000 property
damage.
D. Additional Insured- The following shall be an Additional Insured:The Kodiak-
Island Borough,including all elected,and appointed officials,all employees and
volunteers,all boards,commissions,and/or authorities and their board members,
employees and volunteers. The Additional Insured shall be named on the
Contractor's coverage for Commercial General and vehicle liability.
16. TECHNICAL SPECIFICATIONS
Work under this contract shall be performed in accordance with State of Alaska Standard
Specifications for Highway Construction, dated 2004 and Title 16.80 of the Kodiak
Island Borough Code,which describes the Borough's Road Standards.
17. CONTRACTOR'S REPRESENTATIONS AND COVENANTS
A. The Contractor covenants agrees that all work shall be done to the complete
satisfaction or the Kodiak Island Borough,subject to inspection at all times and
approval by any participating agency of the Government of the United States of
America, and in accordance with the laws of the State of Alaska and rules and
regulations of such Federal agency.

B. The Contractor further covenants agrees to(i)perform all work and labor in the
best and most workmanlike manner and that all and every of said materials and
labor shall be in strict and entire conformity in every respect with the Contract

specified in the Contract Documents,all of which are by reference hereby made a
part of this Contract.
C. The Contractor hereby agrees to receive the prices set forth in the Bid Schedules

INSTRUCTION TO BIDDERS
1. General
The Kodiak Island Borough is concerned that all bids be submitted in a manner that ensures the bidding
process is fair and equitable to all Bidders in compliance with the requirements of the bid documents.
Particular attention of all Bidders is drawn to the provisions of this solicitation and the resulting contract
dealing with pre-bid inquiries and the duty of the Bidders to disclose any significant fact or question
which will adversely affect the cost or time of completion of this project.
Bidders are required to register, through the Kodiak Island Borough website or by contacting the
Engineering and Facilities Department directly,in order to receive bid packages.
Bidders are cautioned that they disregard these provisions at their own risk.
Bidders are directed to study and follow these instructions as to the method and form forsubmitting bids
so there will be no reason to reject a bid.
Bidders will find all required forms and documents contained within this assembly. Please take notice of
Section 6, "Bidders Checklist", as to which forms and documents are required for your bid to be
considered.
Z. Explanation to Bidders
All Bidders are requested to submit to the Owner written request for explanation,interpretation,or other
inquiry 4 days prior to the due date and time of the bidding requirements . All such inquiries will be
addressed in an official addendum that will be issued to all Bidders. CAUTION: These addenda will be
the only binding contractual commitment on the Owner. Any other response will be for information only
and shall not have contractual significance.
3. Conditions at Site of Work
All Bidders are cautioned to carefully read all of the attached documents that make up this bidding
process concerning the contractual responsibility of the Bidder for the conditions of this contract
4. Addenda Requirements
The bid documents provide for acknowledgement of each of the addenda to the drawings and/or
specifications on the bid. All addenda shall be acknowledged on the bid prior to reading or acceptance
of bid. If no addenda are received by the Bidder,the word"none"shall be shown. Every effort will be
made by the Kodiak Island Borough to ensure that contractors receive all addenda when issued.
Addenda will be Faxed or sent to the address provided when contract documents were requested. It is
unusual for no addenda to be issued. All Bidders are responsible for ensuring that they have received all

5. Preparation of Bids
Bids shall be submitted on the forms furnished,or copies thereof,and must be manually signed in ink. If
erasures or other changes appear on the forms,the person signing the bid must initial each erasure or
change.
The forms of bid will provide for quotation of prices as requested on the Bid Schedule. Where required
on the"Bid Schedule",bidders must quote on all items. Failure to do so will result in disqualification.
The Borough reserves the right to disqualify or refuse to receive a bid if bidder is in default for any of
the following reasons:
A. Uncompleted work which, in the judgment of the Borough, might hinder or prevent the prompt
completion of additional work if awarded.
B. Failure to pay or satisfactorily settle all bills due for labor and material on former contracts in force
at the time of issuance of bids.
C. Failure to comply with any qualification regulations of the Borough.
D. The Kodiak Island Borough will award this Project according to the provisions ofthe Kodiak Island

responsible to file a Notice of Completion with the DOL Wage& Hour Administration office. Final

Kodiak Island Borough to hold 10%of the final invoice cost,until all DOL requirements are met by the

demands, suits or loss, including all costs connected therewith, and for any damages which may be
asserted, claimed or recovered against or from the Kodiak Island Borough, its elected and appointed
officials,employees,volunteers or others working on behalf of the Kodiak Island Borough,by reason of
personal injury,including bodily injury or death and/or property damage,including loss of use thereof,
which arises out of or is in any way connected or associated with this contract.

Without limiting the Contractor's indemnification,it is agreed that the Contractor will purchase,at his
own expense and maintain in force at all times during the performance of services under this Contract,
the following policies of insurance. Failure to maintain insurance may,at the option of the Contracting
Officer, be deemed Defective Work and remedied in accordance with the Contract. Where specific
limits are shown,it is understood that they will be the minimum acceptable limits. If the Contractor's
policy contains higher limits, the Borough shall be entitled to coverage to the extent of such higher
limits. As a condition of award,certificates of insurance must be furnished to the Contracting Officer.
These certificates must provide thirty(30)day prior notice to the Borough in the event of cancellation,
non-renewal or a material change in the policy. Proof of insurance is required of the following:
A. Workers' Compensation Insurance
The Contractor shall provide and maintain,for all employees of the Contractor engaged
in work under this Contract,Workers'Compensation Insurance as required by applicable
state law (A.S. 23.30.045) for all employees to be engaged in work at the site of the
project under this Agreement.This coverage must include statutory coverage for States in
which employees are engaging in work and employer's liability protection not less than
$1,000,000 per person,$1,000,000 per occurrence.
B. Comprehensive(Commercial)General Liability Insurance with coverage limits not less
than two million ($2,000,000) dollars per occurrence and annual aggregates where
generally applicable and will include premise operations, independent contractors,
products/completed operations, broad form property damage, blanket contractual and
personal injury endorsements. The Kodiak Island Borough shall be named as an
"Additional Insured"under all liability coverage listed above.
C. Comprehensive Automobile Liability Insurance covering all owned,hired,and non-owned
vehicles and with coverage limits not less than$1,000,000 per person,$1,000,000 per
occurrence bodily injury,and$1,000,000 property damage.
Additional Insured: The following shall be an Additional Insured: The Kodiak Island Borough,
including all elected,and appointed officials,all employees and volunteers,all boards,commissions,
and/or authorities and their board members,employees and volunteers.The Additional Insured shall be
named on the Contractor's coverage for Commercial General and Vehicle liability.
13. Payment
Payment for services rendered under this Agreement shall be made by the Kodiak island Borough within
thirty [30] days of completion/delivery, acceptance by the Kodiak Island Borough and invoicing by

Purpose:
This memorandum provides responses to/additional information for the recommendations for options
to handle solid waste presented to the Assembly by the Solid Waste Advisory Board as part of the
December 29,2015 Work Session. This memorandum also presents a summary of the responses to the
Solid Waste Questionnaire completed by the public in September/October 2015.

1.Do not extend Alaska Waste contract. Renegotiate Solid Waste Contract prior to expiration.
• The KIB Assembly may want to consider negotiating an extension of the AK Waste
contract to allow sufficient time to:
a. Determine the specifics regarding solid waste handling and collection (for example the
use of Dumpster Clusters and/or Transfer Stations, Re-Use Center, and/or Roll Cart /
curbside collection).
b. Draft, review(including Assembly and legal counsel review) and then advertise/issue a
new RFP which will need to include the specific solid waste handling and collection
requirements recommended by SWAB and the Assembly.
Note: The existing contract with AK Waste can be renegotiated—at any time—to conform to the
KIB Assembly recommendations/changes regarding handling of solid waste. Potential benefits of
re-negotiating could include capitalizing the costs of procuring bear resistant roll cart for selected

• During the Work Session,the Assembly requested information regarding public input on
the question of Roll Cart versus Dumpster usage/satisfaction. Questions addressing Roll
Cart versus Dumpster usage/satisfaction were Included In the survey.
Specifically:
Question 2f: 66%of those customers with Roll Carts would like to continue using Roll Carts.
Question 2g: 58%of the Roll Cart users did not want to use a dumpster.
Question 2h: 71%of the Roll Cart users would like to have bear resistant Rall Carts.
Question 2j: 79%of the Roll Cart users did not want to pay an additional fee for bear resistant Roll

3.Change Borough code to restrict roll carts being placed next to curb prior to 6:00 AM.
• Staff suggests / recommends changing the KIB Code to require placing roll-carts at the
curb the morning of pickup—do not reference a specific time.
4. Schedule garbage collection after 7:00 AM.
• Staff suggests / recommends discussing any proposed changes to the collection time
internally with Contractor and Landfill Operators for prior approval.
5.Replace all residential dumpsters with bear resistant dumpsters.
• Alaska Waste is currently switching out the last two non-bear resistant residential
dumpsters to bear resistant dumpsters.
6.Set up dumpster clusters in strategic locations.If feasible,cluster sites will be graded,fenced and
accompanied with bins for cardboard and plastics.
• If Dumpsters Clusters and/or Transfer Stations are chosen,then the following should be
considered:
a) Locations for the Dumpster Clusters and/or Transfer Stations have not been selected /
evaluated—site selection should include input from the KIB Lands Committee for selection
of specific properties.
b)Costs to improve the sites has not been estimated/determined. Staff will need specifics
regarding the improvements (for example grading, fencing, lights, cameras) before
determining the costs. Estimate$15K to$20K per site for improvements such as purchased
/placement of gravel,purchase/installation of a fence on three sides of the site. This does

7.Construct Reuse Center in Dark Lake Area. It will include dumps_ter cluster which will accept reuse
item&__WIid_waste_and recvclables. It will be phased in with the coal of being traded. fenced. and
covered and will initially not be staffed until there is a need to do so.
• - If a Reuse Center is constructed In the Dark Lake Area, then the following should be
considered:
a) Location of Re-Use Center should include Input from the KIB Lands Committee for
selection of specific property.
b)Costs to improve the sites has not been estimated/determined. Staff will need specifics

Estimated total cost to clean Re-Use Center: $33.800 per_year/Assume two(2)hours per

Estimated total cost to dispose of waste removed from Re-use Center: 11.180 per year/
Assume One (1)ton of waste per week would require removal/disposal (Landfill Disposal
Fee$215 per ton).

The Kenai Peninsula Borough Solid Waste Department now
CL has a Household Hazardous Waste Reuse Station at the
Central Peninsula Landfill (CPI.).

The Borough accepts paints and stains in five-gallon or
Hsmaller containers that are at least 75%
® V full and in good condition. The paints
and stains will be placed in the Reuse e
19 Building behind the CPI:s
CL Multipurpose Building and be made "r
G �, available to the public.

VgThe public has access to this building during the regular
' landfill operating hours of 8:00 AM to 5:45 PM, seven
days per week
Members of the public desiring to acquire items from the
Reuse Station are required to sign a Material Acceptance
Form that releases the Borough from any liability before
removing any item from the Reuse Station.
This Reuse Program allows the Borough to save funds
IV otherwise spent disposing of the usable material through
the Household Hazardous Waste
Collection and Disposal Program. m

RE: R&R Bond Projects
Attached is a bundled list of the R&R bond projects as they were presented to the Assembly at
the work session on August 13,2015.These bundled projects were reviewed by KIB and KIBSD
staff and then presented to the KIBSD Facilities Review Committee. The Facilities Review
Committee recommended approval of the bundled projects and they were adopted by the KIBSD
Board as part of their Six-Year Capital Improvement Plan in March 2015.The bundled projects
were then submitted to the State and was issued project agreements in May 2015. The
Elcmentary Flooring and Boilers and Controls projects shown on the attached list are currently in
design,scheduled for construction this summer.
